PURPOSE OF SITE VISIT: Partial Inspection STATUS OF PAST NOTED VIOLATIONS: None. OBSERVED VIOLATIONS: None. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. This inspection was performed at the request of the facility owner, Rob Howerton, in advance of preparing an application for a full permit that would allow the expansion of the disposal area. 2. The facility was accepting and disposing of waste during this inspection. 3. Edge of waste markers had not been installed to permanently identify the landfill's waste boundary. Mr. Kemp stated that he was hoping to be able to access all areas of the site to install that markers in the near future. He cited the wet conditions on the slopes and added that maneuvering equipment over the wet slopes would cause damage and make equipment operation hazardous. Ensure that permanent edge of waste markers are installed to identify the waste boundary of the current 2-acre LCID landfill by May 31, 2019. 4. The site was still wet from frequent rain events; however, clean soil had been spread out to dry, creating a stockpile of cover dirt. Mr. Kemp stated that this process is continually underway to ensure that adequate dirt is available to cover waste and maintain the landfill slopes. 5. The entrance roadway is flanked on either side by a ditch line that conveys storm water into the two catch basins located at the bottom of the entry drive hill. This stormwater conveyance system appeared to be functioning properly. The ditches and catch basins contained sediment, but there was no indication that sediment had escaped these devices. Mr. Kemp stated that cleaning the basins and ditches was an ongoing task due to the continual occurrence of heavy rainfall events. 6. A new sediment trap was under construction at the top of the entry drive on the east side. Baffles were in place and the drainage ditch leading to the device had been roughed -in. Mr. Kemp explained that he would finish up by rip -rapping the ditch and stabilizing the walls of the sediment trap. 7. A working pad had been created in the middle of the site, atop the fill area. The pad was well -maintained and afforded adequate space for trucks and equipment to maneuver safely. 8. The fill area on the east side of the access roadway had been covered and the side slopes had been graded and seeded. A few small erosion rills were visible on the west -facing slope of this fill area, and Mr. Kemp stated that he works on this slope as weather permits. 9. The north slope of the landfill had been adequately covered and graded and appeared to be stable. Mr. Kemp stated that he wanted to track in additional soil prior to seeding this area. He added that he hoped to have seed down within the next few weeks. 10. Required buffers appeared to have been maintained at the facility. Mr. Kemp pointed out some areas around the perimeter of the landfill where he intended to pull the slopes back to reduce the grade and maintain the integrity of the perimeter ditch line. 11. Small stockpiles of inert debris and brush were staged around the operations area. Mr. Kemp stated that waste is placed into the fill area as it arrives onsite, so extensive stockpiling no longer occurs. He added that wood grinding operations no longer occur at the facility and that grinding equipment had been removed. 12. The borrow area on the southwestern portion of the site had been extended since the previous inspection on August 21, 2018. Slopes in this excavated area were observed to be nearly vertical and showed signs of erosion. Please ensure that grades on the excavated slopes are reduced and that the slopes are stable. 13. On the northern end of the borrow area, a sizeable rock wall had been unearthed. Mr. Kemp stated that he was looking for a market for the rock so that it could be removed from the site. 14. The facility was observed to be clean and well maintained. No unacceptable materials were observed in the unprocessed wood stockpiles or in the landfill.
