Dear Patrick:
The North Carolina Department of Environmental Quality (DEQ) Brownfields Program received
and reviewed the Vapor Mitigation System Installation and Pre-Occupancy Report, Units 1, 2, 3,
4, 5, 6, and 7, Revision #1 dated July 15, 2019. This report was submitted in accordance with
Land Use Restriction 6.c. of the recorded Notice of Brownfields Property. The summary report
and samples were for Units 1-7 of the development. DEQ Brownfields reviewed the indoor air
analytical data, the results of which do not exceed the DEQ cumulative carcinogenic risk or non-
carcinogenic hazard index. Therefore, the above referenced units are currently in compliance with
Land Use Restriction Number 6.c. of the Notice of Brownfields Property and may be occupied at
this time.
DEQ Brownfields understands that pressure monitoring will continue once every two weeks for
six months as outlined in the report’s recommendations and, following that, in accordance with
the approved VMS Design. These data will be submitted to DEQ Brownfields annually with the
LURU. However, should pressures not meet the required goal, or other concerns with the system
are identified, please contact DEQ Brownfields. In addition, as-built drawings will be provided as
soon as possible.

Please be advised that this approval from DEQ Brownfields does not waive any applicable
requirement to obtain any necessary permits, licenses or certifications which may be required from
