Susan Ramsey 729 Sea Gate Drive New Port, NC 28570 is hereby permitted to operate Septage Detention and Treatment Facility with permit # SDTF-16-10 located on Sea Gate Drive in Carteret County at approximate position 34.85114° N latitude and -76.69254° E longitude. This site is permitted only for operations that are conducted in accordance with the representations made in the approved application, with all conditions attached to this permit, and with all of the provisions of 15A NCAC 13B.0800 -- Septage Management. Failure to operate as permitted may result in the Department suspending or revoking this permit, initiating action to enjoin the unpermitted operation, imposing administrative penalties, or invoking any other remedy as provided in Chapter 130A, Article 1, Part 2 of the North Carolina General Statutes. This facility is subject to periodic inspection, as deemed necessary by the Division of Waste Management, to determine if the facility is in compliance with this permit. This permit is subject to review at least annually, or more often if deemed necessary by the Division of Waste Management, to determine if the operations permitted are consistent with the Septage Management Rules in effect at the time of the review. Modifications to the conditions of this permit may be made where necessary to make this permit conform to the requirements of rules in effect at the time of the review. Permit to Operate March 22, 2019 Page 2 of CONDITIONS OF OPERATING PERMIT 1. This facility shall be maintained and operated in a manner that will protect the assigned water quality standards of both surface and ground waters. Any flow of waste from the storage tank to adjacent surface waters shall be considered a violation of the NC Septage Management Rules. 2. Leaks and spills are the responsibility of the Permittee and shall be immediately contained, cleaned up, and treated to prevent any contamination of the surrounding area. Any solids from leaks or spills shall be disposed of in a manner consistent with the NC Solid Waste Management Rules. The Division of Waste Management, Solid Waste Section, shall be notified at 919-707-8200 of any leaks or spills that contact surface waters. 3. The method for controlling odors described in the approved application for this permit must effectively control all odors created by the operation of this facility as required by 15A NCAC 13B .0838(g). 4. Only a Septage Management Firm properly permitted and registered to manage septage in North Carolina shall remove waste from this facility. 5. This permit shall not affect the applicability of any statutes, rules, regulations, or ordinances that may be imposed by other local, state, or federal government agencies that may have jurisdiction over this facility. 6. This permit may be modified or reissued at any time to incorporate any conditions, limitations, and/or monitoring requirements the Division deems necessary to adequately protect the environment and public health. The installation of groundwater monitoring wells or a leak detection system may be required at the discretion of the Division of Waste Management. 7. This facility consists of one above ground 1,000-gallon fiberglass tank for the storage of portable toilet waste pumped from boats. A portable trailer tank shall be used to transfer the waste from the boats to the 1,000-gallon storage tank. Waste shall not be stored in the portable trailer tank. Storage or treatment of any liquid or solid wastes other than those specified in the approved application for this permit is prohibited. The Division shall be notified of any changes to the facility prior to their implementation. Facility Permit No.: SDTF-16-10 Sea Gate Association, Inc. Permit to Operate March 22, 2019 Page 3 of 8. This storage facility shall only be used for storing portable toilet waste pumped from boats. The storage facility and pumping device shall only be operated for the discharge of septage under the supervision of Sea Gate Association, Inc. staff unless and until the Division makes a modification toe the conditions of this permit. 9. This permit shall expire on March 15, 2024. Renewal or modification of this permit shall be in accordance with 15A NCAC 13B .0837 (i), (m), (n) or (q). An application for permit renewal shall be submitted at least ninety (90) days prior to the permit renewal date. 10. Records shall be maintained in accordance with the Septage Management Rules. These records shall be made available to a representative of the Division upon request. 11. Any duly authorized officer, employee, or representative of the Division may, upon presentation of credentials, enter and inspect any property, premises, or place on or related to the facility, at any reasonable time for the purpose of determining compliance with this permit; may inspect or copy any records that must be kept under the conditions of this permit; or may obtain samples of groundwater, surface water, or leachate. 12. Sea Gate Drive in Carteret County Dear Ms. Ramsey: The NC Division of Waste Management has reviewed your application to operate a septage detention facility in Carteret County. Your application has been approved in accordance with NC Septage Management Rules and your permit, SDTF-16-10, is enclosed. Please read all permit conditions carefully and pay close attention to Permit Conditions 2, 4, 7, and 9. This permit covers the use of one (1) 1,000 gallons fiberglass tank for the storage of portable toilet waste pumped from boats. This permit shall expire on March 15, 2024 and an application for permit renewal must be submitted ninety (90) days prior to permit expiration. Failure to operate the septage detention facility in accordance with NC Septage Management Rules and the enclosed permit could subject you to administrative penalties of up to $15,000 per violation per day. Again, please read your permit carefully and refer to it as “SDTF-16- 10” when communicating to the Division.
