STATUS OF PERMIT:
Permit to Operate for 3503T-TRANSFER-, Franklin County Transfer Station, was issued on December 16, 2015, and
will expire on December 1, 2020. Pursuant to 15A NCAC 13B .0201(c) and .0206(a), no later than June 1, 2020, the
permittee must submit a request to Section for a permit amendment and must update pertinent facility plans including,
but not limited to, the facility plan, operation plan and waste screening plan.
PURPOSE OF SITE VISIT:
Complaint follow up and complete compliance inspection. The Section received a complaint that cathode ray tubes
(CRT) TV's were being intentionally broken/smashed at the transfer station and sent to landfill.

OBSERVED VIOLATIONS:
A. 15A NCAC 13B .0402 OPERATIONAL REQUIREMENTS
Any person who maintains or operates a transfer facility shall maintain and operate the facility in conformance
with the following practices unless otherwise specified in the permit.
(1) Operational plans shall be approved and followed as specified for the facility.
And, (2) A facility shall only accept wastes which it is permitted to receive.
And, PERMIT TO OPERATE, ISSUED ON DECEMBER 16, 2015, ATTACHMENT 1 GENERAL
PERMIT CONDITIONS INFORMATION, PART I: GENERAL FACILITY
(5) By receiving waste at this facility, the permittee shall be considered to have accepted the terms and conditions
of this permit.
And, PERMIT TO OPERATE, ATTACHMENT 3 CONDITIONS OF PERMIT TO OPERATE
PART VI: TRANSFER STATION / TREATMENT AND PROCESSING UNIT
(3) The following, at a minimum, must not be accepted for disposal at the facility: hazardous waste, yard trash,
liquid wastes, regulated medical waste, sharps not properly packaged, regulated -asbestos containing material as
defined in 40 CFR 61, PCB waste as defined in 40 CFR 761, and wastes banned from disposal in North Carolina
by NCGS 130A-309.10(D.
And, (5) The permittee must not knowingly dispose of, or accept for transfer for subsequent disposal, municipal
solid waste that is generated within the boundaries of a unit of local government that by ordinance:
b. Requires generators or collectors of municipal solid waste to recycle that type or form of municipal solid waste.
Franklin County is in violation of 15A NCAC 13B .0402 (I and 2) and Permit Requirements Attachment], Part 1(5) and
Attachment 3, Part V1(3 and S) by receiving cathode ray tube (CRT) televisions in the transfer station, breaking the lead
glass of the CRTs and sending them to landfill in a transfer trailer mixed with MSW waste.
During the inspection, Brian Haynesworth said that if during a visual inspection of waste that comes into the transfer
station, they come across a flat screen TV, they set it aside to be taken with the e-waste. He also said that if an older TV
is found, then they break it up and send it with the MSW waste to the landfill. According to Mr. Haynesworth, they do
this for convenience and to reduce the volume of the waste. Phil Orozco, NC DEQ Hazardous Waste Section, informed
Mr. Haynesworth that there is lead in the glass of CRT, and that in addition to them being banned from the landfill,
breaking them can cause lead exposure. Mr. Orozco asked Mr. Haynesworth if they were also breaking the yolk to get
copper, and Mr. Haynesworth said they were not.

(5) Effective vector control measures shall be applied to control flies, rodents, and other insects or vermin.
And, (7) Appropriate method shall be provided to confine material subject to be blown by the wind within the
area.

(7) The facility must not cause nuisance conditions.
c. Waste may be stored on -site, in leak resistant transfer trailers, with watertight covers, a maximum of 24 hours
except that a minimal amount of waste may be stored for a maximum of 72 hours when the facility is closed
during a weekend or holiday. Storage of the waste must not cause any nuisance, such as odor or attraction of
vectors_
d. Effective vector control measures must be applied at all times to control any potential vectors including flies,
rodents, insects, and other vermin.
e. Control measures must be utilized to minimize and eliminate visible dust emissions and blowing litter.

