The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

ADDITIONAL COMMENTS
On May 22, 2019, Chuck Kirchner met with Norman and Tim Westmoreland for the purpose of conducting a
comprehensive inspection of the Westmoreland LCID Landfill on Lester Road in Stokesdale, Guilford County. 1. The Westmoreland land clearing and inert debris (LCID) landfill is located on Lester Road in Stokesdale. Mr. Westmoreland’s residence is located on the property, near the LCID landfill. 2. This inspection was to ensure that the notified land clearing and inert debris (LCID) landfill is in compliance with 15A North Carolina Administrative Code (NCAC) 13B .0563, .0564, and .0566. 3. The LCID landfill is approximately 1.5 acres in size. 4. The LCID landfill is open to the general public. 5. Mr. Norman Westmoreland has his files, documents and plans available for review. Site plan and operations were discussed. 6. The LCID landfill appeared to have adequate buffers between the waste boundary and waters of the state and adjacent
structures as required per 15A NCAC 13B .0564(9). 7. Per 15A NCAC 13B .0566(3), “Solid waste shall be restricted to the smallest feasible and compacted as densely as practical into cells.” 8. Per 15A NCAC 13B .0566(4), “Adequate soil cover shall be applied monthly, or when the active area reaches one acre in size, whichever occurs first.” 9. Ensure side slopes continue to maintain a 3:1 ratio and vegetative cover prevents erosion of landfill cap.
10. Open burning of solid waste is prohibited. 11. Mulch, stumps, tree debris and soil were observed on site. No unauthorized wastes observed on site during inspection. 12. No erosion of site was noted during inspection. 13. No surface water was observed impounded over waste. 14. Continue to ensure that water sheet flows off the LCID landfill. 15.
