OF COAL CUMBUSTION BY—PRODUCTS (T15A: 13B, 1700)
SITING FOR STRUCTURAL FILL FACILITIES
(A) COAL COMBUSTION BY—PRODUCTS USED AS A STRUCTURAL FILL SHALL NOT BE PLACED:
1. WITHIN 50 HORIZONTAL FEET OF A JURISDICTIONAL WETLAND UNLESS AFTER CONSIDERATION OF THE CHEMICAL AND
PHYSICAL IMPACT ON THE WETLAND, THE U.S. CORPS OF ENGINEERS ISSUES A PERMIT OR WAIVER FOR THE FILL
2, WITHIN 50 HORIZONTAL FEET OF THE TOP OF THE BANK OF A PERRENIAL STREAM OR OTHER SURFACE WATER BODY
3, WITHIN TWO FEET OF THE SEASONAL HIGH GROUND —WATER TABLE
4 WITHIN 100 HORIZONTAL FEET OF ANY SOURCE OF DRINKING WATER, SUCH AS A WELL, SPRING OR OTHER GROUNDWATER
SOURCE OF DRINKING WATER:
5. WITHIN AN AREA SUBJECT TO A ONE —HUNDRED YEAR FLOOD, UNLESS IT CAN BE DEMONSTRATED TO THE DIVISION THAT THE

PLACEMENT HAS CEASED, THE FINAL COVER SHALL BE APPLIED OVER THE COAL COMBUSTION BY—PRODUCT PLACEMENT AREA.
0 (B) THE FINAL SURFACE OF THE STRUCTURAL FILL SHALL BE GRADED AND PROVIDED WITH DRAINAGE SYSTEMS THAT1
855 1, MINIMIZE EROSION OF COVER MATERIALS; AND
2. PROMOTE DRAINAGE OF AREA PRECIPITATILIN, MINIMIZE INFILTRATIDN AND PREVENT PENDING OF SURFACE WATER
ON THE STRUCTURAL FILL,
(C) OTHER EROSION CONTROL MEASURES, SUCH AS TEMPORARY MULCHING, SEEDING OR SILT BARRIERS SHALL BE INSTALLED TO
ENSURE NO VISIBLE COAL COMBUSTION BY—PRODUCT MIGRATION TO ADJACENT PROPERTIES UNTIL THE BENEFICIAL END USE
OF THE PROJECT IS REALIZED.
(D) THE CONSTRUCTION OR OPERATOR SHALL SUBMIT A CERTIFICATION TO THE DIVISION SIGNED AND SEALED BY A REGISTERED
PROFESSIONAL ENGINEER OR SIGNED BY THE SECRETARY OF THE DEPARTMENT OF TRANSPORTATIONOR HIS DESIGNEE
CERTIFYING THAT ALL REQUIREMENTS IN THE RULES OF THIS SECTION HAVE BEEN MET. THE REPORT SHALL BE SUBMITTED
WITHIN 30 DAYS OF THE APPLICATION OF THE FINAL COVER,
(E) THE DIVISION AND THE DEPARTMENT OF TRANSPORTATION SHALL AGREE ON SPECIFIC CLOSURE CRITERIA THAT APPLY TO
DEPARTMENT OF TRANSPORTATION PROJECT.
RECORDATION OF STRUCTURAL FILL FACILITIES
845 (A) THE OWNERS OF LAND WHERE COAL COMBUSTION BY—PRODUCTS HAVE BEEN UTILIZED IN VOLUMES OF MORE THAN 1,000
CUBIC YARDS SHALL FILE A STATEMENT OF THE VOLUME AND LOCATIONS OF THE COAL COMBUSTION BY—PRODUCTS WITH
THE REGISTER ❑F DEEDS ❑FFICE IN THE COUNTY OR COUNTIES WHERE THE PROPERTY IS LOCATED. THE STATEMENT SHALL
IDENTIFY THE PARCEL OF LAND ACCORDING TO THE COMPLETE LEGAL DESCRIBED BY G,S. 47-38 THROUGH 47-70
(B) RECORDATION SHALL BE REQUIRED WITHIN 90 DAYS AFTER COMPLETION OF COAL COMBUSTION BY—PRODUCT FILL PROJECT.
(C) THE REGISTER OF DEEDS IN ACCORDANCE WITH 6S,161-14 SHALL RECORD THE NOTARIZED STATEMENT AND INDEX IT IN
THE GRANTOR INDEX UNDER THE NAME OF THE OWNER(S) OF THE LAND. THE ❑RIGINAL NOTARIZED STATEMENT WITH THE
REGISTERS AND THE DATE, BOOK AND PAGE NUMBER OF RECORDING SHALL BE RETURNED TO THE DIVISION AFTER
RECORDING.
(D) WHEN PROPERTY WITH MORE THAN 1,000 CUBIC YARDS OF COAL COMBUSTION BY—PRODUCTS IS SOLD, LEASED, CONVEYED OR
TRANSFERRED IN ANY MANNER, THE DEED OR OTHER INSTRUMENT OF TRANSFER SHALL CONTAIN IN THE DESCRIPTION SECTION
IN NO SMALLER TYPE THAN USED IN THE BODY ❑F THE DEED OR INSTRUMENT A STATEMENT THAT COAL COMBUSTION
BY—PRODUCTS HAVE BEEN USED AS FILL MATERIAL ON THE PROPERTY,

