Current status of the Land Clearing and Inert Debris Landfill Notification is OPEN
PURPOSE OF SITE VISIT: Comprehensive Inspection (to ensure that the notified land clearing and inert debris (LCID) landfill is in compliance
with 15A North Carolina Administrative Code (NCAC) 13B .0563, .0564, and .0566) STATUS OF PAST NOTED VIOLATIONS:
None. OBSERVED VIOLATIONS:
1. 15A NCAC 13B .0564(9)(a) states: “The facility shall meet the following minimum buffer requirements: 50 feet from the waste boundary to all surface waters of the state as defined in G.S. 143-212.”
Adcock Grading and Demolition LCID Landfill is in violation in that the toe of the slope of the landfill/waste boundary is less than 50’ from the ponds edge of water or the creek at the northeast corner of the landfill.
The toe of slope/edge of landfill/waste boundary must be pulled back so that the toe of the landfill slope is a minimum of 50’ from the waters edge of the pond or the creek along the northeast corner.

2. 15A NCAC 13B .0566(4) states: “Adequate soil cover shall be applied monthly, or when the active area reaches one acre in size, whichever occurs first.” Adcock Grading and Demolition LCID Landfill is in violation of 15A NCAC 13B .0566(4) in that the north and west side slope have been uncovered for more than a month. The facility is actively receiving LCD.
Adcock Grading and Demolition LCID Landfill will have until June 03, 2019 to ensure that all material received at
the land clearing and inert debris (LCID) landfill that has been at the landfill greater than 30 days is adequately covered with soil such that it is not visible.
3. 15A NCAC 13B .0566(8) states: “The facility shall be adequately secured by means of gates, chains, berms,
fences, etc. to prevent unauthorized access except when an operator is on duty. An attendant shall be on duty at all times while the landfill is open for public use to assure compliance with operational requirements and to prevent acceptance of unauthorized wastes.” Adcock Grading and Demolition LCID Landfill is in violation of 15A NCAC 13B .0566(8) in that the LCID was not
secured by means of gates, chains, berms, fences, etc. to prevent unauthorized access except when an operator is on duty. Adcock Grading and Demolition LCID Landfill must be able to secure landfill to prevent unauthorized access anytime an operator is not on duty.
ADDITIONAL COMMENTS
On April 25, 2019, Chuck Kirchner conducted a comprehensive inspection of the Adcock Grading and Demolition LCID Landfill on Mendenhall Road in Trinity, Randolph County.
1. The Adcock Grading and Demolition land clearing and inert debris (LCID) landfill is located on Mendenhall Road. Mr. Adcock’s residence is located on the property, near the LCID landfill. 2. The LCID landfill is ~ 1.25 acres.
3. The LCID landfill is primarily used by his grading and demolition company. 4. Mr. Adcock previously stated he removes logs from land clearing debris (LCD) and stores them separately to cut for firewood. 5. Material is stored on the right side/atop the non-active area of the LCID landfill. Vehicles used for the grading company were observed parked atop the LCID landfill area. The footprint of the LCID landfill shall not be used as a staging area as by doing so the facility cannot meet the cover and vegetation requirements in 15A NCAC 13B .0566(5) and .0566(7). The landfill must be covered and vegetated as required. Edge of waste markers help facilitate where equipment can be stored off of the landfill disposal area and ensure waste will be placed within the LCID disposal area. It also helps ensure the landfill does not exceed the size limit. 6. A small pile of used asphalt is stored on the landfill. Mr. Adcock previously stated that it will be used for bedding material atop the landfill.
7. Side slopes are not covered with soil. Woody debris left exposed like this can pose a significant fire hazard if not properly covered with soil.
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

8. Per 15A NCAC 13B .0566(3), “Solid waste shall be restricted to the smallest area feasible and compacted as densely as practical into cells.” Ensure all waste brought into landfill is compacted. 9. Mr. Adcock previously stated that wet concrete is not accepted. A small amount of wet concrete was observed at the entrance to the LCID. 10. The facility has an all-weather access road.
