Employees stated that they clean out the pump tanks behind the business. Rule .0832(h) states “Washings from the interior of septage handling containers such as pump trucks shall be managed as septage.” 2) The area behind the business is not a permitted disposal facility or site for septage. This is a violation of N.C.G.S. 130A‐291.1(d) Septage shall be treated and disposed only at a wastewater system that has been approved by the Department under rules adopted by the Commission or by the Environmental Management Commission or at a site that is permitted by the Department under this section. A permit shall be issued only if the site satisfies all of the requirements of the rules adopted by the Commission. Also, a trench had been dug to contain the washings from the pump tanks. This is a violation of Rule .0840(a) that states “No person shall establish, or allow to be established upon any real property owned, operated, leased, or controlled by that person, a septage management facility to treat, manage, store, or dispose of septage, or any component of septage, unless a permit has been obtained from the Division. Septage shall not be disposed of by trenching or burial.” ADDITIONAL COMMENTS 1 – Area behind office building 2 – Area where trucks were placed to be washed out 3 – Trench for holding septage 4 – Area where septage overflowed at elbow in trench The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 3 of 3 5 – Ending of trench 6 – Septage leaving trench flowing onto property 1 – Responded to complaint of tanks from pump trucks being washed and emptied behind office building located at 13603 Swamp Fox Hwy E. Arrived at approximately 2:35 pm and spoke with James Faulk as to the nature of the visit and began the investigation. 2 – Picture one (1) is of the area behind the office building showing where trucks have back up to and a trench. 3 – In second (2) picture, septage washed from the tanks could be seen on ground. 4 – The third (3) picture shows the beginning of the trench where septage had run into from the wash area. 5 – Septage flowed down the trench and had overflowed the trench’s sides into a grassy area (picture 4) near an elbow in the trench. 6 – Ending of trench on property still filled with septage in picture five (5). 7 – Lastly, picture six (6) shows on-going overflow of septage leaving the trench. 8 – The septage (tank washings) shown in the pictures was disposed on land not permitted for disposal or treatment of septage. This is a violation of N.C.G.S. 130A‐291.1(d), Rule .0840(a), and Rule .0832(h) as stated above in “Observed Violations.” 9 – Clean up of septage from trench and adjacent areas and lime applied afterwards was required from inspection.
