PESA Report — 413 North Harrington Street Project Number: OOOR2644.00 Raleigh, North Carolina 800.486.7568 — www.MAAonline.com 413 North Harrington Street (0.96 Acres) Raleigh, North Carolina 1.0 Executive Summary Mid -Atlantic Associates, Inc. (Mid -Atlantic) has performed a Phase I Environmental Site Assessment (PESA) in conformance with the scope and limitations of the American Society for Testing and Materials (ASTM) Practice E 1527-13 at an 0.96 acre parcel of land located at 413 North Harrington Street in Raleigh, Wake County, North Carolina (the "subject site"). The parcel is located approximately 190 feet north of the intersection of North West Street with North Harrington Street in the Glenwood South District of downtown Raleigh. This work was completed by Mid -Atlantic under the terms and conditions of Proposal No. P14R-7071 approved by the client on December 11, 2014. Site maps showing the location and layout of the subject site are provided in Appendix 15.1 and Appendix 15.2. The subject site is developed with a 7,715 square foot building constructed in 1990 according to the Wake County Department of Revenue. Remaining parts of the property are developed with asphalt parking areas. The parcel is zoned DOD (Downtown Overlay District) according to the Wake County Department of Revenue. According to interview information and historical documentation, residences existed on the subject site from at least 1922 to 1959. The houses were then razed as part of a downtown Raleigh redevelopment initiative in approximately 1965. Two buildings were then constructed on the property and were present from 1971 to 1983. The north building was demolished between 1983 and 1988. The south building was either added onto by 1993, or a new building was constructed in the same footprint as the rectangular -shaped south building (the Wake County Department of Revenue lists a 1990 construction date). In the 2002 and later aerial photographs the subject site building is shown with a new, angled roof over the building footprint shown in earlier photographs. The buildings at the subject site after 1971 were used for offices, except for an equipment rental company listed in a 1972 city directory and a printing shop for a life insurance company (1982). The American Defender Life Insurance Company occupied the site in 1977 and 1982. Between 1988 and 1997, the buildings were used by the State Employees Association of NC, Inc. Between 2006 and 2011, the building was used as the Sales Office for the West at North condominium development (later "West") for West Developers, LLC. At the time of our site visit, the building was used for storage of furniture, appliances, signage, and interior decorations such as synthetic plants and candles. These items are used for staging by The Glenwood Agency for marketing of residential properties. Remaining in the building are example kitchens and bathrooms for the various condominium units, including floor space formerly used for a complete example condominium. The south side of the building was used for offices by Choate Construction between 2006 and 2008. Mid -Atlantic has performed this PESA in general conformance with the scope and limitations of ASTM Practice E 1527-13 and 40 CFR Part 312. Any exceptions to, or deletions from, these practices are described in Section 2.4 and Section 11.0 of this report. This assessment has revealed no evidence of RECs in connection with the subject site except for the following: • Documented groundwater contamination on two adjacent properties. Petroleum odors were noted on the southern adjacent, upgradient property during geotechnical drilling of two borings approximately 15 feet south of the subject site, and during installation of a footer approximately 90 feet south of the subject site. The borings and trench encountered the odor at depths near the presumed location of the water table. Laboratory results have Mid -Atlantic Associates, Inc. 1 PESA Report — 413 North Harrington Street Project Number: OOOR2644.00 Raleigh, North Carolina 800.486.7568 — www.MAAonline.com also confirmed groundwater contamination at a monitoring well on the eastern adjacent property which is located cross-gradient/upgradient of the subject site. The monitoring well is located approximately 130 feet southeast of the site. 40 CFR Part 112 requires environmental professionals to consider the information collected during performance of this PESA and render an opinion as to whether additional investigation is warranted to detect contamination. Based on information currently available for the subject site, it is our opinion that additional investigation is not warranted. Due to the close proximity of the impacts noted on the adjacent properties, it is likely that groundwater beneath the subject site is adversely impacted. Additional investigation would only be warranted to determine the degree and extent of these impacts. 2.0 Introduction 2.1 Purpose The purpose of this PESA was to identify RECs that are indicative of an existing release, past release, or material threat of a release at the subject site. This PESA was performed to satisfy one of the requirements to qualify for the innocent landowner, bona fide prospective purchaser or contiguous property owner defense to the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA), and as amended by the Small Business Liability Relief and Brownfields Redevelopment Act: that is, the practices that constitute "all appropriate inquiries into the previous ownership and uses of the property consistent with good commercial or customary practice" as defined in 40 CFR 312. The PESA was conducted in substantial compliance with ASTM Standard Practice E 1527-13 — Standard Practice for Environmental Site Assessments: Phase I Environmental Site Assessment Process and 40 CFR Part 312, Innocent Landowners, Standards for conducting All Appropriate Inquiries. 2.2 Scope of Services This PESA was completed by gathering required information that was publicly available within reasonable time and cost constraints and which could be practically reviewed. This report will be considered valid until a period of one year following the date of our site reconnaissance. Our scope of services included the following: Records Review — Obtaining and reviewing publicly available records (of both current and historical significance) in order to help identify "recognized environmental conditions" in connection with the subject site. Those specific records reviewed, including those records which were sought and were not readily available or reasonably ascertainable, are identified in the report. Site and Surrounding Properties Reconnaissance — Conducting a site and surrounding property reconnaissance, the objective of which was to obtain information indicating the likelihood of the existence of "recognized environmental conditions" in connection with the subject site, as defined in ASTM E-1527-13 and Section 2.3. Interviews — Conducting interviews with persons associated with the subject site and with appropriate local government officials in order to identify "recognized environmental conditions" in connection with the subject site. The specific parties interviewed and the nature and scope of the interviews are described in the report. Mid -Atlantic Associates, Inc. 2 PESA Report — 413 North Harrington Street Project Number: OOOR2644.00 Raleigh, North Carolina 800.486.7568 — www.MAAonline.com • Report — Summarizing the results of our investigation into this report and provide a professional opinion regarding the potential for environmental impact at the site and a list of Recognized Environmental Conditions (RECs). 