LCIDLF, Permit No. 41S-LCID. The written request is, on your behalf, prepared and submitted by Evans Engineering, Inc. According to the request document, the proposed fill grading that is up to 3 (horizontal) to 1 (vertical) will not result in any change of the approved operating gross capacity of 73,595 cubic yards and the approved waste footprints of 3.5 acres for the Phases 1 and 1A as shown the revised drawing Sheet No. 2 of 5 dated February 14, 2019. There is no other change of the approved permit application dated April 8, 2016 (DIN 25871). After the review, the SWS approves your request. The SWS send you this e-mail correspondence in lieu of issuing a new permit. The current permit dated April 19, 2016 (DIN 25851) that will expired on April 19, 2021 is still valid. Please keep this approval document including the new drawing Sheet No. 2 of 5 to the landfill facility operating record. If you have any questions of the permitting processes, please contact myself. I called a few minutes ago and left you a voicemail. Our plan that was submitted on 8-29-18 does label the disturbed area as 4.4 acres. However, the footprint of the LCID (fill area in Phase IA is only 3.5 acres as called for on the plan. The additional disturbed area is for the diversion berms and temporary sediment pits around the low side of the LCID. This 0.9 acres of disturbed area is not part of the Phase 1A LCID foot print. The 08/30/18 e-mail message stated D&D Grading Inc has operating waste footprint of 4.4 acres which exceed the permitted disposal area of 3.5 acres. To avoid any legal action or financial penalty may be taken by the SWS against D&D Grading, Inc. in the near future, please submit the request permit amendment application by February 28, 2019. This grade modification will change the operating capacity of the Phases 1 & 1A but will not change the approved gross capacity of the landfill of 387,142 cubic yards [the final fill grade at 780 feet amsl as shown on drawing Sheet No. 1 of 5 (DIN 25871)]. You agreed to submit a written request for narrating this permit modification and to revise the operating capacity for each phase (Phase 1 through 6) of the landfill shown on the submitted drawing Sheet No. 2 of 5. After obtaining the info from the phone conservation, the SWS conducted a quick review of the drawing Sheet No. 2 of 5 submitted on 08/29/2018 and other pertinent data in the SWS database/file system. The current permit for the LCIDLF dated April 19, 2016 (DIN 25851) allows Mr. David E. Dick – permit holder to construct and operate Phases 1 & 1A of the LCIDLF, which encompass approximately 3.5 acres. However, the latest Facility Annual Report and the submitted drawing Sheet No. 2 of 5 show the landfill waste disposal footprint is approximately 4.4 acres. It is evident that the permit holder has constructed and operated waste disposal activities at approximately 0.9-acre area which is NOT PERMITTED. Therefore, the SWS strongly recommends that the new permit application shall include the revision of waste footprint for each phase of the LCID landfill. Please noted that the total waste boundary of the landfill is 13.0 acres. The phasing plan including phases 1, 1A, 2 through 6 must be clearly delineated on the revised drawing. The first attachment above is of the approved plans. The second attachment shows how we would like to modify the fill in Phase 1 and 1A. The volumes are the same, this new configuration would allow for easier access as we progress into the future phases. After you have had a chance to review this, please call me. Thanks for your help.
