In connection with such acquisition, SCNB commissioned PSI to perform a Phase I environmental site assessment of the Property. During the course of the assessment, PSI observed apparent UST fill and vent ports in the southeast corner of the Property. Based on interviews with on -site maintenance personnel, PSI determined the tank was historically used by FedEx (a former operator of the Property) for heating oil, but no additional information or records were available. At SCNB's request, PSI arranged to have the UST properly abandoned. Due to the unknown size and contents, the proximity to a large oak tree, underground utilities and the on -site garage, in - place abandonment was agreed upon. PSI arranged for cleaning of the tank, and removal of its contents (approximately 20 gallons of product, and 550 gallons of water in which no fuel was observed). In connection with the abandonment, PSI conducted limited soil sampling at the Property on March 29, 2018 (even though, because the tank is believed to have been used for storage of heating oil for use on premises, the tank is not regulated, and such sampling was not required). PSI collected three soil samples by hand -auger form a depth of 6 feet below ground surface ("bgs") and analyzed for total petroleum hydrocarbons ("TPH") gasoline range organics and diesel range organics ("GRO/DRO") by EPA Method 8015C. The resulting laboratory analysis showed no GRO/DRO in concentrations exceeding detection limits. PSI excavated soil at the location of the tank, and obtained three soil samples from the bottom areas of the excavation. The locations from which the samples were collected are shown on the attached figure. Soil samples XV2 and XV3 were obtained from the east and west side of the UST, respectively, at an approximate depth of 8-feet bgs. PSI arranged for Prism Labs (fully accredited for all applicable methods, as indicated in the enclosed lab reports) to analyze the samples for the presence of TPH GRO/DRO by EPA Method 8015C. The results of laboratory analysis indicated that levels of TPH GRO/DRO were not reported above minimum laboratory detection limits or reporting limits in two of the three samples. Levels of TPH-DRO, however, were reported for soil sample XV1 (collected at-1 1 feet bgs) at 190 mg/kg. PSI directed Prism to further analyze soil sample XV1 for Volatile Organic Compounds (VOCs) by EPA Method 8260, Semi -Volatile Organic Compounds (SVOCs) by EPA Method 8270, and Volatile Petroleum Hydrocarbons/Extractable Petroleum by Massachusetts Department of Environmental Protection (MADEP) Method. Such methods are specified by the UST Section of the Division of Waste Management of the NC DEQ in the document entitled "Guidelines for Site Checks, Tank Closure, and Initial Response and Abatement for UTS Releases," January 9, 2018 (the "Guidelines"). Reportable concentrations of MADEP VPH/EPH were calculated using a table included in the Guidelines covering Medium/High Boiling Point Fuels, including #2 fuel oil (heating oil). The following calculated levels of MADEP VPH/EPH were reported by Prism and were compared to the NC DEQ UST Soil -to -Groundwater Maximum Soil Contaminant Concentration Levels (MSCCs): 1. C5-C8 Aliphatics - Below reporting limits (BRL) 2. C9-C 18 Aliphatics - 91.5 mg/kg (below lowest MSCC of 540 mg/kg) 3. C19-C36 Aliphatics - 49 mg/kg (no regulatory standard - considered immobile) 4. C9-C22 Aromatics - 34.60 mg/kg (slightly above the lowest MSCC of 31 mg/kg) None of the reported analyte concentrations were above the residential or industrial/commercial MSCCs. We understand the Department has not assigned a risk classification to this site. We believe, based on the lack of identified drinking water wells, the availability of public water supply, and relatively low levels of identified impact, the site should and would be characterized as low risk. As you know, North Carolina Session Law 2015-241 provides that the Department shall: (1) Not require a responsible party to take immediate action or initial abatement actions with respect to a discharge or release from a noncommercial underground storage tank until such time as the Department has classified the risk posed by the discharge or release, except for those actions determined by the Department to be necessary to protect public health, safety, and welfare and the environment, and to mitigate any fire, explosion, or vapor hazard. (2) Notify the responsible party that no cleanup, no further cleanup, or no further action will be required by the Department if the risk posed by a discharge or release from a CHAR2\2014024v1 Ronald Taraban May 23, 2018 Page 3 of 3 noncommercial underground storage tank is determined by the Department to be low risk, without requiring soil remediation pursuant to 15A NCAC 02L .0408. No abatement action is necessary at the site to protect public health, safety, and