2.3 Significant Assumptions and Definitions Mid -Atlantic assumes that information provided by the User of the PESA report and those interviewed in conjunction with the PESA is true and accurate to the best of their knowledge. No other significant assumptions were used during the performance of this PESA. The ASTM Standard Practice E1527-13 provides several definitions that are applicable to the performance of this PESA: Data Gap — The absence or inability to obtain information required by the standard despite good faith efforts by the environmental professional (EP) to gather such information. Data gaps may result from incompleteness in any of the activities required by the standard, including, but not limited to site reconnaissance (e.g. an inability to conduct the site visit), interviews (e.g. an inability to interview the property owner, regulatory officials, etc.). REC (recognized environmental condition) - "The presence or likely presence of any hazardous substances or petroleum products in, on or at a property: 1) due to release to the environment, 2) under conditions indicative of a release to the environment; or 3) under conditions that pose a material threat of a future release to the environment." For the purposes of [the standard], "migrate' and "migration" refer to the movement of hazardous substances or petroleum products in any form including solid and liquid at the surface or subsurface and vapor in the subsurface". Note: a vapor encroachment condition (VEC) in the subsurface is described in ASTM Guide E2600-10 Standard Guide for Vapor Encroachment Screening on Property Involved in Real Estate Transactions. Per the authorized contract, Mid -Atlantic was not requested to conduct a Vapor Encroachment Screen in accordance with the E2600-10 guide. CREC (controlled recognized environmental condition) — A recognized environmental condition (REC) resulting from a past release of hazardous substances or petroleum products that has been addressed to the satisfaction of the applicable regulatory authority (e.g. as evidenced by the issuance of a no further action letter (NFA) or equivalent, or meeting risk -based criteria established by regulatory authority), with hazardous substances or petroleum products allowed to remain in place subject to the implementation of required controls (for example property use restrictions, activity and use limitations, institutional controls, or engineering controls). A condition identified as a CREC does not imply that the EP has evaluated or confirmed the adequacy, implementation or continued effectiveness of the required control that has been, or is intended to be, implemented. If CREC(s) are identified during the PESA, they will be listed in the Findings section of the report and as a REC in the Conclusions Section. HREC (historic recognized environmental condition) — A past release of any hazardous substances or petroleum products that has occurred in connection with the property and has been addressed to the satisfaction of the applicable regulatory authority or meeting unrestricted residential use criteria established by a regulatory authority, without subjecting the property to any required controls (e.g. property use restrictions, activity and use limitations, institutional controls, or engineering controls). Before calling the past release a HREC, the EP must determine whether the past release is a REC at the time Mid -Atlantic Associates, Inc. 3 PESA Report — 413 North Harrington Street Project Number: OOOR2644.O0 Raleigh, North Carolina 800.486.7568 — www.MAAonline.com the Phase I ESA is conducted (e.g. if there has been a change in the regulatory criteria). If the EP considers the past release to be a REC at the time the PESA is conducted, the condition shall be included in the conclusions section of the report as a REC. De minimis condition — A condition that generally does not represent a threat to human health or the environment and that generally would not be the subject of an enforcement action if brought to the attention of appropriate governmental agencies. De minimis conditions are not RECs nor CRECs. Business environmental risk — A risk which can have a material environmental or environmentally -driven impact on the business associated with the current or planned use of a parcel of commercial real estate, not necessarily limited to those environmental issues required to be investigated in this practice". Client imposed limitations and site condition limitations, if encountered, are detailed in Section 6.1, Methodology and Limiting Conditions. User - The party seeking to use Standard Practice E1527 [the standard] to complete an environmental site assessment of the property. A user may include, without limitation, a potential purchaser of property, a potential tenant of property, an owner of property, a lender, or a property manager. The user has specific obligations for completing a successful application of the standard including: 1) completion and return of the User Questionnaire, preferably prior to the EP visiting the site; 2) Review Title and Judicial Records for Environmental Liens and Activity and Use Limitations (AULs); 3) communicate to the EP prior to the site visit any specialized knowledge or experience pertinent to the identification of RECs in connection with the property and/or actual knowledge of any environmental liens or AULs encumbering the property; 4) communicate to the EP if a significantly lower purchase price (with regard to fair market value) is being offered on the property due to perceived or known environmental contamination (the purchase price need not be disclosed); 5) inform the EP prior to the site visit about commonly known or reasonably ascertainable information within the local community about the property that could pertain to the identification of RECs, and, 6) the user must consider the degree of obviousness of the presence or likely presence of releases or threatened releases at the property and the ability to detect releases or threatened releases by appropriate investigation. In regard to environmental liens and AULs (number "2" above), the standard does not impose on the EP the responsibility to undertake a review of recorded land title records and judicial records for environmental liens and AULs. It is the user's responsibility to either (1) engage a title company, real estate attorney, or title professional to undertake a review of reasonably ascertainable recorded land title records and lien records for environmental liens and AULs currently recorded against or relating to the property, or (2) negotiate such an engagement of a title company, real estate attorney, or title professional as an addition to the scope of work of the EP. 2.4 Limitations and Exceptions As contracted, the scope of work of this PESA did not include a detailed review of agency files on specific, environmentally -related incidents (unless mentioned in the report) which may have occurred near the subject site. It also did not include other issues that may be addressed, depending on site -specific circumstances, during commercial real estate transactions. These include, but are not limited to, asbestos, lead -based paint, radon, lead in drinking water, wetlands, Mid -Atlantic Associates, Inc. 4 PESA Report — 413 North Harrington Street Project Number: OOOR2644.00 Raleigh, North Carolina 800.486.7568 — www.MAAonline.com cultural or natural resources, industrial hygiene, health and safety, ecological resources, endangered species, indoor air quality, biological agents, mold, radiological compounds, etc. Our professional services have been performed using the degree of care and skill ordinarily exercised, under similar conditions, by reputable environmental consultants practicing in this or similar localities. No other warranty, expressed or implied, is made as to the professional information included in this report. Although this study has been a reasonably -thorough attempt to identify conditions that are indicative of releases and threatened releases of hazardous substances, as well as pollutants, contaminants, petroleum and petroleum products and controlled substances on and/or off -site, there is always the possibility that potential sources of contamination have escaped detection due to the limitations of this study, the availability of historical records, the inaccuracy of governmental records and/or the presence of undetected and unreported environmental accidents. It should be noted that no environmental site assessment can completely eliminate uncertainty regarding the potential for recognized environmental conditions in connection with a site. Mid -Atlantic reserves the right to alter our findings based on our review of any information obtained and reviewed after the date of this report. Observations, conclusions and/or recommendations pertaining to environmental conditions at the subject site are necessarily limited to conditions observed, and or materials reviewed at the time this study was undertaken. It was not the purpose of this study to determine the actual presence, degree or extent of contamination, if any, at this site. This could require additional exploratory work, including sampling and laboratory analysis. In addition, the findings of this PESA are not intended to serve as an audit for health and safety compliance issues pertaining to improvements or activities at the site. Mid -Atlantic is not liable for the discovery or elimination of hazards that may potentially cause damage, accidents or injury. No warranty, expressed or implied, is made with regard to the conclusions and/or recommendations presented within this report. 