ADDITIONAL COMMENTS
The facility is an industrial landfill permitted to receive the following waste generated at the facility: gypsum, clarifier
sludge, fly ash, bottom ash, construction and demolition debris, mill rejects (pyrites), limestone material, land clearing
and inert debris, boiler slag, ball mill rejects, sand blast material, and coal waste. This facility is permitted to receive
solid waste generated by or at any Duke Energy Corporation property, as described in the approved plan and as defined
in G.S. 130-290 (a)(2b), except where prohibited by the N. C. General Statues Article 9 of Chapter 130A, and the rules
adopted by the Environmental Management Commission.
1. The Permit and Operations Plan are maintained on-site as required and were reviewed during the inspection.
2. The Permit to Operate expires November 21, 2021.
3. Proper signage is posted at both entrances to the facility in accordance with the approved operations plan.
4. Waste is no longer being placed in the landfill. The last waste acceptance was on October 18, 2015. Additional
soil is being placed on the top of the landfill in preparations for closure. Plans for closure have been submitted
to the Solid Waste Section. Final closure was scheduled to occur in winter 2018. Final closure activities were
underway at the time of the inspection but had been delayed because of unusually wet weather. Heavy rainfalls
had hindered cover soil placement and establishment of slope vegetation.
5. The access road to the site was of all-weather construction and is being maintained.
6. Edge-of-waste markers delineating the permitted disposal area will be restored during the closure process.
7. Conditions during the inspection were very wet. Rain had occurred steadily during the previous 24 hours and it
was still raining at the time of the inspection. The slopes were so wet and slippery that reaching the top of the
landfill even on foot was inadvisable. Conditions at the top of the landfill will be checked during the next
inspection.

The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

8. Leachate flows from the FGD Landfill (INDUS-1809) and the Industrial Landfill No. 1 (INDUS-1812) were
rerouted to the Lined Retention Basin at Marshall Steam Station and were no longer being sent to the ash basin as
of February 7, 2019.