DUKE POWER PERFORMANCE STANDARDS COAL ASH STRUCTURAL FILL
A MINIMUM OF ONE DENSITY TEST SHALL BE PERFORMED FOR EVERY 2,500 CUBIC YARDS OF ASH PLACED
IN A FILL PROJECT, ALL FIELD TESTS FAILING TO MEET THE REQUIRED DENSITY ARE TO BE RETESTED
UNTIL RESULTS ARE WITHIN COMPLIANCE SPECIFIED WITHIN THESE STANDARDS OR ALLOWED BY RESPONSIBLE
ENGINEER. ALL FAILING TESTS AND RETESTS SHALL BE DOCUMENTED PRIOR TO CONTINUING WORK. IN THE
EVENT OF THREE CONSECUTIVE FAILING TESTS, AN AREA CONVERING APPROXIMATELY 100 SQUARE FEET
MINIMUM SHALL BE REWORKED AND RETESTED UNTIL RESULTS ARE WITHIN REQUIRED DENSITY, APPROXIMATE
ELEVATIONS OF TEST LOCATIONS AND POSITION RELATIVE TO BOUNDARY LINES SHALL BE RECORDED ON A
PLAN VIEW OF PROJECT AND SUBMITTED WITH THE FINAL REPORT, ALLOWABLE TEST METHODS ARE ASTM D1556
(SAND CONE), ASTM D1587 (TUBING SAMPLING), ASTM D2167 (BALLOON), ASTM DS922 (NUCLEAR), AND ASTM
D2937 (DRIVE CYLINDER) THE DRIVE CYLINDER METHOD OF FIELD TESTING IS PREFERRED,
REGARDLESS OF THE METHOD, FIELD TESTS SHALL BE CONSISTENT WITH RESPECT To COMPARISON WITH THE
LABORATORY COMPACTION RESULTS, ALL FIELD DENSITY TESTS SHALL BE COMPILED IN A REPORT AND
PRESENTED TO DUKE POWER FOR ALL IN CONJUCNTION WITH FINAL CLOSURE AND RECORDATION OF THE PROJECT,
FINAL SOIL COVER REQUIREMENTS ARE A MINIMUM OF 18" FOR ALL EXPOSED COAL ASH SURFACES, IT IS
RECOMMENDED THAT ADDITIONAL COVER SOIL BE PLACED ON EXTERNAL SLOPES HAVING A POTENTIAL FOR
EXTREME EROSION. ADDITIONAL COVER IN THIS CASE SHALL BE DETERMINED BY THE RESPONSIBLE ENGINEER
COVER SOIL DENSITY AND THICKNESS ON ALL HORIZONTAL SURFACES AND SLOPES SHALL BE VERIFIED BY DENSITY
TESTS AND/OR OTHER METHODS BY SOIL TESTING SERVICE EMPLOYED BY OWNER. INFORMATION OBTAINED SHALL
BE INCLUDED IN REPORT MENTIONED ABOVE. TWO METHODS OF ESTABLISHING SOIL COVER MAY BE IMPLEMENTED,
METHOD 1) SOIL COVER SHALL BE PLACED ALONG PERIMETER OF FILL AREA IN CONJUNCTION WITH ASH FILL LIFTS
TO PREVENT LOSS OF ASH DURING CONSTRUCTION PERIOD. METHOD 2) SOIL CONTAINMENT BERMS MAY BE
ESTABLISHED PRIOR TO ASH PLACEMENT. THESE BERMS SHALL BE CONSTRUCTED IN COMPACTED LIFTS TO INSURE
STRUCTURAL STABILITY,
MINIMUM DENSITY REQUIRED SHALL BE 95% ❑F STANDARD PROCTOR VALUE AS ESTABLISHED BY
ASTM D698 METHOD A, UNLESS ❑THERWISE NOTED OR APPROVED BY THE ENGINEER.
LIFT THICKNESS OF COAL ASH SHALL NOT EXCEED 12", EXCEPT BY APPROVAL FROM ENGINEER,
MINIMUM 24" SOIL COVER SHALL BE PLACED ABOVE ALL SUBSURFACE DRAINS (LE. FRENCH DRAINS) AND
PIPES USED TO CONTROL WATER AT LOWEST ELEVATIONS PRIOR TO PLACEMENT OF COAL ASH AS
STRUCTURAL FILL, NO COAL ASH SHALL BE PLACED WITHIN 24" OF THE SEASONAL HIGH GROUNDWATER TABLE.
DENSITY TESTS SHALL BE PERFORMED ON EXISTING SOIL BASE MATERIAL OF PROJECT SITE PRIOR TO ASH
PLACEMENT AS FILL. DENSITY REQUIREMENT ON IN SITE MATERIAL BELOW ASH FILL CONTAINMENT BERMS
MENTIONED PREVIOUSLY SHALL BE SPECIFIED BY RESPONSIBLE DESIGN ENGINEER
FINAL SEEDING AND GRASSING REQUIREMENTS AS SPECIFIED BY THE ENGINEERS DRAWING SHEET, SHALL
BE MODIFIED ONLY BY APPROVAL OF ENGINEER, ADEQUATE SEEDING SHALL BE PERFORMED IMMEDIATELY
AFTER PLACEMENT OF FINAL COVER TO MINIMIZE EROSION.
UPON COMPLETION OF COAL ASH PLACEMENT AS FILL AND FINAL SOIL COVER, SITES UNDER THE GUIDANCE
OF SOILED WASTE REGULATIONS SECTION 1700 SHALL COMPLY WITH THE GENERAL REQUIREMENTS AND
SPECIFIED ITEMS OF CLOSURE AS SHOWN IN SECTIONS 1706 AND RECORDATION AS SHOWN IN SECTION 1707.
THE CLOSURE COMPLIANCE DOCUMENT SHALL BE PREPARED BY THE DESIGN ENGINEER WITH HIS
PROFESSIONAL ENGINEER STAMP OR SEAL, RECORDATION OF THE ASH FILL WITH THE REGISTER OF DEEDS

