STATUS OF PERMIT:
A Permit to Operate “Municipal Solid Waste Landfill Phases 1,2, and Temporary Cell 1 of Phase 4; Land Clearing
and Inert Debris Landfill” was issued to Ashe County on April 15, 2011. This permit expires on October 14, 2014.
A Permit to Construct “Municipal Solid Waste Landfill Phase 4” was issued to Ashe County on April 15, 2011.
PURPOSE OF SITE VISIT:
Partial Inspection
STATUS OF PAST NOTED VIOLATIONS:
15A North Carolina Administrative Code 13B .1626(2)(a): During the previous inspection performed on February
17, 2012, insufficient soil cover was observed on inactive portions of Phase 4, Temporary Cell 1 north of the working
face. Waste was also exposed within the eastern slope of Phase2 where it meets Phase 4. In order to achieve
compliance, Ashe County was requested to cover all inactive portions of the landfill to include the eastern slope of
Phase 2 with a minimum of six inches of earthen material.

An inspection performed on March 13, 2012 found a significant improvement in operational cover. However, some
waste remained exposed on the eastern slope of Phase 2. This area must be addressed to comply with the Notice of
Violation issued on March 2, 2012. All remaining exposed waste within the inactive portions of the landfill must
be covered with a minimum of six inches of earthen material within 7 days of issuance of this inspection report.
15A North Carolina Administrative Code 13B .1626(11)(c): During the previous inspection performed on
February 17, 2012, windblown material was observed east of the active landfill. This waste was deposited in the
subject area prior to the day of the inspection and had not been returned to the working face at the end of the working
day from which it was generated.
The inspection performed on March 13, 2012 found that windblown waste had been well controlled. This violation is
considered resolved.
OBSERVED VIOLATIONS:
None
ADDITIONAL COMMENTS
1. The facility consists of a MSWLF, Land Clearing and Inert Debris Landfill, scrap tire collection area, and white
goods collection area.
2. This was a partial inspection to observe efforts to comply with the Notice of Violation issued on March 2, 2012.
Operations inspection of the MSWLF:
3. Waste was being accepted into Phase 4, Temporary Cell 1.
4. The working face was of manageable size at the time of inspection.
5. No unacceptable waste streams were observed.
6. Edge of liner markers were in place and maintained.
7. The facility is approved for the use of fabric tarps as an alternate daily cover. No tarps were being used with the
landfill at the time of inspection.
8. Construction of the new wind fence had been completed to a point well north of the working face. Continue to
monitor this area to ensure that the fence will function adequately to control windblown waste in its current
configuration.
9. It appears that past attempts to stabilize the inactive Phase 2 area of the landfill have failed leaving the majority of
soil with little to no vegetative cover. Efforts must be taken to stabilize Phase 2 with a groundcover sufficient to
restrain erosion.
10. It appeared that the angle of the eastern slopes of Phase 2 were too steep to retain soil cover. This issue was
discussed with Mr. Snyder who stated that efforts would begin immediately to properly cover these slopes with
adequate cover. Landfill staff began moving equipment into place prior to the end of the inspection.
11. All access roads were of all weather construction and maintained.
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and
any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
