REGAN Secretary MICHAEL SCOTT Director May 9, 2017 CERTIFIED MAIL 7015 1520 0003 5462 8957 RETURN RECEIPT REQUESTED James Murphy, Operations Manager 212 Bulb Avenue Gastonia, NC 28052 SUBJECT: Notice of Deficiency Compliance Inspection Report United Site Services NCS-01398 Gaston Dear Mr. Murphy: On April 27, 2017 and May 1, 2017, Troy Harrison, representing the State of North Carolina, Division of Waste Management Solid Waste Section (Section), inspected septage pumper vehicles owned by the above referenced facility for compliance with North Carolina solid waste statutes and rules. The following violation were noted: A. North Carolina General Statute (NCGS) 130A-291.1 (h1) states in part: “A permitted septage management firm shall notify the Department within 10 days of placing a pumper truck in service that was not previously included in a permit issued to the firm and shall make the pumper truck available for inspection by the Department.” The above violation may have or can compromise the facility’s ability to ensure protection of the public health and the environment. A compliance inspection was conducted on April 27 2017 and May 1 2017 of the septage pumper vehicles for United Site Services. No further action is necessary. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
