STATUS OF PERMIT:
The permit was issued September 30, 2015 and will expire on September 30, 2020. Please note that, pursuant to 15A
NCAC 13B .0201(g), no later than March 30, 2020, the owner or operator must submit a request to the Section for
permit review and must submit updated facility plans meeting the requirements of Rule 0.565 and .0566.

OBSERVED VIOLATIONS:
A. 15A NCAC 13B .0566 (2) states, "The facility shall only accept those solid wastes which it is permitted to
receive."
And the Facility Permit 42A-LCID, issued September 30, 2015, Attachment 3, Part I, Number 4 states, "This
facility is permitted to receive land clearing waste; yard trash; untreated and unpainted wood; uncontaminated
soil; inert debris such as unpainted rock, brick, concrete, and concrete block; and asphalt in accordance with
NCGS 130-294(m)."
During the inspection, a large amount of treated lumber was observed along the perimeter of the LCID. In

addition, the following non -conforming wastes were observed: insulation, painted asphalt, painted concrete,
concrete with PVC piping, metal, engineered wood, plastics and some miscellaneous trash.
B. 15A NCAC 13B .0566 (4) states, "Adequate soil cover shall be applied monthly, or when the active area reaches
one acre in size, whichever comes first."
At the time of the inspection, the perimeter of the LCID was uncovered. This issue was also noted in the
September 5, 2018 and February 13, 2018 inspection reports. The top of the LCID was well covered with soil and
there were piles of soil along the edge. It is clear that the intent was to cover the LCID, however since this is an
ongoing issue for the facility, it is being listed as an observed violation.
C. 15A NCAC 13B .0566 (10) states, "Surface water shall be diverted from the working face and shall not be
impounded over waste."
And 15A NCAC 13B .0566 (11) states, "Solid waste shall not be disposed of in water."
During the inspection, surface water was observed ponding against the LCID fill.
D. The Facility Permit 42A-LCID, issued September 30, 2015, Attachment 3, Part 1, Number 8 states,
"Excavation, grading and fill material side slopes must not exceed a ratio of three horizontal feet to one vertical
feet (3:1)."
Some of the slopes, especially the slope leading to the front entrance, where the water was ponding, were steeper
than 3:1. This issue was also noted in the September 5, 2018 and February 13, 2018 inspection reports.
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
ADDITIONAL COMMENTS
Roanoke Valley LCID Landfill is owned and operated by Rightmyer Machine Rentals, Inc. This facility is permitted to
receive land clearing waste; yard trash; untreated and unpainted wood; uncontaminated soil; inert debris such as unpainted
rock, brick, concrete, and concrete block; and asphalt in accordance with NCGS 130-294(m). The facility has set a
maximum disposal rate of 70,000 cubic yards per year (average of 275 cubic yards per day based on 253 operating days
per year). This facility is permitted to receive waste generated Halifax, Bertie, Hertford, Northampton, Warren, Vance,
Granville, Franklin, Nash, Wilson, Edgecombe, Pitt, Martin, Chowan, and Gates Counties in North Carolina and Suffolk,
Southampton, Greensville, Brunswick, Mecklenburg, Lunenburg, Nottoway, Amelia, Chesterfield, Dinwiddie, Prince
George, Sussex, Surry, and Ile of Wright Counties in Virginia. The facility is not open to the public.