Franklin County is in violation of I5A NCAC 13B .0402 (5 and 7) and Permit Requirements Attachment 3, Part VI, (7) (c,
d, and e) by leaving transfer trailers uncovered while being stored outside the transfer station. This issue was also noted
in Mary Whaley's February 19, 2018 Inspection Report.
During the inspection, a transfer trailer was stored outside the transfer station and was not covered. Mr. Haynesworth said
the trailers are covered when the transported comes to pick them up. As we approached the transfer trailer, a flock of
approximately 20 buzzards flew out of the open trailer. Additionally, there was windblown (or vector carried) waste on
the ground around the trailer. While we were there, I observed the transporter arrive and cover the trailer before hauling it
away. I informed Mr. Haynesworth that the trailers needed to be covered upon leaving the transfer station.
C. PERMIT TO OPERATE, ATTACHMENT 3 CONDITIONS OF PERMIT TO OPERATE
PART VI: TRANSFER STATION / TREATMENT AND PROCESSING UNIT
(6) The permittee must develop, and use, a training and screening program at the facility for detecting and
preventing unauthorized wastes from being accepted at the facility. At a minimum, the program must include:
a. Random inspections of incoming loads or other comparable procedures.
b. Records of all inspections
c. Training of personnel to recognize hazardous, liquid and other excluded waste types.
d. Development of a contingency plan to properly manage any identified hazardous, liquid, or other excluded or
unauthorized wastes. The plan must address identification, removal, storage and final disposition of these wastes.
And, FRANKLIN COUNTY OPERATION PLAN SECTION 8, HAZARD AND NUISANCE CONTROL,
8.1 WASTE INSPECTION
Visual inspections of each truckload are made at the scale, during unloading of their shipment onto a concrete
pad, and before loading onto the processing area. The truck and driver will be detained if objectionable material is
found during the unloading process. Random load inspections will be performed to abide by the minimum
requirement of 1 % screening of waste. This percentage can be raised depending on the type and nature of the
incoming waste... The shipment will be examined for the following prohibited and/or hazardous waste... waste
banned from landfill disposal by North Carolina statute.
Franklin County is in violation of Permit Requirement Attachment 3, Part VI, (6) (a, b, c, and d) and Franklin County
Operation Plan, Section 8.1 by failing to implement a waste screening program, conduct random inspections, record
inspections, train personnel and develop a contingency plan.
During the inspection, I asked Mr. Haynesworth for the transfer station's random waste screening inspection records, and
Mr. Haynesworth said they did not have those records because they were not performing the waste screening inspections.
D. PERMIT TO OPERATE, ATTACHMENT 3 CONDITIONS OF PERMIT TO OPERATE
PART VII: MISCELLANEOUS SOLID WASTE MANAGEMENT
(1) Waste received and product stored shall be maintained in containers or reasonably sized piles with adequate
fire breaks and lanes in accordance with the approved operation plans and pertinent rules.
And, FRANKLIN COUNTY OPERATION PLAN, SECTION 4 OPERATIONS DESCRIPTION, 4.12
YARD WASTE
Yard waste such as, brush, limbs, tree trunk and other debris (including pallets/clean lumber) is collected in an
area located at the entrance of the facility. All yard waste will be windrowed in the middle of the storage area until
ground. All yard waste is ground up twice a year and it is used for boiler fuel. There will be emergency access
between and around all piles.
Franklin County is in violation of Permit Requirement Attachment 3, Part VII, General (1) and Franklin County
Operation Plan, Section 4.12 by piling yard waste without fire breaks or lanes for emergency access and outside of the
approved yard waste area.

During the inspection, yard waste was piled along the service road going towards the closed landfill and pushed back
into the tree -line. Emergency access to the back side of this pile was blocked by the tree -line. Additionally, yard waste
within the yard waste area was not windrowed. This issue was also noted in Mary Whaley's February 19, 2018
Inspection Report. The yard waste area was full, and it appeared that the waste had not been processed in a while. Mr.
Haynesworth said the County was working with Full Circle Recycling to try to get rid of the yard waste.
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
ADDITIONAL COMMENTS
In addition to the Observed Violations noted above, the following compliance issues were discovered during the
inspection:
E. There was standing water on the scrap tire operational and storage area, and water was ponding under and within
yard waste in the yard waste area.
F. The closed landfill (3501-MSWLF-1984) was overgrown in places and had woody vegetation growing on it.
G. The closed landfill had no visible markers denoting the edge of waste.
H. Household hazardous waste was being stored without lids and secondary containment. This issue was also
noted in Mary Whaley's February 19, 2018 Inspection Report.
I. Batteries were being stored uncovered, broken batteries were stored on a pallet with not containment of battery
acid.
Non -conforming waste, including treated and engineered wood was in the yard waste collection area.
Franklin County must take the following corrective actions in order to resolve the above violations and
compliance issues within the timeframes noted:
1. Immediately stop breaking CRT televisions and monitors and sending CRTs to landfill. All
electronic waste, including CRTs, must be recycled. Follow the state's best management practices for
electronics management.
2. Immediately begin cover transfer trailers with watertight covers either while the trailer is still in the
transfer station or as soon as it leaves the transfer station.
3. Immediately begin to implement a waste screening program in accordance with the Operation Plan
and Operating Permit. Retain records of all random load inspections.
4. Immediately stop piling yard waste outside of the designated yard waste collection area. Within 30
days, move and windrow all yard waste that is currently along the service road to the designated yard
waste area and manage the waste in accordance with the Operation Plan and Operating Permit.
Within 30 days, begin processing the yard waste that has accumulated in the yard waste collection
area in accordance with the Operation Plan and Operating Permit.
5. Within 30 days, resurface or regrade the scrap tire collection area and the yard waste collection area
so that they shed water.
6. Within 30 days, remove woody vegetation and mow the closed MSW landfill.
7. Within 30 days, install edge of waste markers around the closed MSW landfill.
8. Within 30 days, provide secondary containment for household hazardous waste and keep containers
secured with lids.
9. Immediately begin storing any batteries that are cracked or broken in a bucket or bag to prevent
battery acid from leaking. Store batteries under a covered area or cover with a tarp at night and
during rain events.

10. Immediately remove all non -conforming waste from the yard waste area. Begin inspecting this area
on a regular basis for non -conforming waste.
