Subject: Request for abandoned UST removal
On May 11, 2001, the DWQ Groundwater Section in the Mooresville Regional Office received a
complaint of an old UST as well as questionable activity related to dumping oil at Hatley's Tire
Store in Concord, Cabarrus County. Personnel from the Groundwater Section and the UST
section investigated the complaint, including sampling water supply wells in the area. The oil
dumping claim is being investigated by the DWQ. The UST was determined to still be in the
ground at this location. The UST contained gasoline for commercial sale from 1946-1950. The
tank owner is deceased. The son of the owner provided information about the tank in an affidavit.
The surrounding area is residential and there is no public water supply available. Many water
supply wells are located within.1500 of the UST.

Subject: Hatley's Tire Store

Complaint:
Complaint of an old, out of use UST and suspected oil dumping was received from DWQ,
Goundwater section on May 11, 2001.

Investigation Report:
On May 30 ,2001, Ms. Peggy Finley and I conducted a site visit. We were not able to contact the
property owner and the occupants of the property would not let us look around much. We did
notice many water supply wells in the area. We returned on June 13, 2001 to sample wells
surrounding the Hatley property. Those samples, received June 25, 2001, were all clean. An
affidavit was sent to Mr. Ed Hatley on July 31, 2001. He responded to the affidavit, claiming that
the tank had been out of use since 1950 and that his father was the only person to use the tank.
Since the only tank owner/operator is deceased, the site may be a candidate for a state lead
program. DWQ is investigating the claims of oil dumping.
