Summers and Son Landfill (phone conversation 03/09/16) STATUS OF PERMIT: Land Clearing and Inert Debris Landfill Notification recorded with the Guilford County Register of Deeds November 14, 2000 Current status of the Land Clearing and Inert Debris Landfill Notification is OPEN PURPOSE OF SITE VISIT: Comprehensive Inspection (to ensure that the notified land clearing and inert debris (LCID) landfill is in compliance with 15A North Carolina Administrative Code (NCAC) 13B .0563, .0564, and .0566) STATUS OF PAST NOTED VIOLATIONS: None OBSERVED VIOLATIONS: None The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 3 ADDITIONAL COMMENTS On March 9, 2016, John Patrone conducted a comprehensive inspection of the C.L. Summers and Son Landfill – LCID Landfill on Wagoner Road in Gibsonville, Guilford County. 1. The C.L. Summers and Son Landfill is a notified land clearing and inert debris (LCID) landfill. 2. The landfill is known as Summers LCID Landfill, Inc. 3. The LCID landfill is estimated to be < 2 acres. 4. The LCID landfill is primarily used by Clarence L. Summers and Son Trucking and Grading, Inc. but is open to the general public. 5. The LCID landfill is operated by Clarence L. Summers’ son – Clearance Summers. 6. Mr. Summers removes logs from land clearing debris (LCD) and stores them separately to cut for firewood. 7. Reusable concrete items are stored along the access road. 8. Per 15A NCAC 13B .0566(3), “Solid waste shall be restricted to the smallest area feasible and compacted as densely as practical into cells.” 9. Per 15A NCAC 13B .0566(4), “Adequate soil cover shall be applied monthly, or when the active area reaches one acre in size, whichever occurs first.” Ensure LCD in the area prior to current operations is adequately covered with soil and graded accordingly or moved to the working face and covered with soil. 10. Side slopes should be graded such that a 3:1 slope ratio is obtained or a ratio of which no indication of erosion or runoff is observed. 11. The SWS received a voicemail complaint on March 8, 2016 stating that demolition debris was dumped on site. Mr. Patrone conducted a site visit at the facility (03/09/16) and observed a load of demolition debris. Mr. Summers stated that the demolition debris was dumped by someone that gained access to the property a few weeks ago and that he hasn’t had time to haul it to a facility for proper disposal. 12. Mr. Summers was instructed to haul the demolition debris to a facility permitted to accept the material and obtain disposal receipts. 13. Mr. Summers was asked to ensure the landfill area is < 2 acres. 14. Mr. Summers was asked to adequately secure the area adjacent to the metal entrance gate such that vehicles cannot enter the site when the gate is closed and locked. 15. Mr. Summers was reminded to ensure that the gate is closed and locked when facility personnel are not on site. 16. Open burning of solid waste is prohibited. 17. The facility has an all-weather access road. 18. The facility has a proper sign. It is suggested that the facility identification number is also posted: N0550. 19. The facility is also a temporary disaster debris staging site (TDDSS). The TDDSS number is: DS41-005. 20. It is suggested that a sign with the TDDSS identification number is also posted. 21. If the TDDSS is activated, vegetative disaster debris is to be incorporated into the landfill. However, Mr. Summers stated that he may want to stage material on the property, adjacent to the LCID landfill. Mr. Patrone will observe the area to be used although, the TDDSS application illustrates that the entire property is acceptable for use. 22. The SWS will conduct a follow-up inspection in mid-April 2016 to observe that the LCD has been covered with soil, to discuss the LCID landfill fill area, to verify that the demolition debris has been removed and disposal receipts obtained, and to observe that the site is adequately secured when the gate is closed and locked. 23. A copy of the land clearing and inert debris landfill notification submitted to the SWS and a copy of the pertinent LCID rules is included with this inspection report.
