RETURN RECEIPT REQUESTED Mike Garlock Kim Pierson Triple T Pumping 1372 NC Highway 194 N Boone, NC 28607 SUBJECT: Notice of Deficiency Compliance Inspection Report Triple T Pumping Troy Norris Road SDTF-95-01 Watauga County Dear Mr. Garlock & Ms. Pierson: On August 29, 2015, Troy Harrison, representing the State of North Carolina, Division of Waste Management Solid Waste Section, inspected the above referenced facility for compliance with North Carolina solid waste statues and rules. Mr. Eddie Jones was present and represented Triple T Pumping during the inspection. The following violation was noted:
15A North Carolina Administrative Code (NCAC) 13B .0841(g) states: Each detention and treatment
facility shall be designed, constructed, and maintained in such a manner as to: (1) Prevent leaks or the flow of septage out of the facility into the seasonally high water table, onto the ground surface, or into any surface waters;
Triple T Pumping was in violation of 15A NCAC 13B .0841(g) because a 1,000 concrete septage detention tank was observed leaking waste onto the ground. In addition, a spill was observed under a pump used to transport septage. The above deficiency may have or can compromise the facility’s ability to ensure protection of the public health and the environment and thus require remedial action on behalf of the facility in order to maintain compliance with 15A NCAC 13B .0841(g). In order to resolve these issues, Triple T Pumping must take the following corrective actions:
1. Immediately remove all waste from the tank and dispose at a properly permitted facility and discontinue use.
2. Immediately clean up all waste material on the ground that resulted from the leak and spill around the pump.
3. Treat the areas of the leak and spill with hydrated lime. By September 28, 2018, Triple T Pumping must provide a written certification with supporting documentation on company letterhead confirming the corrective actions have been completed. Include in this certification any actions taken to prevent these deficiencies from occurring in the future. Mail this certification to:

Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. Please keep me informed of your progress in this matter. Solid Waste Section staff will conduct follow-up inspection(s) to verify that the facility has completed the requirements of this Notice of Deficiency.