2.5 Special Terms and Conditions This PESA was conducted in accordance with the terms and conditions of Mid -Atlantic's contract with the client. It is the responsibility of the User (typically the client) to provide known site information, environmental lien and AULs, if there is a lower purchase price than the Fair Market Value due to known or perceived contamination, and the other information noted in Section 2.3 under the "User" sub -section. 2.6 User Reliance The User may rely on the contents of this PESA subject to the limitations placed on the scope, nature and type of Mid -Atlantic's services as stated in the PESA and subject to those Terms and Conditions as stated in Mid -Atlantic's contract with the client. The User and any additional parties specifically granted reliance, are the only parties to whom Mid -Atlantic grants the right to rely upon the PESA. No other third party may rely on the PESA unless the express written consent of Mid - Atlantic is first obtained. Any such reliance will be granted in accordance with the terms of the original contract between Mid -Atlantic Associates and the client. This report is assumed "valid" under the standard (ASTM E1527-13) if it was completed less than 180 days prior to the date of property acquisition or the date intended for a property transaction (if the property is not being acquired). If a party other than whom the report was prepared, wishes to use the report during the 180 day period, the new user(s) must satisfy the user responsibilities noted in Section 2.3 under the "User" sub -section. Mid -Atlantic Associates, Inc. 5 PESA Report — 413 North Harrington Street Project Number: OOOR2644.00 Raleigh, North Carolina 800.486.7568 — www.MAAonline.com The standard states that a PESA completed on a property within 12 months of property acquisition or the date intended for a property transaction (if the property is not being acquired), may be used provided that the following PESA components are completed or updated within 180 days of the acquisition date or date intended for a property transaction: (i) interviews with owners, operators and occupants; (ii) a search for recorded environmental cleanup liens; (iii) review of federal, tribal, state and local government records (i.e. an environmental database search); (iv) visual inspection of the property and adjacent properties; and, (v) the declaration by the EP responsible for the assessment or update. For using PESA reports greater than 12 months old prior to the intended acquisition or transaction date, the standard outlines procedures that users should follow in Section 4.7 and 4.8 of ASTM E1527-13. 3.0 Site Description 3.1 Site Location and Legal Description The subject site is located in downtown Raleigh, North Carolina, at 413 North Harrington Street, approximately 190 feet north of the intersection of North West Street with North Harrington Street. The subject site is developed with a 7,715 square foot building constructed in 1990 according to the Wake County Department of Revenue. Remaining parts of the property are developed with asphalt parking areas. The subject site is assigned Parcel ID Number 1704-51-2008 and is currently zoned IND-2 (Industrial-2) with DOD (Downtown Overlay District) according to the Wake County Planning Department. The City of Raleigh is currently rezoning approximately 30% of the City under the Unified Development Ordinance (UDO) which will include the subject site. The proposed zoning classification for the subject site is DX-12-SH ("downtown mixed use with heights up to 12 stories with shop front frontage"). Zoning information for the subject site, queried from http://maps.raleighnc.gov/remappinq/, is included in Appendix 15.4. 3.2 Site and Vicinity General Characteristics The majority of properties in the area are used for commercial and professional offices. Construction and development activity is widespread in this region of the city. 3.3 Current Use of the Property At the time of the site inspection, the present-day building was vacant and used by the property owner for storage of primarily furniture, appliances, kitchen fixtures, bathroom fixtures and sales literature. The site was formerly used as the Sales Office and Construction Office for the "West" condominium tower located on the southern adjacent property. Additional site improvements include parking lots, chain link fencing, sidewalks and landscaped areas. 3.4 Description of Structures, Roads, Utilities & Other Site Improvements The subject site is developed with the approximately 7,715 square -foot current building. According to historical documentation, the subject site building was constructed in 1990 and remodeled in 1995 and 2007. Vehicular access is provided to the subject site from the east by North Harrington Street. The subject site and its surrounding properties are provided with water and sewer services Mid -Atlantic Associates, Inc. 6 PESA Report — 413 North Harrington Street Project Number: OOOR2644.00 Raleigh, North Carolina 800.486.7568 — www.MAAonline.com by the City of Raleigh Utilities Department, electricity by Duke Energy Progress and natural gas by PSNC Energy. 3.5 Current Use of the Adjoining Properties The subject site is bounded to the north by paved parking lots and a one-story office building; to the south by the "West" condominium tower; to the east across North Harrington Street by the Wake County General Services complex; and to the west, across North West Street, by multiple commercial business entities located within a long one-story building. Addresses associated with the adjacent properties include North (506 North West Street (parking lot) and 437 North Harrington Street); East (401 Capital Boulevard); South (401 North Harrington Street) and West (401 North West Street). 4.0 User Provided Information Pursuant to ASTM E 1527-13, Mid -Atlantic requested the following site information from the User. The contact for this project was Mr. Gregg Sandreuter, Manager of Harrington Street Partners, LLC. Mr. Sandreuter provided Mid -Atlantic with the completed User Questionnaire for the subject site. A copy of the User Questionnaire is included in Appendix 15.6 and User -provided information is summarized in the following sections. 4.1 Title Records No title records were provided to Mid -Atlantic by the User. Refer to Section 5.4.5 for a discussion of deed research performed by Mid -Atlantic personnel. 4.2 Environmental Liens or Activity and Use Limitations The User does not have knowledge regarding environmental liens or activity and use limitations (AULs) for the subject site, as reported to Mid -Atlantic in the completed questionnaire. The standard (ASTM E1527-13) lists specific user responsibilities for the project, as listed in Section 2.3 of this report. 4.3 Specialized Knowledge The User indicated on the User Questionnaire that the User developed the "West" condominium tower next door and a second property on a northern adjacent property (office building at 437 North Harrington Street) is under contract. 