Issued April 12, 2018. PURPOSE OF SITE VISIT: Partial Facility Compliance Inspection STATUS OF PAST NOTED VIOLATIONS: None OBSERVED VIOLATIONS: 15A NCAC 13B .0542 - (f) Cover material requirements. (1) Except as provided in Subparagraph (3) of this Paragraph, the owners and operators of all C&DLF units must cover the solid waste with six inches of earthen material when the waste disposal area exceeds one-half acre and at least once weekly. Cover must be placed at more frequent intervals if necessary to control disease vectors, fires, odors, blowing litter, and scavenging. A notation of the date and time of the cover placement must be recorded in the operating record as specified in Paragraph (n) of this Rule. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 2 ADDITIONAL COMMENTS: 01 – The observed violation was due to insufficient cover material place on the working face ( > 0.5 ac ) and other areas of the landfill as stated in 15A NCAC 13B .0542 listed above. (Also noted on the last inspection report dated December 12, 2018). 02 – There is a problem getting the cover material to the working face due to the dump truck is broken down. The facility needs to find another truck to haul the cover material and stockpile the cover on the top of the landfill so the available equipment has access to the material. 03 – Compaction is mainly being done using a bulldozer and not using the compactor. This method will cause a loss of airspace and inhibit windblown trash. Some windblown trash was noted during this inspection. 04 – Incoming load records were reviewed and has required information. 05 – Edge of waste markers still needs to be replaced in several areas. 06 – This facility has 4 Certified Landfill Operators: Justin Harrison, expires 9/27/2022, Johnny Rascoe, expires 12/6/2021, Kimley Brown, expires 9/27/2022 and Ronald Brownfield, expires 10/19/2022. 07 – Scrap tires are being collected at this facility. Laced and stored into a closed top trailer. 08 – Scrap metal pile looks to be managed well. 09 – White goods containing CFC’s are upright until the CFC is removed and then marked with an X to indicate CFC has been removed. 10 – One Tarped load was screened at the scale house and then again on the working face during this inspection. 11 – There was 5 scrap tires pulled out of the waste stream on the landfill and awaiting removal to the scrap tire trailer. 12 – Several Conversations and follow-up inspections will be conducted with Justin Harrison – Landfill Manager to ensure compliance is met. 13 – Facility has required signage. 14 – Site is secured by fencing and locking gates. 15 – Concrete has been ground up and ready for use. 16 – Yard Waste pile is not looking to bad. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
