Septage could be seen leaking from valve onto the ground at time of inspection. This is a violation of Rule .0838(j) that states “Septage shall be transferred to and from a detention system in a safe and sanitary manner that prevents leaks or spills of septage, including in pipes used for transferring waste to and from vehicles.”

administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

Observed violation
1 – Site has proper signage 2 – Good access road 3 – Accessible area for tank inspections 4 – Above ground tank appears structurally sound 5 – No objectionable odor or vectors noted 6 – Appears that the setback distances are being met
7 – Valve on one tank shows leakage. This is a violation of Rule .0838(j) that states “Septage shall be
transferred to and from a detention system in a safe and sanitary manner that prevents leaks or spills of septage, including in pipes used for transferring waste to and from vehicles.” Please address issue so as no further leaks can be seen at tank site.
