Septage waste was observed directly in front of the hole. B. 15A NCAC 13B .0832(a)(6) states: “All conditions for permits issued in accordance with this Section shall be followed;” Gann Brothers Septic Tank Service, Inc. violated 15A NCAC 13B .0832(a)(6) in that it failed to abide with the following permit condition: Conditions of Operating Permit Number 2, which states: “Leaks and spills are the responsibility of the permittee and shall be immediately cleaned and treated to prevent any contamination of the surrounding area. ADDITIONAL COMMENTS 1. The Septage Detention and Treatment facility (SDTF) consisted of two 15,000-gallon and one 10,000-gallon above ground gravity fed tanks for storage and treatment of domestic septage and grease trap pumping. 2. Set-back/buffer requirements appear to have been met. 3. Appropriate signage (No Trespassing signs) is posted for the site. 4. All weather roads are maintained for access to the site. 5. The 10,000-gallon tank appeared to be structurally sound. Waste was no longer leaking from possible overfilling out of a hole in the top. 6. The 15,000-gallon tank located on the left (looking from the access road) that appeared to be empty. This tank was previously observed with septage leaking out of the bottom of the tank. No leakage was observed. 7. The 15,000-tank located on the right (looking from the access road) has been previously repaired and in use however, and a hole in the tank along the welding seam was observed. In addition, waste was observed on the ground immediately in front of the hole. Photographs were submitted on 10/23/2018 indicating that the septage waste had been removed from the ground and lime applied. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. Photographs were submitted on 10/23/2018 indicating that the vegetation had been cleared.