4.4 Commonly Known or Reasonably Ascertainable Information The User provided Mid -Atlantic with two environmental -related reports, two geotechnical reports and an Alta/ACSM Survey for the subject site; and additional documentation for the "West" tower site on the southern adjacent property. The reports are further discussed in Section 5.2. Mid -Atlantic Associates, Inc. 7 PESA Report — 413 North Harrington Street Project Number: OOOR2644.O0 Raleigh, North Carolina 800.486.7568 — www.MAAonline.com 4.5 Valuation Reduction for Environmental Issues According to the User, the purchase price that would be paid for the subject site would reasonably reflect the fair market value. 4.6 Owner, Property Manager, and Occupant Information The Wake County Tax Office has the current owner of the subject site listed as "Harrington Street Ptnr [sic] LLC", with the owner contact listed as Ms. Susan Barden. The point -of -contact for the subject site was Mr. Gregg Sandreuter, Manager of Harrington Street Partners LLC, and is considered the owner representative and property manager. Refer to Section 5.4.5 for more detailed owner information. 4.7 Reason for Performing Phase I ESA Mid -Atlantic understands that the findings of this PESA will be used to evaluate the subject site with respect to a property transaction/refinance. The purpose of a PESA is to identify existing or potential RECs (as defined by ASTM Standard E-1527-13) in connection with the subject site. This PESA was also performed to permit a User to satisfy one of the requirements to qualify for the innocent landowner, contiguous property owner, or bonafide prospective purchaser limitations within the scope of Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA) (42 U.S.0 9601) liability. 5.0 Records Review 5.1 Environmental Regulatory Records Mid -Atlantic contracted EDR to conduct a regulatory database search in accordance with ASTM E 1527-13 standards. The purpose of the search is to identify certain properties and facilities in the vicinity of the subject site (including the subject site, as applicable) which are regulated by the U.S. Environmental Protection Agency (EPA), North Carolina Department of Environment and Natural Resources (DENR) and other state and local environmental regulatory agencies. Detailed information pertaining to each database researched is presented in the EDR report, a copy of which is attached as Appendix 15.5. The subject site was not identified in Mid -Atlantic's review of regulatory records. Mid -Atlantic identified the following potential off -site concerns associated with the adjacent and surrounding properties: • Wake County Center One / Wake County General Services (401 Capital Boulevard), located on the eastern adjacent property, across North Harrington Street, was identified in the Underground Storage Tank (UST), Leaking Underground Storage Tank (LUST), LUST TRUST and RCRA — Non -Generators (RCRA-NonGen) lists for two incidents. Mid -Atlantic Associates, Inc. 8 PESA Report — 413 North Harrington Street Project Number: OOOR2644.00 Raleigh, North Carolina 800.486.7568 — www.MAAonline.com o According to information provided in the LUST database, a release on October 12, 2009 at the site was reported to DENR on October 14, 2009 (Incident No. 33758) and soil and groundwater were impacted. The incident description only lists "Line work, FP". The incident phase for this release has not been reported in the LUST list; o According to information provided in the LUST database, a release on June 8, 2011 at the site was reported to DENR on September 2, 2011 (Incident No. 39069) and soil was impacted after three hydraulic lifts were removed. Cleanup from the release was completed on June 8, 2011. The incident has been assigned "low" risk and the incident phase for this release was not reported in the LUST list. The soil contamination type is listed as "Groundwater/Both"; o The Wake County General Services Center is enrolled in the North Carolina LUST Trust Fund for Incident No. 33758 under a $20,000 deductible; o The RCRA- Non Generators (RC RA- Non Gen) list indicates that the Wake County General Service Administration at 401 Capital Boulevard was formerly a Small Quantity Generator (SQG) of D001 and D002 hazardous wastes. The EDR listing shows no history of violations associated with the site; • Three petroleum LISTS are registered for the 401 Capital Boulevard site as follows: UST Capacity Product Construction Install Permanent No. Date Closure Date 1 10,000 Gasoline / Gas SW-FRP 1/01/1988 Currently In Use Gallons Mix 2 10,000 Gasoline / Gas SW-FRP 1/01/1988 Currently In Use Gallon Mix 3 6,000 Diesel SW-FRP 1/01/1988 Currently In Use Gallon Abbreviations: SW-FRP = Sinale Wall. Fiberalass Reinforced Plastic David Allen Company, Inc. (309 North Harrington Street'), located approximately 260 feet south of the subject site, across West North Street, was identified in the UST, LUST and IMD lists. According to information provided on these lists, a release occurred on March 9, 1992 and was reported to DENR on March 25, 1993 (Incident No. 9987) after soil and groundwater contamination was discovered following in -place closure of two 4,000 gallon petroleum LISTS. The release was closed out on October 20, 2004 after a LUR was filed; and, ' Now assigned a street address of 310 North Harrington Street by Wake County (owner — Marble Empire Properties, LLC) Mid -Atlantic Associates, Inc. 9 PESA Report — 413 North Harrington Street Project Number: OOOR2644.00 Raleigh, North Carolina 800.486.7568 — www.MAAonline.com • Pine State Creamery (405 North West Street), located on the western adjacent property across North West Street, was identified in the LUST and IMD lists. According to information provided on these lists, a release was reported at the site November 23, 1992 (Incident No. 14784) and soil was impacted. The release is in the "Response" phase in the IMD and LUST lists; The above -referenced sites and/or releases may have resulted in adverse environmental impacts to groundwater quality beneath the subject site. The documented release at 309 North Harrington Street (David Allen Company, Inc.) is considered a controlled REC (CREC) based on its "closed out" "status. The registered USTs and LUSTS at the Wake County Center One / Wake County General Services facility (401 Capital Boulevard) on the eastern adjacent property are considered potential RECs based on the topographically upgradient location of the current UST refueling area with respect to the subject site. The incident at 405 North West Street (Pine State Creamery) is also considered a potential REC due to its proximity. Several additional off -site properties within one-half mile of the subject site are listed in the EDR report but are not anticipated to present an environmental threat to the subject site based on such factors as distance from the subject site, field verified location, current regulatory status and estimated groundwater flow direction. In addition, the sites listed in the EDR report's Orphan Summary were not identified within one mile of the subject site and/or are not anticipated to pose an environmental threat to the subject site. Due to the proximity of the 309 North Harrington Street, 401 Capital Boulevard and 405 North West Street listings, Mid -Atlantic reviewed regulatory files associated with these incidents (Section 5.2.2). 