OBSERVED VIOLATIONS:
A. 15A NCAC 13B.1626(2)(a): states: "Except as provided in Sub -Item (b) of this Item, the owners or operators
of all MSWLF units must cover disposed solid waste with six inches of earthen material at the end of each
operating day, or at more frequent intervals if necessary, to control disease vectors, fires, odors, blowing litter,
and scavenging."
B. 15A NCAC 13B .0203(d) states in part: "...by receiving solid waste at a permitted facility, the permittee(s) shall
be considered to have accepted the conditions of the permit and shall comply with the conditions of the permit."
The approved operations plan "Operation Plan", (FID 1319745) states in section 5.2, 2(a) Operational
Requirements,: "Cover material requirements Except as in Part (b), The County must cover disposed solid waste
with six inches of earthen material at the end of each operating day, or at more frequent intervals if necessary, to
control disease vectors, fires, odors blowing litter, and scavenging."

Cherokee County is in violation of 15A NCAC 13B.1626(2)(a) and 15A NCAC 13B.0203(d) in that
uncovered waste was observed on the northern slope of the landfill and on the working face was
uncovered during a pre -operational inspection of the landfill. On the morning of May 23, 2019 at 7:00
am, a pre -operational inspection of the landfill was conducted to ensure that waste was being covered at
the end of each working day. During that inspection a trench with varying dimensions containing
uncovered waste had been installed down the length of the northern slope. This trench appeared to be
functioning as an extension of the working face. Both the trench and the entire working face were
observed to be completely uncovered prior to staff arriving to start operations.
To achieve compliance, Cherokee County must immediately cover all waste with a minimum of six inches or
earthen material and ensure that all waste is completely covered at the end of every day of operation.

The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
ADDITIONAL COMMENTS
1. All photographs were taken by Lee Hill on May 23, 2019.
2. A pre -operational inspection of the landfill was conducted at 7:00 am to ensure that all waste was being covered
at the end of each day as required by 15A NCAC 13B.1626(2)(a).
3. The working face was observed to be completely uncovered prior staff arriving to begin operations.
4. A trench with varying dimensions was located on the northern slope at the edge of the working face, extending
from the top of the slope to a point approximately three quarters of the of the distance to the toe. The trench
contained a layer of trash which was also uncovered. Staff stated that the waste had been placed in the trench
during the course of operations.
5. A tarp had been positioned down the slope to the northeast of the working face. Leachate was observed running
from under the tarp down the slope. The leachate did not appear to leave the liner of the cell. Ensure all
leachate seeps are repaired promptly.
6. Since the previous inspection, some repair work had been accomplished on the eastern slope and to the west of
the working face on the northern slope.
7. Scrap tires were observed in various locations around the active landfill. Scrap tires are banned from landfill

disposal. Scrap tires must be removed from the operations area and taken to the scrap tire trailer for
proper disposal.
8. Some windblown litter could be seen at the edge of the wood line to the west of the working face. Ensure that
windblown litter is collected and returned to the working face at the end of each operating day.
9. Facility staff sent pictures at the end of the working day on May 23, 2019 that appeared to show improvement
of waste coverage.
10. Additional pre -operational inspections will be conducted to ensure that the facility is in compliance with
15A NCAC 13B.1626(2)(a) and 15A NCAC 13B.0203(d).