RECORDATION OF STRUCTURAL FILL FACILITIES
(A) THE OWNERS OF LAND WHERE COAL COMBUSTION BY-PRODUCTS HAVE BEEN UTILIZED IN VOLUMES OF MORE THAN 1,000
CUBIC YARDS SHALL FILE A STATEMENT OF THE VOLUME AND LOCATIONS OF THE COAL COMBUSTION BY-PRODUCTS WITH
THE REGISTER OF DEEDS OFFICE IN THE COUNTY OR COUNTIES WHERE THE PROPERTY IS LOCATED. THE STATEMENT SHALL
IDENTIFY THE PARCEL OF LAND ACCORDING TO THE COMPLETE LEGAL DESCRIBED BY GS. 47-38 THROUGH 47-70.
(B) RECORDATION SHALL BE REQUIRED WITHIN 90 DAYS AFTER COMPLETION OF COAL COMBUSTION BY-PRODUCT FILL PROJECT,

UNTIL RESULTS ARE WITHIN COMPLIANCE SPECIFIED WITHIN THESE STANDARDS OR ALLOWED BY RESPONSIBLE
ENGINEER, ALL FAILING TESTS AND RETESTS SHALL BE DOCUMENTED PRIOR TO CONTINUING WORK. IN THE
EVENT OF THREE CONSECUTIVE FAILING TESTS, AN FREA CONVERING APPROXIMATELY 100 SQUARE FEET
MINIMUM SHALL BE REWORKED AND RETESTED UNTIL RESULTS ARE WITHIN REQUIRED DENSITY, APPROXIMATE

EXTREME EROSION. ADDITIONAL COVER IN THIS CASE SHALL BE DETERMINED BY THE RESPONSIBLE ENGINEER.
COVER SOIL DENSITY AND THICKNESS ON ALL HORIZONTAL SURFACES AND SLOPES SHALL BE VERIFIED BY DENSITY
TESTS AND/OR OTHER METHODS BY SOIL TESTING SERVICE EMPLOYED BY OWNER. INFORMATION ❑BTAINED SHALL
BE INCLUDED IN REPORT MENTIONED ABOVE. TWO METHODS OF ESTABLISHING SOIL COVER MAY BE IMPLEMENTED.

