OBSERVED VIOLATIONS: .0838(j) – (previously .0841(j) – Septage shall be transferred to and from a detention facility in a manner that prevents leaks or spills of septage onto the ground surface or exterior of the detention system, including septage in pipes used for transferring waste to and from vehicles. Noted a significant amount of septage debris on the top & sides of tanks #2 & #3 and also dark stains on the ground below. Completely clean up the top & sides of tanks #2 & #3 and the ground surface below and dispose of the waste properly. Review procedures/implement changes to prevent septage spills or tank overflows from occurring. This was requested on the previous audit. Train employees accordingly in proper procedures. Although these tanks will be decommissioned this summer they are still currently in use so spills shall be prevented. The required sign is posted and the access road is adequate. 3. No vectors or odors noted. 4. The approved setbacks are being met. 5. The required 5 foot cleared radius is present at this time. 6. The “pond” has been removed. Construction is ongoing at this time in regards to the permit modification. The concrete containment area is underway. Time/temp requirement will be met after tanks 101 & 102 and the containment area will provide more volume than these two tanks (25,000 each). Walked thru site and discussed construction changes (new waste process) to be implemented. Discussed setbacks, reviewed/tweaked permit submittal & treatment logs. Additional review of operation manual needed and final site drawings will be submitted for pre-operational inspection. Screening debris & dewatered solids will be sent to the landfill for disposal. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
