Dear Mr. Ratchford:
On March 22, 2019, the Solid Waste Section (Section) issued a Notice of Deficiency for activities being
conducted on the property containing the closed Race Park USA structural fill, CCB0053 in
Mooresville, Iredell County.
Following a meeting onsite on May 3, 2019, the final version of the coal ash subsurface report was
submitted detailing the cover thickness across the closed structural fill. Neill Grading and
Construction Co., Inc. excavated material from the sediment basin and surrounding berm that
contained ash residuals. Documentation was provided noting that a total of 167 truckloads of
material were hauled to the Republic Services Speedway landfill in Cabarrus County for proper
disposal. Sampling was conducted by Excel Civil & Environmental Associates, PLLC to ensure
material had been removed to meet the clean closure guidance document for coal ash removal and
was confirmed on May 20th,
During subsequent site visits, Division of Water Resources staff have observed grading activities on-
going on this site to raise the grade of the property several feet in the areas of the sediment basin and
construction road. It is understood that additional fill will be placed during Phase 2 over other areas
of the site including the closed structural fill.
Based on the above, this letter serves to confirm that the requirements of the Notice of Deficiency
dated March 22, 2019 have been satisfied and the violation(s) have been corrected.

Please forward a copy of the approved redesign drawings for Phase 2 utilities from Piedmont
Design as soon as you receive them. Department staff will then arrange a follow-up meeting
with you, your consultant and contractor to discuss future grading plans, including but not
limited to appropriate notification and contingency plans that may be required moving
forward.