CONSTRUCTION SPECIFICATIONS
1. SITE PREPARATIONS - CLEAR, GRUB AND STRIP TOPSOIL FROM AREAS UNDER
THE EMBANKMENT TO REMOVE TREES, VEGETATION, ROOTS AND OTHER
OBJECTIONABLE MATERIAL. TO FACILITATE SEDIMENT CLEANOUT AND
RESTORATION, CLEAR THE POOL AREA OF ALL BRUSH, TREES AND OTHER
OBJECTIONAL MATERIALS. STOCKPILE ALL TOPSOIL OR SOIL CONTAINING
ORGANIC MATTER FOR USE ON THE OUTER SHELL OF THE EMBANKMENT TO
FACILITATE VEGETATIVE ESTABLISHMENT.
2. EMBANKMENT - ALL FILL MATERIAL SHOULD BE CLEAN MINERAL SOIL, FREE
OF ROOTS, WOODY VEGETATION, ROCKS, AND OTHER OBJECTIONABLE MATERIAL.
SCARIFY AREAS ON WHICH FILL IS TO BE PLACED BEFORE PLACING FILL.
THE FILL MATERIAL MUST CONTAIN SUFFICIENT MOISTURE SO IT CAN BE
FORMED BY HAND INTO A BALL WITHOUT CRUMBLING. IF WATER CAN BE
SQUEEZED OUT OF THE BALL, IT IS TOO WET FOR PROPER COMPACTION.
PLACE FILL MATERIAL IN 6 TO 8-INCH CONTINUOUS LAYERS OVER ENTIRE
LENGTH OF THE FILL AREA AND THEN COMPACT IT. COMPACTION MAY BE
OBTAINED BY ROUTING THE CONSTRUCTION HAULING EQUIPMENT OVER THE FILL
SO THAT THE ENTIRE SURFACE OF EACH LAYER IS TRAVERSED BY AT LEAST
ONE WHEEL OR TREAD TRACK OF THE HEAVY EQUIPMENT, OR A COMPACTOR
MAY BE USED. CONSTRUCT THE EMBANKMENT TO AN ELEVATION 10% HIGHER
THAN THE DESIGN HEIGHT TO ALLOW FOR SETTLING.
3. CONDUIT SPILLWAYS - ALL CONDUIT MATERIALS SHALL BE AS SHOWN
ON PLANS. DO NOT USE PERVIOUS MATERIAL SUCH AS
SAND, GRAVEL, OR CRUSHED STONE AS BACKFILL AROUND THE PIPE SP!LL',"4,
IN 4-INCH LAYERS AND COMPACT IT UNDER AND AROUND THE PIPE TO AT LEAST
THE SAME DENSITY AS THE ADJACENT EMBANKMENT. CARE MUST BE TAKEN
NOT TO RAISE THE PIPE FROM FIRM CONTACT WITH ITS FOUNDATION WHEN
COMPACTING UNDER THE PIPE HAUNCHES.
PLACE A MINIMUM DEPTH OF 2 FT. OF HAND -COMPACTED BACKFILL OVER THE
PIPE SPILLWAY BEFORE CROSSING IT WITH CONSTRUCTION EQUIPMENT.
IN NO CASE SHOULD THE PIPE CONDUIT BE INSTALLED BY CUTTING A TRENCH
THROUGH THE PAM AFTER THE EMBANKMENT IS COMPLETE.
4. EMERGENCY SPILLWAY - INSTALL THE EMERGENCY SPILLWAY IN UNDISTURBED
SOIL. THE ACHIEVEMENT OF PLANNED ELEVATIONS, GRADE, DESIGN WIDTH,
AND ENTRANCE AND EXIT CHANNEL SLOPES ARE CRITICAL TO THE SUCCESSFUL
OPERATION OF THE EMERGENCY SPILLWAY.
5. INLETS - DISCHARGE WATER INTO THE BASIN IN A MANNER TO PREVENT
EROSION. USE DIVERSIONS WITH OUTLET PROTECTION TO DIVERT SEDIMENT -
LADEN WATER TO THE UPPER END OF THE POOL AREA TO IMPROVE BASIN
TRAP EFFICIENCY.
6. EROSION CONTROL - CONSTRUCT THE STRUCTURE SO THAT THE DISTURBED
AREA IS MINIMIZED. DIVERT SURFACE WATER AWAY FROM BARE AREAS.
COMPLETE THE EMBANKMENT BEFORE THE AREA IS CLEARED. STABILIZE THE
EMERGENCY SPILLWAY EMBANKMENT AND ALL OTHER DISTURBED AREAS ABOVE
THE CREST OF THE PRINCIPAL SPILLWAY IMMEDIATELY AFTER CONSTRUCTION.
7. SAFETY - DETENTION BASINS MAY ATTRACT CHILDREN AND CAN BE DANGEROUS.
AVOID STEEP SIDE SLOPES, AND FENCE AND MARK BASINS WITH WARNING
SIGNS IF TRESPASSING IS LIKELY. FOLLOW ALL STATE AND LOCAL