5.2 Additional Environmental Record Sources 5.2.1 Resorts arovided by User During this PESA, the User provided Mid -Atlantic with additional documents for the subject site and the southern adjacent property now occupied by the West condominium tower. The documents included a prior (2004) PESA, two geotechnical reports and two environmental -related reports that document Phase II soil and groundwater sampling and soil excavation work during construction of the West tower. The reports are discussed below in chronological order. Report 1: • ECS, 2004, Report of Subsurface Exploration and Geotechnical Engineering Analysis for the State Employee Association of North Carolina property located at 413 North Harrington Street in Raleigh, North Carolina, Engineering Consulting Services, Limited, Raleigh, North Carolina, June 29, 2004. (Note: this report by ECS pertained to a project site that encompassed the current subject site and the southern adjacent property). In June 2004, ECS drilled approximately nine borings on the site. The three borings drilled on the current subject site (B-6, B-7 and B-8) were drilled to depths ranging from 18 to 19.5 feet below land surface (bls) and evidence of petroleum -contaminated soils were not encountered. However, ECS encountered strong petroleum -like odors in soil samples collected from two boring locations on the current southern adjacent property, including B-1 (at depths of 8.5 to 15 feet bls) and B-4 (depths of 9 to 16.5 feet bls). The two borings were terminated at depths of 16 and 17.5 feet bls when the drillers noted moist soils suggesting that the groundwater table would soon be encountered. ECS stated that due to the observed contamination, the drillers did not want to breach the water table. The location of the borings drilled on the current southern adjacent Mid -Atlantic Associates, Inc. 10 PESA Report — 413 North Harrington Street Project Number: OOOR2644.00 Raleigh, North Carolina 800.486.7568 — www.MAAonline.com property where petroleum contamination was discovered is shown on Drawing 15.2 in Appendix 15.2. Report 2: • SITECH, 2004, Phase I Environmental Site Assessment Report, Real Property Located at 413 North Harrington Street - State Employee Association of North Carolina, Inc., Raleigh, North Carolina, SITECH Consulting Services, P.C., Raleigh, North Carolina, July 8, 2004. (Note: this report by SITECH pertained to a project site that encompassed the current subject site and the southern adjacent property). In 2004, SITECH Consulting Inc. (SITECH) noted that the building at the current subject site was occupied by State Employee Association of North Carolina, Inc. (SEANC), and that SEANC had occupied the building since 1990, shortly after its construction. A previous building was present on the current subject site to the north of the existing building and was demolished on an unknown date between 1974 and 1990; SITECH noted that its use was unknown. According to the 2004 PESA, the SEANC had occupied the current subject site for approximately 35 years2. Prior to their occupancy, the current subject site was used for residential and limited commercial use back to the early 1900s. A parking lot with pedestrian shelter was located on the current southern adjacent property in 2004. SITECH noted in their report the geotechnical borings that were completed by ECS in 2004 where petroleum contaminated soils were discovered. The report also noted nearby facilities that were listed on regulatory databases; text regarding the review of the regulatory file for the David Allen LUST incident at 309 North Harrington Street; and the outcome of an interview with officials at the UST Section, DENR regarding a monitoring well observed on or near the current south adjacent property and the status of the David Allen LUST Incident. Their conclusions from the report are as follows: Based on information provided by personnel of the DENR Underground Storage Tank Section, it appears that the monitoring well observed by SITECH on the current southern adjacent property boundary formerly contained free -phase petroleum product, associated with a release from USTs located on the David Allen Company. It is our understanding, that during the geotechnical investigation for this property, petroleum odor was encountered in at least two borings on the current southern adjacent property, in the vicinity of this well. A review of the State files for the David Allen Company indicates that groundwater flow is north towards the site and groundwater contamination is suspected beneath the site. According to DENR personnel, the State had already assigned responsibility to the David Allen Company [July 2004] and a Notice of Regulatory Requirements was issued in April 2003 for a Comprehensive Site Assessment, which would have been due in November 2003. Based on SITECH's historical research, it appears that the David Allen Company property was also formerly used by the Standard Oil Company of New Jersey, a bulk petroleum storage facility, from the turn of the century until the mid-1950s. Several large vertical and horizontal petroleum bulk storage tanks were formerly located on this property. Historical Sanborn Fire Insurance Maps of the property from 1914 show a "store" in the southwest corner with a canopy extending onto West North Street. A Sanborn map of the site from 1950 also shows this store. Additionally another "store" is shown in the south central portion of the site. The north central portion z Including within a previous building located at the site. Mid -Atlantic Associates, Inc. 11 PESA Report — 413 North Harrington Street Project Number: OOOR2644.00 Raleigh, North Carolina 800.486.7568 — www.MAAonline.com of the site is shown to contain a "wood shed" and being utilized by a "wood yard". SITECH could not determine if wood treatment occurred on the site, or simply that the site was used for the storage of wood. SITECH did not observe any features on the Sanborn Map that indicate treatment occurred on the site and it appears possible the yard may have been associated with one of the stores. The use of the canopy by one of the stores cannot be determined Based upon the results of their PESA, SITECH recommended: • Performing a Ground Penetrating Radar and Magnetometer (GPR/Mag) survey of the site to identify any USTs associated with the residences or the stores (including the store with a canopy) formerly shown on the site. The results of the GPR/Mag survey could identify additional anomalies which may also require assessment. • Performing a limited soil and groundwater assessment on the southern site boundary [current southern adjacent property] to determine contaminant concentrations and depths of contaminants. This would establish if the suspected soil contamination is likely due to capillary action of contaminants from the groundwater or another source and also establish if contaminant concentrations increase toward the site. Given the longevity of the possible release it appears likely that the core of the plume may have moved onto the site. • Installation of two piezometers in the location of the former "wood shed" and "wood yard" [shown in Sanborn Maps on the current southern adjacent property]. While the Sanborn Maps do not show physical features typically associated with wood treating, if treated wood was stored on the site, leaching of chemicals into the soils and possibly groundwater on the site could potentially impact the property. The piezometers could also be sampled for suspected petroleum contaminants from the David Allen Company/ Standard Oil Company. Report 3: • SITECH, 2004b, Limited Phase 11 Soil and Groundwater Assessment, Electromagnetic Survey and Ground Penetrating RadarAssessment, Real Property Located at 413 North Harrington Street - State Employee Association of North Carolina, Inc., Raleigh, North Carolina, SITECH Consulting Services, P.C., Raleigh, North Carolina, August 31, 2004. (Note: this report by SITECH pertained to a project site that encompassed the current subject site and the southern adjacent property). SITECH completed Phase II assessment work during August 2004 in follow-up to their recommendations in the July 2004 PESA. The purpose of this Phase II work was to identify buried USTs or metallic containers on the site (which included the current subject site and current southern adjacent property), install piezometers near the southern site boundary to establish possible soil and groundwater contamination and perform soil sampling near the former wood shed and wood yard shown on the Sanborn maps. SITECH installed three soil borings on the south portion of the site: boring S-1 was installed downgradient of the existing monitoring well; boring S-2 was installed down -gradient and cross -gradient of the existing monitoring well; and, boring S-3 was installed near the former wood shed and wood yard (Drawing 15.2-1 in Appendix 15.2). Groundwater and bedrock were encountered at a depth of approximately 17 feet bls. Soil samples were collected from S-1, S-2 and S-3 from depths of 8 to 11 feet bls at S-1 and S-2; and 4 to 8 feet bls at S-3. Groundwater samples were collected from the three locations after piezometers were installed. Petroleum -related soil and groundwater contaminants were exhibited Mid -Atlantic Associates, Inc. 12 PESA Report — 413 North Harrington Street Project Number: OOOR2644.00 Raleigh, North Carolina 800.486.7568 — www.MAAonline.com in soil and groundwater samples collected from S-1; however, petroleum soil contaminants were detected at concentrations below State action levels and groundwater contamination was detected from two petroleum hydrocarbon fraction classes, and not individual constituents. The soil sample from boring S-3 exhibited mercury at a concentration [0.03 mg/Kg] above a State screening level in effect at the time [0.0154 mg/Kg]3. Chromium was detected in the S-3 soil sample at a concentration of 7.1 mg/Kg, below the soil action levels in effect in 2004 but currently above the action levels for hexavalent chromium'. Petroleum constituents in groundwater within the C5 to C8 aliphatic and C9 to C22 aromatic hydrocarbon fraction classes exceeded the North Carolina groundwater quality standards (NCGQS) in 2004 and are above the NCGQS in effect today. Regarding the detected contamination, SITECH concluded in 2004: "Given no likely sources were identified on the subject property, the proximity of the existing monitoring well on the David Allen Company property and the fact that this well formerly contained free phase petroleum, the contaminants encountered in groundwater in this portion of the property are likely attributable to the David Allen Company site. Petroleum soil contamination is present also, although at levels less than the State Action Levels'. This would appear likely due to the capillary action of contaminated groundwater in the vadose zone and fluctuations of the groundwater" (SITECH, 2004b). Based on the results of the electromagnetic/GPR survey, SITECH concluded: "We find no indication at the present time of Underground Storage Tanks or other buried metallic objects, with the exception of the metallic debris field north of the SEANC building. While this does not appear associated with a UST, the content of the area has not been ascertained and should be considered a potential issue for site development purposes. We recommend obtaining further soil samples to support background concentration of mercury. If this cannot be done, additional assessment may be warranted" (SITECH, 2004b). Report 4: ECS, 2011, Geotechnical Engineering Services, Proposed West2 [sic] Apartments, 401 North Harrington Stree4 Raleigh, North Carolina, Engineering Consulting Services, Limited, Raleigh, North Carolina, November 9, 2011. The 2011 report was an addendum to a previous ECS report submitted to Hamilton Merritt, Inc. and dated October 20, 2006 (not supplied to Mid -Atlantic by the User). The addendum included geotechnical borings and foundation recommendations for the proposed West2 Apartments planned for construction on the subject property north of the existing West condominium tower and parking garage. Data from 10 borings drilled between 2004 (Report 1) and 2006 were evaluated. As noted above, three of the borings (B-6, B-7 and B-8) are located on the subject site and petroleum -like odors were not reported by ECS. The 2011 report included a log from 2006 for boring B-124, where petroleum -contaminated soils were identified from approximately 12.5 to 13.7 feet bls. Boring B-124 is located approximately 15 feet from the southern property boundary of the subject site. Drawing 15.2 shows the locations for B-124 and the three geotechnical borings previously drilled on the subject site. 3 The current soil action levels for elemental mercury in soils is 1 mg/Kg for unrestricted use. ' The Division of Waste Management currently has different action levels for hexavalent and trivalent forms of chromium in soils. Hexavalent is less common and associated with manufacturing: it has low action levels in comparison with the more prevalent form of trivalent chromium. The trivalent action levels are above the 7.1 mg/Kg level of chromium detected at the subject site. 5 The petroleum soil contaminant concentrations in the SITECH report were compared to current action levels and the contaminants are still below established soil action levels. Mid -Atlantic Associates, Inc. 13 PESA Report — 413 North Harrington Street Project Number: OOOR2644.00 Raleigh, North Carolina 800.486.7568 — www.MAAonline.com Report 5: • SITECH, 2005, Review of Letter of No FurtherAction [N FA] 15A NCAC 2L.01 15 (h), David Allen Company, 309 N. Harrington Street Raleigh, NC Incident Number 9987, Low Risk, SITECH Consulting Services, P.C., Raleigh, North Carolina, August 2, 2005 SITECH prepared a findings letter documenting their review of an NFA letter prepared for the David Allen Company site by DENR that was dated October 20, 2004. In their previous PESA in July 2004 (Report 1), SITECH identified the Allen site as a potential off -site source of groundwater contamination. Follow-up work was completed by SITECH in August 2014 by collecting soil and groundwater samples from locations on the West tower property (current southern adjacent site) that were deemed hydraulically downgradient of the Allen site. SITECH identified limited groundwater contamination, reportedly associated with a groundwater plume from the Allen site (no potential sources were identified on the current southern adjacent property). SITECH stated that no soil contamination was detected in the soils in 2004 from the areas sampled above regulatory levels. According to SITECH, and verified by Mid -Atlantic during our file review (Section 5.2.2), DENR determined that the site met the requirements of a low -risk site but exceeded the NC groundwater quality standards and residential soil cleanup levels. The DENR granted No Further Action for the David Allen Company LUST incident, contingent that a Notice of Residual Petroleum Contamination (NORP) is attached to the Deed for the 309 North Harrington Street property. The filed NORP restricts groundwater as a water supply in the area of contamination and in areas where soil exceeds the residential MSCC's. It also restricts the property for residential use, schools, nursing homes, parks, recreational and day care centers. SITECH concluded in their Review of Letter of No Further Action that: "At the time of the August Limited Phase II assessment SITECH conferred with Mr. Bob Davies and Mr. Walt Plekan of the NCDENR UST Section whom agreed that there was no physical indication based on the data obtained from the State Employees property that would restrict planned mixed use (commercial and residential) development of the State Employees property and that based on this data no further investigations or studies would be required by their office on the SEANC site. The low risk and ultimate No Further Action letter to the David Allen Co. in October of 2004 further affirms this opinion" (SITECH, 2005). Report 6: • S (TECH, 2007, Summary of Soil Removal and Disposal at the West at North Site, Raleigh, NC, SITECH Consulting Services, P.C., Raleigh, North Carolina, August 31, 2004 This 2007 letter report from SITECH documents soil removal and disposal work from the West at North construction site (West tower) on March 2Id and March 5t", 2007. SITECH reported that the West tower construction project superintendent contacted them on Friday, March 2, 2007 and stated that workers had encountered soil with a petroleum odor while installing a footing in the northwest portion of the construction site. Soils from a depth of at 18 feet bls emitted a "mild diesel fuel" odor. SITECH mobilized to the site to inspect the area of concern and screen the excavated soils. The soils did not register any contaminants using an OVA but the soils were noted with a "mild fuel oil olfactory odor." SITECH measured the excavation at 18.5 