notice period had been met with no comments or additional questions and that we
intended to proceed with the project. This still remains true, however, we have the
following responses to your comments:
I. The Division of Waste Management has always been provided subsequent
notifications regarding changes per. 1703 (a), F uture changes will also be notified
to the Department of Waste Management.
2. The slopes depicted on the construction plans were not appropriately updated after
the wetlands delineation was performed and the tow -point subsequently moved,
and thus, the slopes depicted on the construction plans are incorrect. The
construction plans wilt be revised and resubmitted with the correct slopes, not
exceeding 3:1 ratio per Section. 1700 regulations. The change in estimated
volume due to revising the slopes is negligible; therefore, the estimated volume
and project end date are still accurate.
3. The Corp. of Engineers chose to use the Plumbline construction drawings instead
of field sketches, survey plats, etc., to document the wetlands delineation. A
Corp. of Engineers wetland determination form was submitted in the package and
specifically states the project was determined not to impact jurisdictional waters
or wetlands.
4. The access road described in the nature and purpose section is an additional access
road that was required for easy access to the CCB site. Please note this access
road will riot be constructed from CCB. However, the revised drawings will
depict the access road.
5. Any changes to the site will be performed in accordance with Section. 1700 for
the Beneficial Use of Coal Combustion Byproducts.
