The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and
any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

ADDITIONAL COMMENTS:
On February 4, 2008, the Solid Waste Section issued a letter stating that they had received the documentation
necessary for the notification of the site and that they could start construction. It was estimated that the 6 acre
site would be completed by September, 2008 and that the site would have 64,000 cubic yards of coal ash
deposited.
2. The property is site situated 4.4 miles south of Weldon at 4752 Highway 301 in Halifax County. According to
the Halifax County Tax Assessor it is identified as Parcel # 0619899. The site was recorded by the property
owner, Otis N. Vaughan., with the Halifax County Register of Deeds on May 11, 2009. The recordation can be
found in Book 2009, Page 78.
3. According to the "Structural Fill Facility Documentation Report", URS Corporation, July 2009, a total of
165,500.82 tons of coal combustion products were utilized in the construction of the structural fill between
February 2008 and April 9, 2009. URS Corporation, 1600 Perimeter Park Drive- Suite 400, Morrisville, NC
27560, is the engineering firm which was contracted to oversee the engineering and construction of the site.
The coal ash was generated by Westmoreland Partners, Roanoke Valley Energy Plant, Weldon, NC.
4. The coal combustion products were utilized at this site to reclaim a licensed soil mining site and restore it to
pasture land. At the time of the inspection, the site was well vegetated with grasses, lespedeza and pines. No
structures were observed onsite.

5. Per 15A NCAC 1313.17050), the facility shall be covered with a minimum of 12-inches compacted earth and
an additional 6-inches of surface soil capable of supporting native vegetation. At the time of the inspection, the
site appeared to have sufficient cover and was being well maintained. A mowed path circles around the
structural fill.
