STATUS OF PERMIT:
A Permit to Operate a Treatment and Processing Facility, Land Clearing and Inert Debris Landfill and a Small Type 1 Composting Facility was issued on January 2, 2015. The Permit to Operate shall expire on March 25, 2019. Information regarding the permit renewal has been submitted and is under review by the Solid Waste Section-Permitting Branch. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

ADDITIONAL COMMENTS 1. Garick LLC d.b.a. Tarheel Bark is permitted as a treatment and processing facility, small Type 1 Compost facility and a Land Clearing and Inert Debris Landfill.
2. The LCID Landfill has been approved for excavation and mining for beneficial re-use of the yard waste and wood waste. The facility is not currently excavating or mining the LCID Landfill. The facility is required to notify the Section prior to any excavation work.
3. Take measures to remove trees and woody vegetation on the side slopes of the LCID to allow for proper monitoring and maintenance of the landfill. 4. Boundary markers delineating the approved disposal area of the LCID need to be located and/or replaced if needed.
5. The processing area includes the following activities:
• Raw pine bark is screened to nugget, mini nugget and pine fines.
• Hardwood material is brought in already processed and screened into hardwood fines. The hardwood fines are blended with screened fill dirt to make topsoil. 6. No unacceptable waste was observed. 7. Grading of the processing area is ongoing to allow for positive drainage. 8. Take measures to ensure that yard trash which is defined as solid waste resulting from landscaping and yard
maintenance such as brush, grass, leaves, tree limbs and similar vegetative material are composted and temperature records are maintained demonstrating that temperatures are maintained at or above 131° F for three consecutive days.