welfare and the environment, or to mitigate any fire, explosion, or vapor hazard. Because the site should be characterized as low risk, we ask that you, as soon as possible provide notice that no cleanup, and no further action will be required with respect to the site. Please note that SCNB is willing to arrange for recordation of an appropriate Notice of Residual Petroleum, if the Department believes such recordation would be appropriate. INTRODUCTION The subject property consists of approximately 3.93-acres referenced by Mecklenburg County Parcel ID 20515304, located at 9401 Nations Ford Road in Charlotte, North Carolina. The site is currently occupied by Victory Christian Center, used for general storage and vehicle service/repair of school buses. Site improvements include an approximate 39,600-sf warehouse and office building, asphalt paving and landscaped areas. The site location is depicted in Figure 1. Current uses of surrounding properties include: College & Career Tech and a radio station to the north; Wooded land with a tributary of Kings Branch followed by The Zachry Group and Ready Mix Concrete to the east; East Hebron Street followed by partially wooded land, CATO Distribution Center and Central Piedmont Community College (CPCC) Harper Campus to the south; and Nations Ford Road followed by Victory Apartments, Charlotte Fire Station 20 and CPCC to the west. Reference Figure 2 for a depiction of the surrounding property occupants and uses. No private water supply wells or single-family residences were observed in the area. Potable water is provided to the vicinity by Charlotte Water. 1.2 PROJECT BACKGROUND PSI conducted a Phase I ESA at the subject property in March 2018. The findings of the Phase I ESA included the observation of UST fill and vent ports in the southeast corner of the property (Figure 3). Based on interviews with on -site maintenance personnel, the tank was historically used by Fed Ex for heating oil, and no additional information or records were available. At the request of the client, PSI arranged to have the UST properly abandoned. Due to the unknown size and extents, the proximity to a large oak tree, underground utilities and the on -site garage, in -place abandonment was agreed upon. 1.3 PHYSICAL SETTING PSI reviewed United States Geological Survey (USGS) Topographic (Topo) Maps and other information regarding the physical setting of the site to assist with the interpretation of subsurface water movement near the property. Based on reviewed information, the interpreted shallow groundwater flow is towards the east-southeast. This soil unit is found on interfluves and is well drained with moderately high to high permeability. This soil series does not meet the criteria for a hydric rating. 1.4 PHYSIOGRAPHIC PROVINCE AND GEOLOGIC DESCRIPTION The project site is located in the Charlotte Belt of the Piedmont Physiographic Province. The Charlotte Belt is dominated by metamorphic and intrusive rocks. According to the Geologic Map of North Carolina (1985), the site is reportedly underlain by Intrusive, Metamorphosed Granitic Rock. The virgin soils encountered in this area are the residual product of in -place chemical weathering of underlying parent rock formation. In areas not altered by erosion or disturbed by the activities of man, the typical residual soil profile consists of fine grained soils (clays and silts) near the surface where soil weathering is generally more advanced, underlain by more coarse grained soils (silty sands and sandy silts). The boundary between soil and rock is not sharply defined. This transition zone termed partially weathered rock is normally found overlying the parent bedrock. Partially weathered rock is defined, for engineering purposed, as residual material with Standard Penetration Test resistances in excess of 100 blows per foot (bpf). Weathering is facilitated by fractures, joints, and by the presence of less resistant rock types. Consequently, the profile of the partially weathered rock and hard rock is quite irregular and erratic, even over short horizontal distances. LIMITED SOIL SAMPLING PSI conducted Limited Soil Sampling at the subject property on March 29, 2018. The purpose of the assessment was to obtain preliminary information in respect to soil sampling near the suspect heating oil UST system, prior to closure. The scope of work generally consisted of collecting soil samples with hand tools, field screening, laboratory analysis, and report of findings. 