PREPARATION:
Preparation of Planting Soil: Mix lime with dry soil prior
to mixing of fertilizer. Prevent lime from contacting acid
loving plants.
Apply phosphoric acid fertilizer to(other than that
constituting a portion of complete fertilizers) directly
to subgrade before applying planting soil and tilling.
Preparation of Seeding Bed: Loosen subgrade of areas
to be grassed to a minimum of 4". Remove stones 1 1/2'
In any dimension and sticks, roots, rubbish, and other
extraneous matter. Limit preparation to areas which
will be planted promptly after preparation.
Seed bed Is to conform to ground elevations as shown
on the Construction Drawings, or as was existing prior
to construction. Light rolling and natural settlement
should be taken Into account. The completed seed bed
should blend uniformly Into the surrounding topography.
Good surface drainage of the bed must be provided.
Visible ponding will not be allowed.
Apply specified commercial fertilizer as the specified
rates, and thoroughly mix Into the upper 2' of the seed
bed. Delay application of the fertilizer if lawn planting
will not follow within a few days.
In established lawn areas, fine grade seed bed to a
smooth, even surface with loose, uniformly fine texture.
Roll, rake, ad drag lawn areas, remove ridges and fill
depressions as required to meet finished grades. Limit
fine grading to areas which can be planted immediately
after grading.
Moisten prepared lawn areas before grassing if soil Is
dry. Water thoroughly and allow surface moisture to
dry before planting. Do not create a muddy soil
condition.
Restore seed beds to specified conditions if eroded or
otherwise disturbed after fine grading and prior to
planting.

Do not wet seed or seed which Is moldy or otherwise
damaged In transit or storage.
Sow seed using a spreader or seeding machine. Do not
seed when wind velocity exceeds 5 miles per hour.
Distribute evenly over entire area by sowing equal
quantity In two directions at right angles to each other.
Sow not less that the quantity of seed specified.
Rake seed lightly Into the top one -eighth Inch of soil,
roll lightly, and water with a fine spray.
Protect seeded slopes against erosion by spreading
speclfled lawn mulch after completion of seeding
operations. Spread uniformly to form a continuous
blanket not loss than 1 1/2 , loose measurement, over
seeded areas.
HYDROSEEDING NEW LAWNS:
Mix specified seed, fertilizer. and pulverized mulch In
water, using equipment specifically designed for hydroseed
application. Continue mixing until uniformly blended Into
homogeneous slurry, suitable for hydraulic application.
Apply slurry uniformly to all areas to be seeded. Rate
of applications Is to be as required to obtain specified
seed sowing rate.
MULCHING:
After fertilizing, seeding, raking, and tilling, dried straw
Is to be uniformly spread over the area at the rate
of 90 pounds per 1000 square feet. Straw Is to be
sprayed with liquid asphalt to bong and anchor It.
Liquid asphalt (kerosene thinned) Is to be applied at a
rate of 150 gallons per ton of straw (approximately 7
gallons per 1000 square feet).

MAINTENANCE:
Begin maintenance Immediately after planting.
Maintain seeding for not less than 60 days after
substantial completion, and longer as required to
establish an acceptable stand. If seeded in fall
and not given full 60 days of maintenance, or if
not considered acceptable at that time, continue
maintenance the following spring until an acceptable
stand Is established.
Maintain grossing by watering, fertilizing, weeding,
mowing, trimming, and other operations such as rolling,
regrading and replanting as required to establish a
smooth, acceptable lawn, free of eroded bare area.
INSPECTION AND MAINTENANCE
When grassing is completed, Including maintenance, the
Engineer will, upon request, make an Inspection to
determine acceptability.
When Inspected grassing does not comply with the
requirements, replace rejected work and continue
specified maintenance until reinspected by the
Engineer and found acceptable.
SEASONAL SEEDING MIXTURE AND RATES OF APPLICATION
Seasonal seeding mixtures and rate of application
shall be as follows. All rates are In pounds per
1000 square feet.
Seeding within right-of-ways of state roadways will
be accomplished in accordance with the requirements
pertaining to maintained lawns.
Unless otherwise required by the State of the Engineer
(pursuant to potential erosion of ditches or steep
slopes) seed within road right-of-way will be treated
like established lawns.
