The permit includes the Permit to Construct Phases 3 and 4 and the Permit to Operate Phases 1, 2, and Cell 1A of Phase 3. The life of site ends when the facility reaches its final permitted elevation. PURPOSE OF SITE VISIT: Comprehensive Inspection STATUS OF PAST NOTED VIOLATIONS: 15A North Carolina Administrative Code 13B .1626(2)(a) states: “Except as provided in Sub-Item (b) of this Item, the owners or operators of all MSWLF units must cover disposed solid waste with six inches of earthen material at the end of each operating day, or at more frequent intervals if necessary, to control disease vectors, fires, odors, blowing litter and scavenging.” OBSERVED VIOLATIONS: A. 15A North Carolina Administrative Code 13B .1626(2)(a) states: “Except as provided in Sub-Item (b) of this Item, the owners or operators of all MSWLF units must cover disposed solid waste with six inches of earthen material at the end of each operating day, or at more frequent intervals if necessary, to control disease vectors, fires, odors, blowing litter and scavenging.” FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 4 During the inspection, multiple areas of inadequate cover was observed on the landfill: • An area on the east side slope of Phase 1 where a pipe was installed to address a leachate seep. A stockpile of waste removed during the installation of the pipe was also observed. The waste must be removed and taken to the active working area. • An area located to the east of the active working face. • The northern side slope of Phase 2-Cell 2D. • Areas on the west side slopes of Phase 2 and 3. Waste Connections, Inc. is in violation of 15A NCAC 13B .1626(2)(a) by failing to maintain adequate cover on all disposed waste with six inches of earthen material. To achieve compliance with 15A NCAC 13B .1626(2)(a), all exposed waste must be covered with a minimum of six inches of earthen material within 10-days of receipt of this inspection report and associated Notice of Deficiency. Areas which will not have additional waste placed on them for 12-months or more, but where final termination of disposal operations has not occurred, shall be covered with a minimum of one foot of intermediate cover. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 3 of 4 Inadequate cover on west side slopes of Phase 2 and 3. ADDITIONAL COMMENTS 1. The facility consists of a MSWLF and a drop-off convenience area for residential waste. 2. The facility is permitted to receive solid waste generated from within the States of North Carolina and South Carolina, consistent with the local government waste management plan and with the franchise approved by the Anson County Board of Commissioners. The facility must not receive solid waste from transfer stations that accept solid waste generated in states other than North Carolina and South Carolina. 3. Proper signage was observed at the entrance of the facility. Operations Inspection of the MSWLF: 4. Waste was being placed in Phase 3, Cell 1A. 5. The facility is permitted to use a tarp, automobile shredder fluff mixed with soil, petroleum contaminated soil and seaboard solids as alternative cover material. The facility is currently utilizing automobile shredder fluff as alternative cover material. 6. The facility utilizes two tippers. 7. No unacceptable waste was observed. 8. Edge of waste markers were being maintained. 9. Access roads were well maintained. 10. Leachate recirculation is not being conducted. 11. Take measures to ensure that all woody vegetation is removed on Phase 1. 12. Take measures to ensure that side slopes are stabilized with a ground cover sufficient to restrain erosion. 13. During the inspection, dust made vision on landfill roads extremely difficult. According to landfill staff, the water truck was being repaired. Operations Inspection of the Yard Waste Treatment and Processing (Wood Grinding)/Composting Area: 14. No unacceptable waste was observed. 15. The facility is not actively composting at this time. Ground material is used within the landfill. No material is distributed to the public. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. Tires were being collected in a covered trailer. Inspection of the Leachate Storage Area: 17. The leachate storage area consists of two 250,000-gallon leachate storage tanks and a leachate storage basin consisting of an inground storage tank constructed of lined cast-in-place concrete. 18. The leachate storage tanks will be kept empty and remain available as back-up to the leachate storage basin. 19. The leachate storage basin appeared to have an adequate amount of freeboard. 20. The leachate is pumped from the leachate storage basin to the Anson County WWTP via a force main. Records Review: 21. Reviewed the permit, training records, waste determination records, random inspection records, quarterly methane monitoring records, scrap tire certification forms and semi-annual groundwater, surface water and leachate monitoring. 22. It is recommended that the random inspection forms be revised to include a list of banned items and how any unacceptable waste is managed. 23. The facility receives approximately 2,900 tons of waste each operational day. 24. 731,763 gallons of leachate was discharged in April 2018. 25. Leachate line cleaning was conducted in 2018. 26.
