OBSERVED VIOLATIONS:
A. 15A North Carolina Administrative Code 13B .0566(4) states: `Adequate soil cover shall be applied monthly, or
when the active area reaches one acre in size, whichever occurs first. "
During the inspection, side slopes were observed to have inadequate (no) soil cover. Mr. Whitesides stated he applied
soil cover to the top but never to the side slopes. Therefore, T&L Grading, Inc. is in violation of 15A NCAC 13B
.0566(4).

B. 15A North Carolina Administrative Code 13B .0566(12) states: "Open burning of solid waste is prohibited. "
During an on -site inspection performed on July 11, 2019, the waste within the landfill was on fire. Upon arrival to the
facility smoke was observed. Mr. Whitesides was on -site and stated he brought land clearing debris from a
construction project at the state park to burn it. Facility staff was actively pushing soil to extinguish the fire. The area
where the land clearing debris was burning was adjacent to the landfill. Therefore, T&L Grading, Inc. is in violation
of 15A NCAC 13B .0566(12).
To achieve compliance with the violations listed above, actions must continue to ensure that the fire is
completely extinguished. Immediately discontinue acceptance of waste until the fire has been completely
extinguished. Notify Kim Sue, Environmental Senior Specialist, once the fire has been extinguished and it is
deemed safe to work within the landfill area. Within 30 days from the notification to the Environmental Senior
Specialist, the entire waste area must be covered with adequate soil including the working face as required by
15A NCAC 13B .0566(4).

C. 15A North Carolina Administrative Code 13B .0566(16) states: A sign shall be posted at the facility entrance
showing the contact name and number in case of an emergency and the permit number. The permit number
requirement is not applicable for facilities not requiring an individual permit. "
During the inspection it was observed that proper signage was not posted at the facility entrance. Therefore, T&L
Grading, Inc. is in violation of 15A NCAC 13B .0566(16).
To achieve compliance, a sign must be installed with proper information at the entrance to the facility by
August 15, 2019.
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
ADDITIONAL COMMENTS
1. This facility is a Land Clearing and Inert Debris landfill for the disposal of land clearing waste, inert debris,
untreated wood, and yard trash and requiring a disposal area of less than two acres.
2. A gate has been provided at the entrance of the site which appeared to be adequate to prevent unauthorized access to
the site.
3. Access roads within the facility were adequately maintained.
4. Install permanent waste boundary markers to ensure the disposal area of two acres is maintained.
5. When questioned why only the top of the landfill was covered with soil and not the side slopes Mr. Whitesides
stated that would take a lot of soil which he stated he does not have on site. It was discussed with Mr. Whitesides
he would have to make arrangements to have adequate soil available to cover per 15A NCAC 13B .0566(12).
6. Mr. Whitesides obtained a burning permit from the local fire department to burn the land clearing from the
construction project at the state park. The solid waste rule for open burning at a Land Clearing/Inert Debris (LCID)
Landfill was pointed out to Mr. Whitesides.
7. 15A NCAC 13B .0566(6) requires that adequate erosion control measures, structures, or devices shall be utilized to
prevent silt from leaving the site and to prevent excessive on site erosion. During the inspection, diversion berms
located within the access road leading to the skimmer basin were found to have no sedimentation control measures
at the outlets of the berms. Drainage from an unstable excavated area above the skimmer basin was diverted around
the basin via a diversion berm resulting in sediment depositing into the wooded area beyond the basin. This site has
been referred to the Gaston Natural Resources Department for erosion and sedimentation concerns.
