Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. All photos were taken by Lee Hill on June 6, 2019. 2. The facility is approved to receive stumps, land clearing debris and untreated and unpainted wood. 3. The facility was secured by gate and signage was posted at the entrance with the permit number and emergency contact information. 4. The current operations plan and permit were available for review upon request. 5. Tonnage records from June 2018 to May 2019 were sent by email; the facility received 11,941 tons of material from Buncombe County and Henderson County during that period. 6. All wood and processed materials were being stored at least 50 feet from the property line and from the onsite stream. 7. Permanent boundary markers delineating the 50-foot setback to the property line were installed along the north and west sides of the facility. Permanent markers were also installed demarcating the 50-foot buffer for the onsite stream. 8. Interior roadways were being maintained and in good condition at the time of inspection. All windrows and stockpiles had adequate roadways around them to provide vehicular access in the event of a fire. 9. Unground land clearing debris was stored separately from unground pallets. No unapproved material was observed in the land clearing debris stockpile. Pallets with painted ends were observed in a recently dumped load. Facility staff stated that the would remove the painted portion and dispose of it in the onsite dumpster. 10. Surface water was being diverted from the operational and storage areas and no standing water was observed at the time of inspection. 11. The facility utilizes sprinklers to control dust and minimize airborne emissions when needed. 12. The facility was well managed at the time of inspection.