2.1 UTILITY LOCATING Prior to conducting the field work, PSI contacted North Carolina 811, to locate utilities at the subject property. Utilities were marked by the respective utility companies as they entered the site. In addition, PSI subcontracted with Probe Utility Locating of Huntersville, North Carolina to mark underground utilities in the project area and attempt to identify the location and extents of the heating oil UST. PSI mobilized to the subject property on March 14, 2018 to supervise Probe during the locating activities. Based on the locating results, no underground utilities were identified in the immediate area of the UST (based on the observed fill and vent ports). However, a natural gas line, water drain lines, and buried electric power were located adjacent to the proposed areas of excavation. The exact location and estimated capacity of the UST were not identified during underground radar or electromagnetic survey. 2.2 FIELD WORK Field investigation and sampling activities were conducted on March 29, 2018, under the supervision of Mark R. McCagg, Principal Consultant, and with Jason K. Harris, Staff Geologist for PSI. The field work was conducted by qualified professionals who are OSHA safety trained in accordance with CFR 1910.120. Sample collection, field documentation, sample custody and laboratory procedures were conducted in general accordance with methods prescribed by the North Carolina Department of Environmental Quality (NC DEQ) and the United States Environmental Protection Agency (USEPA). Three (3) soil borings were advanced in the area of the observed UST fill and vent ports, using decontaminated stainless steel hand augers. The soil borings were advanced to an approximate depth of six (6) feet below ground surface (bgs), due to limitations of the equipment and encountered material. PSI collected a representative soil sample at the bottom of each boring (5'-6' bgs), which was split into two portions. The first portion was packed into laboratory provided containers and placed into a cooler with ice. The second portion was placed in a sealed plastic bag, to be field screened with a Photo - Ionization Detector (PID) by soil-headspace method. The hand -auger sample locations are depicted in Figure 4. The soil analytical samples were hand delivered to Prism Laboratories in Charlotte, North Carolina and were tested for Total Petroleum Hydrocarbons (TPH) - Diesel Range Organics (DRO) and Gasoline Range Organics (GRO) by EPA Method 8015C. www.intertek.com/building PSI Project Number: 04571178 UST Closure Report — Victory Christian Center, Charlotte, NC April 20, 2018 otri Page 4 2.3 LIMITED SOIL SAMPLING RESULTS During the limited field investigation conducted on March 29, 2018; no petroleum odors, dark staining, oily residue, or elevated PID readings were encountered in the soil observed from ground surface to approximately 6-feet bgs. The results of laboratory analysis indicated that levels of TPH GRO/DRO were not reported above minimum laboratory detection limits in soil samples HA1, HA2, and HA3. No investigative -derived wastes (IDW) were generated during the Limited Soil Sampling event. UST CLOSURE Below is a summary of the UST source information, history, UST closure, laboratory analysis and results. 3.1 SOURCE INFORMATION AND UST HISTORY No releases were identified in connection with the on -site heating oil UST, prior to UST closure activities. The tank capacity and installation dates were not provided to PSI, and were not found in researched regulatory information (reviewed during the Phase I ESA). Since the UST was reportedly used for heating oil, registration at the local and state level was not required. Slight petroleum odors were noted in the water contained within the UST, observed during utility marking activities conducted on March 14, 2018. 3.2 UST CLOSURE ACTIVITIES PSI subcontracted with Zebra Environmental & Industrial Services, Inc. of High Point, North Carolina on March 30, 2018 to conduct UST closure activities. The field work was supervised by Mr. Mark R. McCagg of PSI. As previously mentioned in Section 2.1, utilities were marked by NC 811 and Probe Utility Locating prior to the UST closure. Zebra excavated soil in the landscaped areas near the observed fill and vent pipes, down to the upper tank surface. The top of the tank was located approximately 6% feet bgs; however, the extents of the UST could not be reached due to the proximity of a mature oak tree, the depth of the tank and the limited capacity of the excavating equipment (back -hoe), which was selected based on a typical UST depth of 3 to 3% feet bgs. Following the limited excavation, Zebra evacuated the contents of the UST using a vacuum truck. Approximately 550 gallons of liquid were removed and transported to Zebra's facility in North Carolina for future disposal. The excavation was back -filled with overburden and the remainder of the field work was re -scheduled for the following week. PSI re -mobilized to the subject property on April 3, 2018 to complete the UST closure. Zebra removed sections of pavement with an asphalt saw and utilized a Komatsu WB 140 front-end loader with excavator to remove sub -surface material down to the tank shell. The UST was uncovered at