Box 1109 Monroe, NC 28111-1109 Attn: Olin Furr Dear Mr. Furr: NORTH CAROLINA Environmental Quality March 25, 2019 Re: Notice of Regulatory Requirements 15A NCAC 2L .0407(b) Risk -based Assessment and Corrective Action for Petroleum Underground Storage Tanks Amoco #9 7810 Lyles Lane, Concord Cabarrus County Incident Number: 36757 Risk Classification: High The UST Section, Division of Waste Management (DWM), Mooresville Regional Office (MRO) received the January 18, 2019 Groundwater Monitoring Report on January 25, 2018. The report recommending implementation of the proposed Corrective Action Plan and continued semiannual groundwater sampling was reviewed and approved on March 25, 2019. The paper report copies will be maintained in the MRO. The electronic copies have been loaded to the DWM's electronic document storage system (Laserfiche). The report states: • The Amoco #9 site is a retail gasoline and convenience store. A petroleum release occurred at the site in September 2009, due to a third party motor vehicle colliding with a petroleum dispenser at the site (dispenser #1). The third party has been identified, and EMC Insurance is investigating the identified third party for insurance coverage. Surface water bodies are not located within a 250-foot radius of the site. The closest surface water feature is a drainage ditch situated approximately 360 feet northwest of the UST basin. The property slopes to the south, therefore, stormwater from the site and adjacent properties would be expected to flow towards the south. The surface water body was neither impacted nor significantly threatened by the subject release. The site is not located within a wellhead protection area. One water supply well, formerly used for irrigation purposes, is located within 250 feet of the UST basin. Based on information provided by the owner of this well, the well is damaged and not currently in service. No other water supply wells were identified within 1000 feet of the site. The subject site and all adjacent properties utilize public water supplies for potable water. However, water level data suggests the water table beneath the Amoco #9 property itself is locally influenced. This is most likely due to natural and/or manmade structures in the subsurface. Local mounding of the water table near the UST basin is not considered to be unusual, given the differences between the hydraulic conductivity and porosity of the UST basin backfill materials, and the native soil at the site. • Historically, the bulk of the dissolved -phase petroleum plume in groundwater beneath the site is situated on the Amoco #9 site in the vicinity of the initial spill area, with the geometry of the plume being enlarged toward the South and Southeast. • HES prepared and submitted a Corrective Action Plan (CAP) that has been reviewed and approved by the NCDEQ — Mooresville Regional Office. An agreement with the property owner (The Bermuda Corporation) is being negotiated for the implementation of the CAP. • Twelve monitoring wells have been installed at the site (I I EPA Type II (MW-1 is 30', MW-I 1 is 44', remainder are 20'), & 1 EPA Type III (MW-1D is 40')). • The most recent groundwater monitoring event was completed on December 18, 2018. None of the monitoring wells contained any free product. • Monitoring wells MW-1, MW-1D, MW-7, and MW-8 were unable to be sampled during the December 18, 2018 sampling event due to damage caused by repaving activities on the property. • One dissolved phase petroleum constituent was detected in site during the December 18, 2018 monitoring event (MW-3 MTBE=43µg/L) at a concentration greater than the respective NCAC 2L Standard. Per this Notice of Regulatory Requirements: • Continue sampling monitoring wells on a semi-annual basis (next sampling event June 2019). • Reinstall monitoring well MW-1 near its current location and reinstall MW-1D (place within the inferred MTBE plume boundaries). • Add one new monitoring well on the western side of the MTBE plume in on the Sonny's BBQ property. • Seek permission to sample the irrigation well located at Sonny's BBQ. Seek permission to abandon the water supply well. Make sure that this well's location is shown on future site maps. • Make sure that dates in the report match those of site sampling events and the current year. • The next remediation monitoring report is due no later than July 31, 2019. Failure to comply with the State's rules in the manner and time specified may result in the assessment of civil penalties and/or the use of other enforcement mechanisms.
