STATUS OF PAST NOTED VIOLATIONS:
A. Corrective measures in progress: 15A NCAC 13B .1626(2)(a) states in part: “the owners or operators of all MSWLF units must cover disposed solid waste with six inches of earthen material at the end of each
operating day.” Significant progress had been made since the last inspection to cover landfill slopes and the working face. However, this violation is not resolved as waste was observed around the tipping area prior to the commencing landfill operations on the day of the inspection. The County of Randolph, N.C. and Waste Management of Carolinas, Inc. must immediately cover disposed solid waste with six inches of earthen material and/or an approved alternative daily cover material and at the end of each operating day, including
the waste exposed in the cut slope at the juncture of Cell 2 and Cell 3 under construction.

day of operation, all windblown material resulting from the operation shall be collected and returned to the area
by the owner or operator." At the time of the inspection a small amount of windblown waste was still observed on the northern slope. The County of Randolph, N.C. and Waste Management of Carolinas, Inc. must immediately collect and properly dispose of all windblown litter at the facility and by the conclusion of each day of operations.
Still some windblown waste observed on north slope of active cell during inspection. Appears to be from tipping area.

OBSERVED VIOLATIONS A. 15A North Carolina Administrative Code 13B .1626(8)(d) states in part: “Leachate shall be contained within a lined disposal cell or leachate collection and storage system. All leachate shall be treated, as required by the receiving facility, prior to discharge.” During the inspection, a leachate outbreak was observed in the low area between the lined cell 2 and the unlined cell 3. Flow from the outbreak went into the low area of cell 3. A berm was placed in this area of cell 3 to capture the leachate. Leachate was observed ponded inside this berm and some leachate was observed outside of this area. The County of Randolph, N.C. and Waste Management of Carolinas, Inc. are
in violation of 15A NCAC 13B .1626(8)(d) in that leachate was not contained within the lined disposal cell or leachate containment and storage system.

Leachate observed outside of berm in cell 3. To achieve compliance, within 10-days of receipt of this inspection report, Waste Management and Randolph County must make all necessary repairs to seam between Phase 2 and Phase 3 at the location of the leachate outbreak. Waste Management must also follow Soil Sampling Plan, submitted by SCS Engineering on behalf of Waste Management, Inc. and approved by the Solid Waste Section on May 3, 2019, to determine the impact of the leachate release. Prior to the issuance of this inspection report, Mr. Misenheimer, with Waste Management, submitted a report showing corrective actions done on site and sampling that is being conducted in this area. Corrective actions appear timely and adequate. All corrective measures must meet requirements set forth by Solid Waste Section Hydrologist, Christine Ritter.
This was the second leachate release in this area since the previous inspection. A Soil Sampling Plan for soils affected by leachate releases at the Great Oak Landfill, submitted by SCS Engineers on behalf of Waste Management, was approved on May 3, 2019 by the Solid Waste Section for a release that was observed by the facility on April 18, 2019. The facility has sampled the soils and results are pending.
ADDITIONAL COMMENTS
On May 16, 2019, Chuck Kirchner met with Dan Moore from Waste Management to conduct a partial inspection of the Great Oak Landfill on Old Cedar Falls Road in Randleman, Randolph County. This inspection was a compliance inspection for the April 10, 2019 Notice of Violation. 1. The Great Oak Landfill is a municipal solid waste (MSW) landfill owned by Randolph County and operated by Waste Management of Carolinas, Inc.
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

2. Follow-up inspections have been performed on April 23, 2019 and May 16, 2019 to follow up on the April 10, 2019 Notice of Violation and the Waste Management response letter dated April 19, 2019. 3. Tarps were observed being removed from the working face prior to operations during this inspection. 4. Per 15A NCAC 13B .1604(L)(iii) any leachate release shall be reported orally within 24 hours from the time the permittee becomes aware of the circumstances of any release or discharge outside the liner, collection system or other containment component. A leachate discharge into a lined containment berm shall still require notification
since this liner is not part of the designed leachate collection/treatment system. 5. Several areas were seeded and mulched as previously requested, to include the slope above the landfill.

6. All photographs were taken by Chuck Kirchner during the inspection on May 16, 2019. 7. During the inspection, working face operations were starting for the day in Cell 2. All uncovered waste shown in photographs was documented prior to commencing solid waste disposal activities. 8. The facility does not accept scrap tires or white goods. These were not observed on site during the inspection. 9. The operations plan states that the facility may use reusable tarps, auto-shredder fluff, and petroleum contaminated soil as ADC. 10. It was previously noted that the facility uses tarps Monday through Friday and covers with soil on Saturday. All waste needs to be returned to the working face or adequately covered at the conclusion of operations each day. Any previous day’s cover utilized for cover the following day must be covered with an adequate amount of clean soil to prevent waste from being exposed.

11. Accumulated sediment needs to be removed from the sediment basin below the active cell area as noted on April 29, 2019 facility inspection report. Mr. Moore stated that this work had been approved but has not started to date. In addition, accumulated sediment in front of the check dam by the creek crossing needs to be removed and the ditch line stabilized as discussed in the field. 12. Sediment basins are required to be cleaned out when sediment accumulates to ½ of the design depth as specified in the facility operations plan.
