Harris LMC Block 42 Holding, LLC 201 South Tryon Street, Suite 1000 Charlotte, North Carolina 28202 jeff-harris@livelmc.com Subject: Brownfields Soil Management Options Block 42 Brownfield Property Charlotte, Mecklenburg County Brownfields Project No. 21024-17-060 Dear Mr. Harris: The North Carolina Department of Environmental Quality (DEQ) Brownfields Program received a request to export fill from the Block 42 Brownfields Property. This request was submitted on your behalf by Mr. Ralph McGee, PG of Hart & Hickman, PC via emails on January 9, 2019 and January 22, 2019. Specifically, the request was to export up to 8,000 cubic yards of non-impacted soils to a beneficial fill reuse site known as Fleet Maintenance & Repair, Inc. in Mt. Holly which is raising grade to construct an asphalt parking lot. DEQ Brownfields reviewed the soil analytical data available for the Brownfields Property from the Brownfields Assessment Report dated January 22, 2018, the In-Situ Soil Characterization Assessment Report dated February 1, 2019, and the Test Pit In-Situ Soil Characterization Report dated February 12, 2019. In addition, DEQ reviewed the results from collected at the proposed Fleet Maintenance & Repair and Charlotte Douglas International Airport receiving facilities. Based on our review of the data, the DEQ Solid Waste Section and DEQ Brownfield’s agree that these soils may be exported as outlined in the table below. Please note that the “Beneficial Fill” option listed in the table below is specifically approved for the Fleet Maintenance & Repair facility in Mt. Holly, NC or the Charlotte Douglas International Airport. Other Beneficial Fill and Land Clearing & Inert Debris Landfill (LCID) options may be available; however, DEQ requires that the receiving facility be identified and approved prior to export. The receiving facility should have metals concentrations which are consistent with those from the Brownfields Property. Similarly, many site soils, including those with impacts, may be suitable for use at another Brownfields Property that has similar impacts. Additional sampling would potentially be required beyond these depths prior to export. 2) BFILL= Beneficial Fill; LCID = Land Clearing & Inert Debris Landfill; CDLF = Construction & Demolition landfill; MSWLF = Municipal Solid Waste landfill (MSWLF) facility. Per the Block 42 EMP, the soils will be field screened during excavation prior to export from the property. If unanticipated impacts are identified during excavation, please refer to the EMP for further actions and cease transfer until appropriate characterization can be completed. In addition, and also in accordance with the site’s approved EMP, an annual Redevelopment Summary Report will be submitted to DEQ Brownfields. Details related to the disposition of this soil including but Mr. Jeffrey Harris February 14, 2019 Page 3 not limited to, total volume, general description of field screening efforts, etc. should be included with the Redevelopment Summary Report. Please be advised that this approval does not waive any applicable requirement to obtain any necessary permits, licenses or certifications which may be required from other state or local entities.
