STATUS OF PAST NOTED VIOLATIONS:
RESOLVED: 15A NCAC 13B .0203(d) states: `By receiving solid waste at a permitted facility, the permittee(s)
shall be considered to have accepted the conditions of the permit and shall comply with the conditions of the
permit." Permit to Operate No. 2909-LCID-2013, Attachment 2, Conditions of Permit to Construct, Part I, facility
specific condition 3.d. states, "The disposal unit boundary must be accurately identified with permanent markers."
Permit to Operate No. 2909-LCID-2013, Attachment 3, Conditions of Permit to Operate, Part I, facility specific
condition 7 states, "The permanent markers that accurately delineate the waste disposal boundary must be
maintained." Permanent edge of waste markers have been installed around the perimeter of the landfill
waste boundary. Markers are metal posts with white tops.

OBSERVED VIOLATIONS:
1. RESOLVED: 15A NCAC 13B .0566(2) states, "The facility shall only accept those solid wastes which it is
permitted to receive." During the inspection, a pile of red soil was observed on the west side of the landfill.
The soil pile contained large pieces of plastic sheeting. Mr. Johnson stated that the material had been hidden in
the incoming loads and not found until after the loads were dumped. On June 24, 2019, Mr. Phillips provided
photos indicating that the plastic had been removed from the soil pile and placed in the facility's dumpster for
proper disposal.

The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
ADDITIONAL COMMENTS
1. Since the previous inspection on October 2, 2018, the following corrective measures were completed:
• A permit renewal request was submitted to the Solid Waste Section, including an updated site plan;
• The renewal of the permit to operate was approved on January 30, 2019;
• Permanent edge of waste markers were installed around the perimeter of the waste disposal boundary;
• Unacceptable materials were removed from the unprocessed wood waste stockpile area.
2. The facility maintains a cover log that specifies dates when the landfill is fully covered with clean soil. During
the inspection, Mr. Johnson was not able to provide the facility cover log for review. He stated that Mr. Veach
was keeping the cover log, the Permit to Operate and the Operations Plan in his office. Ensure that the landfill
cover log and copies of the current Permit to Operate and the approved Operation Plan are kept at the
facility and are available for review upon request.
3. 15A NCAC 13B .0566(4) states, "Adequate soil cover shall be applied monthly, or when the active area
reaches one acre in size, whichever occurs first." An inspection of the active area of the landfill revealed a
large working face containing uncovered land clearing debris. When questioned, Mr. Johnson stated that he
couldn't recall the last time he had applied soil cover to the exposed waste in the landfill. The landfill cover log
was not available for review. Ensure that all waste in the landfill is covered with clean soil at least every 30
days.
4. 15A NCAC 13B .0566(3) states, "Solid waste shall be restricted to the smallest area feasible and
compacted as densely as practical into cells." The working face was observed to be spread across the width of
the excavated area and appeared to be almost vertical. It also appeared that land clearing debris had been pushed
off the top of the fill area, forming a loose pile, rather than being placed in the landfill in lifts and compacted, as
required. Ensure that the slope of the working face is maintained at a grade that allows heavy equipment
to maneuver safely, and that waste is placed in the landfill in lifts and compacted as it is placed.
5. It is recommended that all equipment operators receive training about the procedures and responsibilities that
must be incorporated into the daily operation of the permitted LCID landfill unit, as set forth in 15A NCAC
13B .0566 — Operational Requirements for Land Clearing/Inert Debris (LCID) Landfills. (You may access

6. On June 17, 2019, Mike Phillips came to the Winston-Salem Regional Office and met with Susan Heim to talk
through issues identified during the inspection on June 11, 2019. Mr. Phillips agreed to complete the
following actions by July 15, 2019 to ensure that the facility to remains in compliance with 15A NCAC
13B .0566:
• The remaining logs, brush and unprocessed wood waste currently stored on top of the landfill will be
moved to the wood waste collection area, located in the northwest corner of the site; (Only clean soil to
be used for landfill cover may be stockpiled on top of the fill area.)
• All waste disposed of in the landfill will be compacted and adequately covered;
• The slopes of the excavation area will be regraded and stabilized to prevent erosion.
