STATUS OF PERMIT:
Coal Combustion By-products Structural Fill constructed per 15A NCAC 13B .1700 Solid Waste Rules

PURPOSE OF SITE VISIT:
Partial inspection to ensure that the Structural Fill Facility is in compliance with 15A North Carolina
Administration Code (NCAC) 13B. 1700, “Requirements For Beneficial Use Of Coal Combustion By-Products.”

STATUS OF PAST NOTED VIOLATIONS:
None.

OBSERVED VIOLATIONS:
None.

The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

ADDITIONAL COMMENTS
1. The Duke Energy Corporation - Marshall Steam Station completed construction of a structural fill project in
January 2013 located on the facility property, approximately 1,500 feet north of the FGD Residue Landfill (18-
09).

2. Approximately 15% of the beneficial use area was covered with a Distributed Solar Photovoltaic (PV) System.
Expansion of the PV system is not planned at this time. The access road has been extended beyond the area of
solar PVs along the eastern side of the top to the north east corner. An area to the north of the solar panels is
being used as a laydown yard.

3. At the time of the inspection, construction activities for the stormwater Diversion Channels and Temporary
Stormwater Ponds (MAR-145) Project were underway.

4. Coal combustion by-products utilized on exterior slopes of the structural fill facility shall not have a slope
greater than a 3:1 ratio as per 15A NCAC 13B .1705(l). Side slopes appeared to meet this requirement at the
time of the inspection.

5. The facility shall be covered with a minimum of 12-inches compacted earth and an additional 6-inches of
surface soil capable of supporting native vegetation as per 15A NCAC 13B .1705(j). Final cover is being well
maintained. Native vegetation is covering the side slopes and top of the structural fill. No erosion or ponded
water was observed during the inspection.

6. Approximately 4,698,500 cubic yards of coal combustion by-products were utilized in the construction of the
structural fill.

7. Per the requirements of 15A NCAC 13B .1707, the structural fill has been recorded on the property deed. It
was recorded on March 28, 2013 and can be found in Book 03180, Pages 0156-0160.

8. The structural fill was being used for its intended purpose of an operating PV system at the time of the
inspection. Various types of PV panels are located on the structural fill for testing purposes.
