RESPONSE TO: NOTICE OF VIOLATION – DATED APRIL 10, 2019
Dear Mr. Kirchner:
Waste Management of Carolinas (WM) respectfully submits this response to the Notice of
Violation (NOV) dated April 10, 2019, received via email from the North Carolina Department
of Environmental Quality (NCDEQ) on April 11, 2019 (Attachment 1). WM understands that
the NOV stems from an inspection of the Great Oak Landfill on April 3, 2019 by Mr. Chuck
Kirchner (NCDEQ). The NOV states both of the following:
1. “The County of Randolph, N.C. and Waste Management of Carolinas, Inc. are in
violation of 15A NCAC 13B .1626(2)(a) by failing to cover all material with required soil
cover at the end of each day.”
2. “The County of Randolph, N.C. and Waste Management of Carolinas, Inc. are in
violation of 15A NCAC 13B. 1626(11)(c) by failing to collect and return all windblown
material to the active landfill at the end of each day.”
CORRECTIVE ACTIONS/MEASURES ON-SITE
INADEQUATE COVER RESPONSE
On April 3, 2019, subsequent to the NCDEQ site inspection, Great Oak Landfill
personnel immediately began to deploy additional earthen cover over the deficient
areas identified (estimated in the NOV to be 0.9 acres in size) around the tipping area
and around the active cell. WM understands that adequate daily cover is necessary to
control disease vectors, fires, odors, blowing litter, and scavenging. WM is committed
to placing the required 6 inches of earthen material (or approved alternate daily cover)
over disposed waste at the end of each operating day. Please see the Photographic
Log (Attachment 2) for documentation purposes.

Furthermore, WM has purchased and received 6 additional cover tarps (50 feet by 50
feet) to supplement the 8 tarps that the landfill currently utilizes for cover purposes as
needed. Note that on morning of the April 3rd (prior to the NCDEQ inspection), the site
had already picked up the deployed tarps (used for cover purposes) from the previous
day.
WINDBLOWN MATERIAL RESPONSE
After the NCDEQ site inspection on April 3rd, Great Oak Landfill personnel immediately
began to address the windblown material that was observed around the tipping area,
active cell, and on landfill side slopes. WM understands that windblown material is
required to be collected and returned to the active landfill area each day. WM will
continue to monitor and collect windblown material throughout the day.

SUBJECT: NOTICE OF VIOLATION Compliance Inspection Report – Great Oak Landfill Waste Management of Carolinas, Inc., Operator
County of Randolph, N.C., Owner Permit I.D. Number: 76-07 Randolph County
Dear Mr. Johnson and Mr. McFeeley: On April 3, 2019, Chuck Kirchner, representing the State of North Carolina, Division of Waste Management Solid Waste Section, inspected the above referenced facility for compliance with North Carolina solid waste statutes and rules. Mike McFeeley, Landfill Supervisor was present and represented Waste Management of Carolinas, Inc. during this inspection. The following violations were noted:

A. 15A NCAC 13B .1626(2)(a) Cover material requirements states in part: “the owners or operators of all MSWLF units must cover disposed solid waste with six inches of earthen material at the end of each operating day, or at more frequent intervals if necessary, to control disease vectors, fires, odors, blowing litter, and scavenging.” The County of Randolph, N.C. and Waste Management of Carolinas, Inc. are in violation of 15A NCAC 13B .1626(2)(a) by failing to cover all material with required soil cover at the end of each day.
During the inspection, a large amount of exposed waste, in an area estimated to be 0.9 acres in size, was observed around the tipping area and around the active cell from the prior operational day. B. 15A NCAC 13B .1626(11)(c) states, in part: " At the conclusion of each day of operation, all windblown material resulting from the operation shall be collected and returned to the area by the owner or operator."
The County of Randolph, N.C. and Waste Management of Carolinas, Inc. are in violation of 15A NCAC 13B. 1626(11)(c) by failing to collect and return all windblown material to the active landfill at the end of
each day. During the inspection, windblown material was observed around the tipping area, around the active cell, and on landfill side slopes.
Based upon the foregoing, Waste Management of Carolinas, Inc. shall come into compliance by April 19, 2019 with all requirements of the regulations in 15A NCAC 13B .1626(2)(a) and 15A NCAC 13B .1626(11)(c) by completing the following:
1. All exposed waste must be covered with a minimum of 6‐inches of earthen material within 7‐days of receipt of the Notice of Violation. Areas which will not have additional wastes placed on them for 12‐months or more, but where final termination of disposal operations has not occurred, shall be covered with a minimum of 1‐foot of intermediate cover. 2. Collect and dispose of all windblown material resulting from the operation.
The violations listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
