On Sunday, September 25, 2017, an anonymous complaint was received by the Solid Waste Section concerning the dumping of cooking oil onto the ground by Stanley Environmental. The complainant stated that ten tanker trucks were used to dump the materials involved in this incident. The complaint was received by the Asheville Regional Office on Monday, September 24, 2017, for investigation. 2. Currently, the permitted Septage Land Application Site (SLAS) consists of Field 1 (22.99 acres), Field 2 (17.32 acres) and Field 3 (6.31 acres). Fields 1 and 2 have been decreased in size due to the expansion of the Earth Farms Compost facility and other office/business space. A modification is currently under review to reflect a name change and a decrease in acreage available for land application. 3. The site is permitted for land application of domestic septage and grease septage. No evidence of cooking oil (yellow grease) was observed on the fields. The current permit and North Carolina Septage rules allow for the land application of septage grease (brown grease collected from grease traps). Used Cooking oil (or yellow grease) is currently not regulated by the Solid Waste Section. 4. The site had accessible all-weather roads to the septage land application field covered under the permit. 5. Appropriate signage was displayed at the site. 6. Field 3 had disposal area boundaries that were well delineated with permanent markers which corresponded to the site map. This field appeared to have used most recently. 7. A large portion of Field 1 is no longer being used as a land application field and had been graded and is now part of a composting operation (SWC-36-13) on site. The portion of Field 1 that is still permitted for land application did not appear to have any recent use and will require harvesting before further use. 8. Field 2 was in the 30-day waiting period before harvest 9. A few boundary markers were missing during the inspection; however, they were replaced on the day of inspection and photographs sent to the Solid Waste Section by email. 10. All septage discharges appear to have been made within the disposal area boundary. 11. No evidence of standing liquid or pooled waste was observed. 12. No objectionable odors were observed. 13. Site logs were reviewed and appeared to be current. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
