OBSERVED VIOLATIONS:
A. 15A NCAC 13B .1626(8)(d) states in part: "Leachate shall be contained within a lined disposal cell or leachate
collection and storage system. All leachate shall be treated, as required by the receiving facility, prior to
discharge."
Transylvania County is in violation of 15A NCAC 13B .1626(8)(d) by allowing leachate to leave the lined
disposal cell or leachate collection and storage system.
During the March 27, 2019 inspection, leachate was observed leaving the lined disposal cell at two locations on
the western slope of the active landfill. The leachate flow lead down a slope and into the stormwater collection
system. These two specific locations are identified on the map below as Seep 2 and Seep 3.

To correct the violation, Transylvania County must immediately repair the seeps. Transylvania County must
submit a sampling plan to Christine Ritter, Hydrogeologist by April 12, 2019 and immediately implement the plan
once approved.

Leachate Seep 2
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
ADDITIONAL COMMENTS
1. All photos were taken by Lee Hill March 27, 2019 unless otherwise noted.
2. The facility is owned and operated by Transylvania County
3. The facility is open to the public Monday through Saturday, 8:00 am to 4:00 pm.
Records Review
4. The current permit and operations plan were available upon request.

7. Landfill gas monitoring logs were reviewed. The facility monitored for landfill gas on October 5, 2017, January
31, 2018, May 31, 2018, and on October 18, 2018. No exceedances were noted at the property line.
Monitoring results from inside facility structures were missing from the October 18, 2018. Please ensure that
monitoring results from inside facility structures are included in the operating record.
8. Tonnage records for calendar year 2018 were reviewed. The facility averaged 82.13 tons per day of MSW and

C&D waste during that period.
9. Groundwater monitoring was conducted on May 22, 2018 and October 17-18, 2018. Per the February 5, 2019
Water Quality Report "On October 24, 2018, personnel from JOYCE visited the Woodruff Landfill for a second
sampling event for the three remaining monitoring wells (MW-3, MW-6, MW-10) that were left out of the
original monitoring event by mistake. A resampling event was conducted on November 29, 2018 for monitoring
well MW-9SR."
10. Scrap tire forms from March 5, 2018 to February 22, 2019 were reviewed. Several of the forms were missing
the generator signatures. All forms must have original signatures.
11. Leachate hauling and daily inspection records were available for review.
Operations Inspection of the MSWLF Unit (8807-MSWLF-1990)
12. The facility is currently filling in Phase 5.
13. The working face was small, compact and no unapproved material was observed. The top of the cell appeared to
have had at least 6" of cover applied to it; however, waste that appeared to have been tracked by equipment was
noted on the on the top of the landfill cell. Additional soil had been placed on the northwestern portion of the
cell. Facility staff stated that they were attempting to add additional cover to the top of the cell as weather
permitted. It is recommended that equipment traffic be minimized on areas of the cells that are not
actively receiving waste to prevent disturbing the cover.
14. Rill erosion was observed on the western slope of Phase 5 closest to the leachate tank. It did not appear that the
erosion had exposed waste; however, windblown litter was observed inside the rills. Repair the rill erosion to
prevent waste from becoming exposed.
15. One leachate seep (Seep 1) was observed near the toe of the northwestern slope of Phase 5. This seep appeared
to have occurred recently and leachate did not leave the lined disposal area.
16. Three seeps were observed on the western slopes of Phases 4 & 5 (Seep 2, Seep 3, and Seep 4) with Seep 2 and
Seep 3 leaving the lined disposal center. Seep 2 occurred on the slope above leachate pump #4, and leachate
was observed leaving the liner system, appearing to enter the storm water collection system. Seep 3 was
observed on the slope above Seep 2, and here, the leachate again mixed with storm water and entered the
stormwater collection system. Seep 4 was located on the slope of Phase 4 of the landfill and on an area where
equipment had traveled up the slope. Leachate did not leave the liner from Seep 4. See Observed Violations
Section of this report for additional information and a location map.
17. Facility staff took immediate action to immediately identify the problem and repair the areas. Soil berms were
installed below the seeps to ensure that leachate would not leave the lined disposal area while the areas were
being repaired. Facility staff sent photos documenting progress and kept the section apprised of actions being
taken to remedy the seeps.
18. Rill erosion was observed on the southwestern slopes near the boundary of Phases 4 & 5. It did not appear that
the erosion had exposed waste; however, windblown litter was observed inside the rills. Repair the rill erosion
to prevent waste from becoming exposed.
19. A significant amount of windblown litter was observed in the former soil borrow area to the west of Phase 5.
15A NCAC 13B.1626(11)(c) states "Methods such as fencing and diking shall be provided within the area
to confine solid waste subject to be blown by the wind. At the conclusion of each day of operation, all
windblown material resulting from the operation shall be collected and returned to the area by the owner
or operator." Ensure that windblown litter is collected and returned to the working face at the end of each
operating day.
20. On Thursday, March 29, 2019, Kenn Webb, Transylvania County Solid Waste Director, sent a follow up email
on the status of the leachate repair process and how the facility was going to address other concerns that were
discussed during the inspection. The email also detailed a plan for the daily visual inspection of the landfill for
seeps and other areas of concern going forward.

Operations Inspection of the LCID Landfill (8807-LCID-1988)
21. The LCID landfill is located to the northwest of the scale house.
22. The facility is not currently landfilling waste and the area is being used as a treatment and processing area for
land clearing waste.
23. No unapproved material was observed in the stockpile and the facility has contracted with Cason Companies for
grinding. Facility staff stated that grinding would begin within the week.
Operations Inspection of the White Goods. Special Waste and Tire Collection Areas
24. White goods are collected on a concrete pad located to the north of the scale house. White goods containing
refrigerants are separated and placed in a roll off container. White goods and scrap metal are sent to Asheville
Metal Recycling for processing. Refrigerants are removed at Asheville Scrap Metal.
25. Electronics are collected, palletized, or placed in gaylord boxes and sent to ERI in Baden, NC for processing.
26. Scrap tires are collected in two van trailers and sent to US Tire in Concord, NC for processing.