approximately 6%-feet bgs, and was observed as steel constructed with a fiberglass jacket. The final excavation was approximately 8-feet by 12-feet, tapered downwards toward the center. The observed stratigraphy in the excavation generally consisted of medium to fine sandy silt, grading to partially weathered rock (saprolitic). Groundwater was not encountered during the UST Closure. After the limits of excavation were reached, Zebra obtained soil samples from the bottom areas of the excavation through the excavator bucket. PSI collected three (3) soil samples from this material for laboratory analysis and PID field screening. The sample locations are depicted in Figure S. Soil sample XV1 was obtained from the north side of the UST, at a depth of approximately 11-feet bgs. Soil samples XV2 and XV3 were obtained from the east and west side of the UST, respectively, at an approximate depth of 8- feet bgs. Zebra entered the excavation to cut an access hole in the top of the UST, to facilitate pressure -washing the interior of the tank. The tank was observed to be in good general condition, with no pitting, excessive corrosion, or holes noted (top and sides of the tank only - the bottom was not exposed due to in -place closure). No heating oil product lines were observed emanating from the UST or other areas inside of the excavation. In addition, no abandoned product lines were observed inside of the building in the area of UST. Based on physical measurements, the UST was 66-inches long by 50-inches in diameter, and had a capacity of approximately 560-gallons. After the tank was cleaned, the contents were removed by vacuum truck (approximately 20-gallons). Zebra then placed a partial truckload of #78M stone in the excavation. The stone material was free - flowing and readily entered the UST void spaces. Additional stone was placed on top of the tank along with the excavated overburden. Zebra used the excavator bucket to compact the backfill periodically as the excavation was filled in. The surface of the excavation was finished with additional #78M stone in the areas formerly covered with asphalt. These areas were minimally compacted and slightly mounded. As previously agreed upon with the client, asphalt was not replaced, and no compaction testing was requested or conducted within the current project scope. All scrap asphalt, steel piping (fill and vent lines), and gravel were loaded and hauled by Zebra following the UST closure activities. 3.3 SOIL LABORATORY ANALYSIS AND RESULTS The soil analytical samples were hand delivered to Prism Laboratories in Charlotte, North Carolina under proper chain -of -custody procedures. The results of laboratory analysis indicated that levels of TPH GRO/DRO were not reported above minimum laboratory detection limits or reporting limits in two of the three soil samples collected during UST closure (see Table 2). However, levels of TPH-DRO were reported for soil sample XV1 (collected at —11 feet bgs) at 190 mg/kg, which is above the NC DEQ UST action level of 100 mg/kg. Following the receipt of the laboratory results on April 6, 2018, PSI directed Prism to further analyze soil sample XV1 for Volatile Organic Compounds (VOCs) by EPA Method 8260, Semi -Volatile Organic Compounds (SVOCs) by EPA Method 8270, and Volatile Petroleum Hydrocarbons/Extractable Petroleum Hydrocarbons (VPH/EPH) by Massachusetts Department of Environmental Protection (MADEP) Method. www.intertek.com/buiIding ton PSI Project Number: 04571178 UST Closure Report — Victory Christian Center, Charlotte, NC April 20, 2018 Page 7 The testing methods are specified by the NC DEQ in the document entitled "Guidelines for Site Checks, Tank Closure, and Initial Response and Abatement for UTS Releases", dated January 9, 2018. The results of the additional laboratory analysis indicate that all parameters were below method detection limits for VOCs (8260B) and SVOCs (8270C). Reportable concentrations of MADEP VPH/EPH were calculated using a table provided by the NC DEQ (presented in Table 3), specifically issued for Medium/High Boiling Point Fuels, including #2 fuel oil (heating oil). CONCLUSIONS AND RECOMMENDATIONS PSI has conducted Limited Soil Sampling and In -Place UST Closure activities at the subject property. Based on the results of the field evaluation and sampling, PSI presents the following conclusions and recommendations: 4.1 CONCLUSIONS The heating oil UST has been successfully evacuated, cleaned and abandoned in -place by filling with #78M stone. Field screening and observations did not indicate a petroleum release. However, soil analytical laboratory results (TPH-DRO) of the soil sample collected at —11-feet bgs (XV1) indicated that a petroleum release above regulatory screening criteria has occurred. The additional laboratory testing indicated that VOCs and SVOCs were not detected above minimum detection limits.
