Project Engineer Smith + Gardner, Inc. 14 N Boylan Ave. Raleigh, NC 27603 NORTH CAROLINA Environmental Quality February 4, 2019 SUBJECT: Compliance Inspection Report — October 25, 2018 Fogleman and Fogleman Landfill and Recycling Facility Permit No. 32F-LCID- Durham, North Carolina Dear Mr. Hollomon, The Solid Waste Section (Section) has reviewed the response letter, dated December 7, 2018, submitted on behalf of Fogleman and Fogleman Landfill and Recycling Facility (Fogleman LCID) by Smith + Gardner, Inc (S+G). The letter outlines the planned response actions to address issues noted in the October 25, 2018 compliance inspection report and sets a proposed timeline for corrective actions. Additionally, the letter includes photo evidence of corrective actions taken at Fogleman LCID. According to the photos, Fogleman LCID has added soil cover to Case A (as defined in the letter). I appreciate your effort to resolve this area quickly. S+G on behalf of Fogleman LCID requested a 45-day extension to cover Case B. Given that 45 days have past, as of January 15, 2019, Case B should be covered. S+G on behalf of Fogleman LCID requested an indeterminate timeframe for covering Case C, covering as filling progresses. The method of covering in lifts is acceptable, however, the Section places at a minimum contingency that if incoming tonnage does not allow Fogleman LCID to address the area of Case C within 60 days of the date of this letter, they move to place additional soil cover. The concern here is, as you stated, fire. Land clearing material protruding from uncovered slopes is not the entire scope of the fire risk. Risk of fire increases due to voids caused by any debris (including concrete and other visible inert waste) creating pockets in the waste, allowing oxygen to flow in.