feet bls and on top of the saprolite/bedrock and at the groundwater interface. In order to prevent construction delays, the contractor desired that the impacted soils be removed immediately and considered "petroleum contaminated" non -hazardous waste for disposal purposes. A total of 164.15 tons of soil were removed and disposed by Soil Solutions, Inc. at a permitted soil treatment facility (Soil Works) in Selma, North Carolina. Mid -Atlantic Associates, Inc. 14 PESA Report — 413 North Harrington Street Project Number: OOOR2644.00 Raleigh, North Carolina 800.486.7568 — www.MAAonline.com SITECH obtained one soil sample from the stockpiled material prior to disposal and submitted the sample for analysis of total petroleum hydrocarbons (TPH) using EPA methods 5030 and 3550 analyses. In the report, SITECH noted that previous samples obtained in 2004 from soils with a significant odor on the southern and central portions of the site and closer to the suspected source (the off -site David Allen Company LUST incident) had not detected contaminants above residential state action levels. The results from analysis of the stockpile sample exhibited 30 mg/Kg for diesel compounds and no detectable concentration of gasoline -related compounds. After the affected soils were removed, SITECH noted that soils remaining on the site had no residual odor. SITECH noted that based on the laboratory results from the stockpile sampling, they did not recommend further assessment. SITECH also indicated that a copy of the report was forwarded to Mr. Bob Davies, Regional Supervisor of the UST Section's Raleigh Regional Office. 5.2.2 Information from File Reviews Former David Allen Company (Incident No. 9987), 309 North West Street [current address of 310 North Harrington Street per Wake County GIST Pertinent information from the file with respect to the subject site is noted in Section 5.2.1. The most recent documents in the file were from 2004 and 2005 and included a petition from the property owner to DENR requesting the site be given an NFA determination (October 7, 2004) and a summary letter from DENR to SITECH Consulting in response to a question about the site status (October 13, 2005). The October 2005 letter indicates that DENR attributed past groundwater contamination found in MW-5, near the southern boundary of the current southern adjacent property with the North West Street right of way, to the release at the David Allen Company site. A copy of the NORP filed with the Wake County Register of Deeds (ROD) was not in the file, and is not readily available via an online search of real estate records at the ROD office. Wake County General Services Administration (Incidents No. 33758 and 39069), 401 Capital Blvd. The Wake County General Services Administration complex is located topographically cross - gradient to upgradient with respect to the subject site. Incident No. 39069 is associated with underground leaks from hydraulic lifts in a vehicle servicing garage located topographically down - gradient of the subject site. Therefore the LUST associated with the leaking lifts is not anticipated to impact the subject site. The second incident, No. 33758, is associated with soil and groundwater contamination associated with a leak(s) from product lines associated with Wake County's refueling area located cross -gradient to upgradient of the site. The leak was discovered in October 2009 when petroleum -stained pea gravel and petroleum odors were noted near a pump on top of the diesel fuel UST while equipment upgrades were being conducted. Petroleum - contaminated pea gravel was removed from the excavation and later, free product appearing to be mostly gasoline was discovered in the gravel backfill after a heavy precipitation event. Free product was recovered from the backfill several times between October and December 2009. All petroleum -impacted soil and gravel backfill could not be removed according to the "Introduction" section of the Phase 1 Limited Site Assessment report (LSA) completed by Mid -Atlantic (report dated April 29, 2010). One monitoring well was installed by Mid -Atlantic near the UST pit on January 25 to 27, 2010 and groundwater contamination was discovered. Specifically, benzene, methyl-tert-butyl-ether (MTBE), naphthalene and petroleum hydrocarbons in the C5-C8 aliphatics and C9-C22 aromatic hydrocarbon fraction classes were greater than the North Carolina groundwater quality standards (NCGQS). Portions of the LSA report are included in Appendix 15.9. After the LSA was reviewed, the UST Section classified the site as "low risk" and issued a Notice of Regulatory Requirements (NORR) to Wake County, dated May 4, 2010. Within the Mid -Atlantic Associates, Inc. 15 PESA Report — 413 North Harrington Street Project Number: OOOR2644.00 Raleigh, North Carolina 800.486.7568 — www.MAAonline.com NORR, the UST Section requested that Wake County prepare a NORP for the site and file it with the Wake County ROD Office (Appendix 15.9). The regulatory file did not contain further information or a completed NORP. This leaking UST incident is considered in the "response" phase according to the regulatory file and as reported in the EDR report (Section 5.1). Based upon our review, only one monitoring well was installed in association with the release, therefore a groundwater flow direction could not be determined. The monitoring well discovered with contamination (MW-1) is located approximately 130 feet from the southeast property corner of the subject site. Topography from MW-1 apparently decreases in elevation to the north and northeast, however topography is also lower at the subject site and the closest perennial stream (Pigeon Branch) is located approximately 1,000 feet to the north of the subject site (Appendix 15.1). Therefore groundwater, and petroleum contaminants, may potentially flow/migrate across the eastern portion of the site closest to North Harrington Street. Former Pine State Creamery (incident No 14784), 405 North West Street Based on our review of the regulatory file, petroleum USTs formerly operated on the Pine State Creamery property on the western adjacent property were located topographically downgradient of the subject site and are not of environmental concern. The file review revealed that the buildings on the western adjacent property were used to repair Pine State Creamery vehicles. 5.3 Physical Setting Sources The geologic and hydrogeologic settings of a site are considered of interest since they may provide information related to the direction and physical mechanisms of contaminant migration, if present, from on -site and off -site sources. 5.3.1 Geologic Setting According to the map titled Geology of North Carolina (1985), prepared by the North Carolina Geological Survey Section of the North Carolina Department of Natural Resources and Community Development, the subject site is located in the Metamorphic Rocks of the Raleigh Belt. The subject site appears to be underlain primarily by "biotite gneiss and schist intruded by numerous sills and dikes of granite, pegmatite, and aplite." 5.3.2 Topography and Surface Drainage According to the USGS Topographic Quadrangle Map of Raleigh West, North Carolina (Appendix 15.1), maximum site elevations occur in the southeastern corner of the subject site, while the minimum elevations occur on the northwest corner of the subject site. Based on topographic elevation contour data provided by Wake County GIS, the topographic elevation ranges from 286 feet above mean sea level (msl) in the northwest corner to 302 feet msl in the southeast corner. Stormwater drains were noted on the north and northeast sections of the property. Rain water is expected to drain by sheet flow from the parking areas on the subject site to the west and northwest towards North West Street and east towards North Harrington Street. 