Center Street Lexington, NC 27292 PARTICIPANTS: Roger Jones, Public Services Manager — City of Lexington Susan Heim, Environmental Senior Specialist — Solid Waste Section STATUS OF PERMIT: Closed PURPOSE OF SITE VISIT: Post -closure Inspection STATUS OF PAST NOTED VIOLATIONS: 1. RESOLVED: 15A NCAC 02C .0108(k) states: "All non -water supply wells, including temporary wells, shall be secured with a locking well cap to ensure against unauthorized access and use." All monitoring wells had been fitted with new locks, and repairs to well caps had been made to prevent unauthorized access. In addition, Mr. Jones had flagged all of the well locations, making access easier. RESOLVED: 15A NCAC 02C .0108(o) states: "Each non -water supply well shall have permanently affixed an identification plate. The identification plate shall be constructed of a durable, waterproof, rustproof metal or other material approved by the Department as equivalent and shall contain the following information: (1) well contractor name and certification number; (2) date well completed; (3) total depth of well; (4) a warning that the well is not for water supply and that the groundwater may contain hazardous materials; (5) depth(s) to the top(s) and bottom(s) of the screen(s); and Page 1 of 4 D_E FACILITY COMPLIANCE INSPECTION REPORT NOFTH CAaOLiNA Division of Waste Management OepaNnent d EnvimmeMal Oualiry Solid Waste Section (6) the well identification number or name assigned by the well owner. All monitoring wells had been fitted with rustproof identification plates. RESOLVED: 15A NCAC 13B .0505(5)(b) states: "Surface water shall not be impounded over or in waste." During this inspection, the landfill cap was closely observed. The seeded areas had grown up in a mix of tall rye grass and lespedeza; and, vegetation was knee- to waist -high. No areas of ponding water were observed on the landfill cap. Mr. Jones pointed out several drainage ditch lines that had been revealed as a result of maintenance operations. These ditches appeared to be functional and properly sloped to convey water that sheet flows off the two landfill cells to the creek below. 4. RESOLVED: 15A NCAC 13B .0510(c) states, in part: "When a solid waste disposal site has been closed in accordance with the requirements of the Division, future necessary maintenance and water quality monitoring shall be the responsibility of the owner and the operator." The top of the landfill cap has been cleared of brush and trees, and Mr. Jones stated that a great deal of work had taken place to repair areas of subsidence and re- establish the integrity of the landfill cap. He explained that the city had used staff expertise to perform the maintenance tasks and noted that mowing would not occur again until the fall, after the vegetative cover had been given the opportunity to become well established. An additional inspection will be performed after mowing takes place in the fall to observe the landfill cap OBSERVED VIOLATIONS: None. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. ADDITIONAL COMMENTS: 1. The facility access road had been repaired, eliminating the large holes and humps that had developed over time. Loads of rock had been brought in to make the roadway navigable by vehicle. 2. Permanent edge -of -waste markers had been installed around the perimeter of the landfill. Mr. Jones pointed out that the markers indicate the approximate disposal boundary, because some spots were difficult to pinpoint exactly. The markers are dark green t-posts with white tops and are easy to spot. 3. Most monitoring wells were observed and found to be in good repair, with new locks and caps that are intact, and permanent rust -proof identification tags. Mr. Jones provided an invoice from the city's consultant certifying that all necessary repairs had been completed as required. All wells and the roadway access point for each had been flagged with bright red tape to make locating them easier. 4. Some of the monitoring wells still had encroaching vegetation, and Mr. Jones stated that the maintenance to remove it is ongoing. He added that regular mowing of the site will include maintenance of the areas immediately surrounding the wells. 5. Trees and woody growth had been removed from the top of the landfill. However, large trees and brush were observed on the side slopes. Mr. Jones stated that the city plans to manage these trees by removing dead or damaged trees when necessary and making any repairs to the cap that might be required as a result. 6. The entire top of the landfill had been mown and seeded, and the resulting vegetation had grown to a height of 2', and up to 4' in some spots. Mr. Jones explained that he intended to allow the vegetative cover to continue to grow and become well established before additional mowing, which would be scheduled for the fall. 7. Loads of dirt had been brought to the site to repair the areas of subsidence where water had become impounded on top of the landfill. No ponding water was observed at the facility. An additional inspection will be made after the fall mowing has taken place to better observe the condition of the landfill cap.
