The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

ADDITIONAL COMMENTS:
1. The facility shall accept only the following waste: land clearing debris, untreated wood, yard trash and inert
debris, strictly limited to untreated concrete, brick, concrete block, uncontaminated soil, rock and gravel.
2. Any unacceptable materials must be separated from waste in incoming loads and disposed of properly at a
facility that has been permitted to accept it. Mr. Boyles stated that the landfill attendant will be screening every
load as it enters the facility and as the load is dumped. He added that any waste found would be returned to the
hauler and, if found after the hauler had left the facility, would be stored in a dumpster to await proper disposal
at a permitted MSW landfill. Mr. Boyles explained that the landfill and the property next door that is occupied
by his mother share a dumpster that is serviced regularly.
3. Unauthorized access to the facility is prevented by means of a locking gate, fencing, perimeter berms and wood
lines. Mr. Boyles stated that the gate will be kept locked unless there is an operator on duty at the site. He added
that he has installed video cameras on the site as an added means of security. Mr. Boyles also pointed out that
he lives directly across the road from the landfill and will be able to monitor the site when he is at home.
4. Proper signage was observed at the facility entrance, including emergency contact information and a list of
materials accepted for disposal.
5. The facility appeared to be clean and well -maintained. No unacceptable waste or windblown litter was
observed.
6. Heavy rains over the past week have left the site wet, and small amounts of ponding water were observed
throughout the facility.
7. Landfill operations will be conducted from an office located at the end of the entrance drive. Incoming waste
will be tracked by volume, and records will be stored either in the office or at Mr. Boyles' home. Please ensure
that facility records are available for inspection upon request.
8. Permanent edge -of -waste markers had been installed and were clearly visible. Mr. Boyles noted that markers
were in place for the 2-acre notified landfill as well as the larger landfill that will be going through the
permitting process in the near future.
9. Access roads are of all-weather construction and were found to be in good condition. No ponding water was
observed on the roadways.
10. The facility has an approved erosion control plan, and is inspected by the City of Winston-Salem/Forsyth
County Erosion Control Section. Prior to the inspection, a telephone conversation with Neil Uldrick, the erosion
control inspector handling the facility, confirmed that appropriate erosion control measures were incorporated
into the site and had been observed to be properly constructed and operational. Please ensure that erosion
control measures are properly maintained and that the facility complies with all provisions of the
approved erosion control plan.
11. An area located to the north of the 2-acre landfill footprint had been previously excavated. The slopes of the
excavated area were observed to be nearly vertical, and evidence of erosion was apparent. Please ensure that
excavation slopes are maintained at a grade that prevents erosion from occurring.
12. The area where the initial lift is to be placed had been prepared, and a pile of land clearing debris was already
staged and ready to be landfilled. Some water was observed to be ponding in this area. 15A NCAC 13B
.0566(11) states, "Solid waste shall not be disposed of in water." Ensure that the floor of the landfill is
reshaped to provide positive drainage, and that all water is eliminated prior to disposing of waste in the
landfill.
13. 15A NCAC 13B .0566(4) states, "Adequate soil cover shall be applied monthly, or when the active area
reaches one acre in size, whichever comes first." It is recommended that a cover log is maintained at the
facility that notes the dates when soil cover is applied to all waste in the landfill and how much soil is used.
Such a log would serve to demonstrate compliance with 15A NCAC 13B .0566(4).
