STATUS OF PAST NOTED VIOLATIONS:
1. CORRECTIVE ACTIONS IN PROGRESS:15A NCAC 13B .0503(2)(a)(ii) states: "A site shall meet the
following design requirements: The concentration of explosive gases generated by the site shall not exceed the
lower explosive limit for the gases at the property boundary."
Transylvania County has implemented the approved Landfill Gas Remediation Plan; however, methane levels still
exceed 100% of the lower explosive limit. Additional measures may be required, should the plan fail to reduce
methane levels at the facility boundary. Please see additional comment number seven for details.
2. CORRECTIVE ACTIONS IN PROGRESS:15A NCAC 13B .0203(d) states: `By receiving solid waste at a
permitted facility, the permittee(s) shall be considered to have accepted the conditions of the permit and shall
comply with conditions of the permit." The facility received a closure letter from the Solid Waste Section
[Section] on December 21, 1995 which stated post closure conditions.

The closure letter Post Closure Condition 1 states: "MANAGEMENT OF LANDFILL GAS: The owners
shall take the measures necessary to ensure that the closed site shall continue to meet the design standards
for landfill gas found in Rule .0503(2)(a)."
Transylvania County has implemented the approved Landfill Gas Remediation Plan; however, methane levels

reduce methane levels at the facility boundary. Please see additional comment number seven for details.
OBSERVED VIOLATIONS:
None
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
ADDITIONAL COMMENTS
1. All photos were taken by Lee Hill on February 4, 2019.
2. The facility is secured by a gate which is located at the Calvert Road Convenience site.
3. Good vegetative cover was established on the cap of the landfill and facility staff were in the process of mowing
at the time of the inspection.
4. A small amount of briars was observed to be growing on the south slope of the landfill. The county recently
purchased a skid steer with a rotary mowing deck attachment to aid in mowing areas that are difficult to
maintain with traditional means. Please remove the woody vegetation growing on the cap of the landfill.
5. Some settling was observed on the southern slope of the landfill. Please repair the area to maintain positive
drainage and prevent the potential for water standing on the cap of the landfill.
6. A portion of the concrete pad on newly constructed gas well GP-12R has been broken off and needs to be
repaired.
7. Results from the October 17, 2016 landfill gas monitoring revealed exceedances above the LEL in three wells:
GP-3 (308% of LEL), GP-8 (302% of LEL) and GP-9 (1204% of LEL). These exceedances prompted the section
to require a Landfill Gas Remediation Plan for the facility. On February 15, 2017, Joyce Engineering submitted a
"Proposed Remediation Strategy" on behalf of Transylvania County. This plan included installing two new
probes to replace existing probes GP-6 and GP-8 and quarterly monitoring for one year to determine if gas was
migrating off site. On March 6, 2017, the Section approved the interim remedial measure under the condition
that Transylvania County would submit a new landfill gas remediation plan if concentrations exceed the LEL for
two consecutive quarterly monitoring events in either of the new landfill gas probes. The facility conducted
monthly landfill gas monitoring from May 2017 to October 2017 in GP-6R and GP-8R which all exceeded the
LEL. On October 19, 2017, Joyce Engineering submitted a Landfill Gas Remediation Plan which proposed
installing two new landfill gas probes to replace GP-4 and GP-12. On December 6, 2017, the Section did not
approve the plan and instead required Transylvania County to submit a Landfill Gas Remediation plan to reduce
the methane concentrations below the LEL in GP-6R and GP-8R. On December 11, 2017, a revised
Landfill Gas Remediation Plan was submitted and was approved by the Section on January 10, 2018.
The approved plan included installing two new monitoring probes GP-4R and GP-12R to replace GP-4
and GP-12. The monitoring data from the new and existing wells would be used to design a landfill gas
intercept trench. On June 25, 2018, Joyce Engineering submitted details to the Section for the proposed
landfill gas intercept trench and it was approved on June 26, 2018 with the following conditions:

"Trench installation shall be completed within 60 days of this approval; LFG monitoring shall be
conducted within 30 days of trench installation; a progress report on the installation and initial
monitoring shall be submitted within 15 days of the initial monitoring; quarterly LFG monitoring shall
be conducted thereafter on the normal schedule for the facility; and, a LFG Corrective Action update
report evaluating the effectiveness of the trench to reduce methane levels to acceptable levels shall be
submitted to the Section after one year of operation." During the construction of the intercept trench,
random pockets of waste were found in the top two to three feet below the cover soil. On August 9,
2018, a sixty-day extension for construction of the landfill gas intercept trench was requested and
approved. The random pockets of waste that were encountered during the construction of the trench
were taken to the Transylvania County Landfill (8807-MSWLF-1992) for disposal. The trench was
completed on September 26, 2018, thus allowing the county to proceed with the other steps approved in
the Landfill Gas Remediation Plan. The sampling event that occurred on October 17, 2018 showed a
decrease in methane in the wells; however, levels still exceeded 100% of the lower explosive limit.
