Upon investigating, the vehicle was identified to belong to Greasecycle. Operating an unlettered pump truck is a violation of Rule .0835(b) that states “All permitted septage management firms shall display lettering on each side of every pumper vehicle operated by the firm. The lettering shall include the firm name, town name, phone number, and septage management firm permit number as shown on the firm application. All lettering required by this Rule on the pumper vehicle shall be no less than three inches in height and legible, distinguishable from the background, and not obstructed from view. Identification shall not be removable (i.e. no magnetic signs).” 2) The Division received no notification from Greasecycle of the use of this pumper vehicle to pump grease trap waste. This is a violation of North Carolina General Statute (N.C.G.S.) 130A-291.1 (h1) that states “The annual permit application shall identify the pumper trucks to be used by the septage management firm. A permitted septage management firm shall notify the Department within 10 days of placing a pumper truck in service that was not previously included in a permit issued to the firm and shall make the pumper truck available for inspection by the Department. A septage management firm is not prohibited from use of a pumper truck that meets the requirements of the rules adopted by the Commission prior to inspection by the Department.” FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 3 The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. ADDITIONAL COMMENTS 1) Received a complaint with a picture and video of a pumper vehicle in Durham on 12/20/2018 without any lettering on the vehicle. From the picture, the pumper vehicle had a plate # of YA138696 and was parked in front of two establishments, Pie Pushers and Pinhook. On 1/20/2019, I called Pie Pushers and they confirmed that their grease trap was pumped out by Greasecycle on 12/20/2018. 2) On 02/11/2019, I met with Dylan at the office/facility to inspect the firm pumper vehicles and discuss the complaint. Dylan acknowledged that the pumper vehicle was from Greasecycle. I discussed with Dylan that any pumper vehicle that may be used to pump grease trap waste needs to be lettered. Greasecycle also has pumper vehicles that only pump used fryer oil. 3) Was at the facility to inspect SDTF-92-11. While at the facility, I inspected the pumper vehicle with plate # YA138696 that was identified in the complaint. See pictures below. 4) The required lettering was present on both sides of the vehicle. The letters were at least three (3) inches in height. 5) The tank appeared to be structurally sound and was affixed to the frame of the vehicle. 6) Caps present on the access ports. Access covers were closed and properly sealed. The valves appeared to be in working order. 7) No leaks noticed. 8) Truck logs not inspected. 9) The pumper vehicle identified in the complaint on 12/20/2018 now meets the requirements for pumper vehicles as covered within the Septage Management Rules. In the future, please make sure when adding another pumper vehicle to be used to pump septage, i.e. grease trap waste, that the vehicle meets the requirement set forth within the Septage Management Rules. Also, notify the Division within ten (10) days of placing that pumper vehicle within service. Driver side of the pumper vehicle with plate # YA138696. Passenger side of the pumper vehicle.
