STATUS OF PAST NOTED VIOLATIONS:
None.
OBSERVED VIOLATIONS:
A. RESOLVED: 15A NCAC 13B .1626(2)(a) states, in part, "the owners or operators of all MSWLF units must
cover disposed solid waste with six inches of earthen material at the end of each operating day, or at more
frequent intervals if necessary, to control disease vectors, fires, odors, blowing litter, and scavenging."
During the July 9, 2019 inspection, the operations area and slopes surrounding the working face were observed to
have exposed waste and windblown litter. In addition, windblown litter had become trapped in the sediment of the
pond located adjacent to the working face. On July 11, 2019, during a follow-up inspection, the operations area
and surrounding slopes were found to have received adequate cover, and windblown litter had been collected and
returned to the working face. Trucks and equipment were able to maneuver throughout the operations area
without exposing waste. Windblown litter had also been removed from the sediment pond. Therefore, this
violation is considered to be resolved.

The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
ADDITIONAL COMMENTS
1. On July 9, 2019, the relocated collection area for concrete, asphalt and brick (CAB) was inspected. The access
roadway was in good condition, and the tipping area was configured to allow as much maneuvering room as
possible for heavy trucks and equipment. Mr. Cain pointed out the area where a new sediment basin would be
constructed once approval was obtained.
2. Several small pieces of painted concrete and a 2' section of corrugated plastic pipe were observed in the inert
debris stockpile. Mr. Cain had staff remove these unacceptable materials and take them to the working face for
proper disposal.
3. The CAB area was inspected again on July 11, 2019 and no unacceptable materials were observed. Please
ensure that inert debris loads are screened as they are unloaded, and that any unacceptable materials are
removed before the load is pushed up into the stockpile.
4. The white goods collection area was observed to be well -organized and clean, with an attendant on duty.
5. On July 9, 2019, the working face and surrounding operations area were inspected and found to have inadequate
cover that had resulted in exposed waste. Soil mixed with waste from the tipping area appeared to have been
spread by vehicle and equipment tires, and windblown litter had settled on the slopes. Mr. Cain provided photos
from the close of operations showing that all waste had been covered and windblown litter had been collected
and removed. (See Observed Violations section of this report for additional information.)
6. The working face and the surrounding operations area were inspected again on July 11, 2019 and appeared to
have adequate cover. Windblown litter was well controlled, and clean soil had been tracked in on the
surrounding slopes.
7. Mr. Cain stated that facility staff had begun work on cleaning out the sediment ponds. He explained that,
although the ponds had been cleared last fall, sediment had accumulated quickly as a result of frequent storm
events during the spring and early summer.
8. On July 9, 2019, the sediment pond immediately adjacent to the working face appeared to be almost full of
sediment. A layer of windblown litter had settled and become trapped on top of the sediment. On July 11, 2019,
the same sediment pond was observed, and all windblown litter had been removed. Mr. Cain pointed out that
clean -out of the pond was about 2/3 complete. (See Observed Violations section of this report for additional
information.)
