Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 2 ADDITIONAL COMMENTS 1. The investigation was conducted at 1933 Michelle Dr., Kannapolis, NC 28083 2. An anonymous complaint was received on 6/20/2019 concerning the dumping of septage waste on the property where it goes into a stream next to a white fence. The complainant said that he observed the activity from an R & R Pumping Service pumper vehicle. 3. On 6/24/2019, I (Troy Harrison) went to the site. The area did have what appeared to be silt and mud with a few items of trash and not septage. I spoke with Mr. Richard Kaylor by phone and he stated he had pumped the mud out a pond using a pumper vehicle that was recently inspected but not used for septage. 4. As a reminder, once a pumper vehicle has been used, all waste in the tank is considered septage and must be disposed of at a facility permitted to receive such waste. 5. The complaint is closed and no further is necessary.
