Dear Mr. Ratchford:
The erosion and sedimentation control plan submitted for the subject project has been
reviewed and is disapproved for the reasons listed on the attached sheet.
You may submit a revised erosion and sedimentation control plan for approval addressing
those items outlined on the enclosed dorm. Under the authority of NCGS I I3A-54.1(a)
and Section 9.6.6 of the Iredell County Land Development Code, this office has 15 days
from the date of receipt to approve or disapprove your revised plan. However, if you
wish to contest the disapproval of this plan, you must request an administrative hearing
within 60 days of your receipt of this Letter of Disapproval. This request must be in form
of a written petition, conforming to Chapterl50B of the North Carolina General Statutes,
and filed with the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh,
North Carolina 27699-6714. A copy of the petition must be served on this Department as
follows:

Pending approval of a revised plan or a decision on an appeal, commencement of any
Iand-disturbing activity associated with this project shall constitute a violation of the
Sedimentation Pollution Control Act of 1973 (NCGS 113A-51 through 66 and Section
8.12 of the Iredell County Land Development Code).

Required changes are designated as "RC" under legal authority from NC General
Statutes Chapter 113A Article 4 and the Iredell County Land Development Code.
Suggested changes are designated as "SC" for improvement of the plan.
1. The riser and pipe located under the fire road needs to be raised to the 815 contour
since there is no information regarding the location of coal ash in this area and to
keep a 5 foot separation between utilities and the potential coal ash. —RC
2. On the plan, clearly delineate the coal ash from the report generated from borings.

3. Provide a narrative on how to comply with the requirements of NC Department of
Environmental Quality, Division of Waste Management, concerning the removal
of material, where it is going, and how the site will be filled for compliance. —RC
