OBSERVED VIOLATIONS: 15A North Carolina Administrative Code (NCAC) 13B .0838(j) states: Septage shall be transferred to and from a detention system in a manner that prevents leaks or spills of septage onto the ground surface or exterior surface of the detention system, including septage in pipes used for transferring waste to and from vehicles. Triple T Pumping was in violation of 15A NCAC 13B .0838(j) because septage from the dewatering facility operating under Septage Management Permit Number SDTF-95-01 flowed onto the ground onto neighboring property into a stream on March 8, 2019 during transfer of septage from a tank to a vehicle. The Septage Detention and Treatment facility (SDTF) consisted of one 100-gallon, two 4,000-gallon, three 1,000- gallon, one 6,000-gallon, one 10,000-gallon and one 12,000-gallon tanks. The nine tanks have a total capacity of 39,100 gallons for the storage of untreated and treated waste. In addition, one 6,000-gallon dewatering drum and one 30-yard dewatering box was also observed. 2. On Friday, March 8, 2019, at approximately 8:00 AM, Troy Harrison received a voice-mail message from Mike Garlock at Triple T Pumping that a spill had occurred at the SDTF facility to give him a call. The message was originally left at approximately 6:30 PM on March 7, 2019. I called Mr. Garlock at approximately 8:15 AM. He stated that an employee had a hose in the 6,000-gallon tank and when he put the hose down, the septage siphoned out onto the ground and into the woods. He stated that approximately 100 gallons went made it into a neighbors’ pond and approximately 400 or 500 gallons was released. He said that he had just called the Health Department. I advised Mr. Garlock to report in writing what occurred, and this was received at 1:10 PM. His statement read: “A driver was pumping out of the 6000 gallon holding tank of processed water and the driver laid the pump hose on the ground, driver left. The hose starting siphoning and the water hit the ditch line and down on the neighbors property and his pond. The neighbor called and we immediately sent a man to the site to check it and found the siphoning hose and stopped it. We called Troy Harrison to report it.” 3. I contacted Mr. Lon Snider, NC DWQ/WSRO and reported the spill to him. 4. I contacted Mr. Andy Blephen of the Appalachian Health District. He said that he has been in contact with the property owner where the pond is located and was going to visit the site on Monday. He stated that a video was taken of the event and resulted in the death of some frogs and fish. I called Mr. Snider and informed him about the fish kill report. 5. A complaint was received at approximately 2:30 PM concerning the spill via telephone concerning the spill. The complainant said the he was concerned about his well water and I advised him to check with the local health department concerning any well testing. I also provided contact information for DWQ/WSRO. The complainant said that a video was taken of the event and would be submitted to the Division. 6. Mr. Blethen submitted an email of the findings of his investigation that occurred on March 11, 2019. 7. On March 14, 2019, Mr. Harrison met with Mr. Blethen at the tanks to investigate of the spill. There was evidence that a spill had occurred however no odors were observed at the pond. There was a brown discoloration in the stream that began approximately 150 feet above where the spill entered the stream that appear to be iron bacteria. Pooled leachate was observed at the sump area below the dewatering area (see photo below). Mr. Garlock was contacted, and he said that the pump is automatic and there should be no pooled leachate and he would make sure that this is corrected. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