5.3.3 Groundwater Groundwater levels and flow directions are typically site specific. Site -specific groundwater flow can be influenced by impermeable surfaces, the proximity of nearby drainage features, sinkholes, creeks, swamps, and pumped groundwater wells. Fractures, joints, bedding planes and other discontinuities in the underlying rock can affect the groundwater conditions. Based upon the Mid -Atlantic Associates, Inc. 16 PESA Report — 413 North Harrington Street Project Number: OOOR2644.00 Raleigh, North Carolina 800.486.7568 — www.MAAonline.com pattern of topographic contour lines shown on the topographic map (Drawing 15.1), groundwater flow below the subject site should flow to the north or northwest in the direction of decreasing topography. 5.4 Historical Use Information on the Subject Site Mid -Atlantic reviewed historical aerial photographs, Sanborn' Maps, topographic maps, city directories, and tax/deed records to evaluate past uses of the subject site. Historical aerial photographs were obtained from EDR and the Wake County Geographic Information Services (GIS) department. The topographic maps and city directory information reviewed during this PESA was obtained during a prior assessment in January 2013 on the north adjacent property (437 & 441 North Harrington Street). This former assessment was also completed for Mr. Gregg Sandreuter. Copies of documents corresponding to the historical sources are attached as Appendix 15.4. 5.4.1 Aerial Photographs The historical aerial photographs from 1938 and 1959 show between two and five small buildings, or parts of small buildings, on the subject site. In 1965 the subject site is shown as cleared land that appears to be prepared for construction. The 1971, 1981, 1983 and 1988 aerial photographs show two buildings and parking lots on the subject site. The 1993 and more recent aerial photographs show a new building at the subject site in a similar location to the current building. Alternatively, the original building may have been enlarged on the north side. The 2002 and later photographs show this building with a new roof. In the 2007 and 2008 aerial photographs, the west side of the site is shown with construction trailers related to erection of the "West" residential condominium tower on the south adjacent property. In the 2009 aerial photograph the construction is shown as completed with no vehicles or materials staged on the subject site. Aerial photographs from 2010, 2011, 2012 and 2013 show little change. The subject site in the 2013 photograph is within a deep shadow from the adjacent "West" tower. Environmentally significant features were not identified at the subject site during Mid -Atlantic's review of aerial photographs. 5.4.2 Topographic Maps Historical topographic maps of the subject site area of various scales were provided by EDR. Maps with scales of 1:24000 (equivalent to one inch equals 2,000 feet) show the most detail and are discussed in this section (the subject site is outlined on the topographic maps in Appendix 15.4). The Raleigh West, North Carolina topographic maps from 1968, 1973, 1981, 1987, 1988, 1993 and 2002 show the subject site as "urban land" with no discernable features. Environmentally suspect features were not identified on the subject site during Mid -Atlantic's review of historical topographic maps. 5.4.3 Sanborn® Maps Mid -Atlantic's review of historical Sanborn' maps revealed the following information concerning the subject site: • 1914 — Dwellings (2) on the western one-third of the site. Portions of three dwellings and one garage in the eastern one-third of the site. 0 1950 — Dwellings (3), including one duplex building on the western one-third of the site. Portions of three dwellings and one garage in the eastern one-third of the site. Building on the north part of the property, at #419 North Harrington Street, labelled "OFF" for offices along with illegible writing. The building at No. 419 was built in 1966. Environmentally suspect features were not identified during Mid -Atlantic's review of historical Sanborn maps. Refer to Sections 5.4.1, 5.4.2 and 5.4.4 for additional historical document information associated with the subject site. 5.4.4 City Directories City directories were reviewed by EDR. Our review of the EDR data revealed the following information concerning the subject site. Current and historical buildings on the subject site were previously assigned different addresses as noted below: 413 North Harrington Street 1921 to 1957 — Apparent Residential Land Use (refer to Appendix 15.4 for individuals listed) After 1972 (Commercial Land use, except possibly 2003) • 1972 —Abrams Rent All • 1977 —American Defender Life Insurance Company • 1982 — American Defender Life Insurance Company Printing Shop • 1988, 1992, 1997 — State Employees Association of North Carolina • 2003 — Gunnelis, Durward F. • 2012 — West Developers, LLC 415 North Harrington Street (1922 to 1957) — Apparent Residential Land Use 417 North Harrington Street (1922 to 1957) — Apparent Residential Land Use 419 North Harrington Street (1972 to 1997) • 1972 — Vacant • 1977, 198Z 1988 — State Employees Association • 1992 — Gunnelis, Durwood F. • 1997 — Not Verged At least three residences were located on the subject site prior to 1957 at No. 413, No. 415 and No. 417 North Harrington Street. The Sanborn Maps from 1914 and 1950 depict these residences. A building was listed at No. 419 North Harrington Street in the 1972 to 1997 city directories (the Sanborn map from 1972 shows a building constructed in 1966). Commercial listings are present for No. 413 North Harrington Street after 1972 except for 2003 when an individual is listed. The Sanborn Map from 1972 indicates the original No. 413 building was constructed in 1967 and historical aerial photographs from 1971 to 1988 show a prior building located in the southern portion of the subject site. Mid -Atlantic Associates, Inc. 18 PESA Report — 413 North Harrington Street Project Number: OOOR2644.00 Raleigh, North Carolina 800.486.7568 — www.MAAonline.com The prior uses of the subject site as a printing facility in 1982 and a rental equipment facility in 1977 are considered environmentally suspect based on the nature of these operations and the potential impacts associated with the improper storage, handling and disposal of inks, solvents and/or petroleum products which might have been used at the facility. 5.4.5 Tax and Deed Information Property record information obtained from the Wake County Tax Administrator's Office identifies the current owner of Parcel ID Number 1704-51-2008 as follows: Harrington Street Ptnr LLC 4208 Six Forks Road, Suite 1400 Raleigh, North Carolina 27609-5764 Mid -Atlantic reviewed deed information for Parcel ID Number 1704-51-2008 obtained from the Wake County Register of Deeds. The deed associated with the transfer of the Raleigh Redevelopment Commission to Larry E. Ball had several restrictive covenants prohibiting certain kinds of land use including manufacturing of chemicals, fertilizers, oil refining; junkyards and dwellings. The 1965 deed date corresponds with the extensive cleared land shown on the 1965 aerial photograph for the subject site and adjacent properties. A copy of the current property deed is included in Appendix 15.4. 5.4.6 Data Failure Data failure occurs when reasonably ascertainable, standard historical sources have been reviewed and the objectives (use of the subject site back to its first developed use or 1940, whichever is earlier) have not been met. Mid -Atlantic traced the subject site's land use back to 1914 based on review of historical Sanborn° fire insurance maps. In 1914, dwellings were located on the subject site indicating development; therefore, this constitutes data failure. City directory listings were also not available for the northern adjacent parcel and other parcels at five year increments. In our opinion, this data failure does not constitute a data gap as it did not impact our ability to identify RECs at the subject site. Mid -Atlantic Associates, Inc. 19 PESA Report — 413 North Harrington Street Project Number: OOOR2644.00 Raleigh, North Carolina 800.486.7568 — www.MAAonline.com 5.5 Historical Use Information on Adioinina Properties Mid -Atlantic reviewed historical aerial photographs, Sanborn Maps, topographic maps, and city directories to evaluate past uses of adjoining properties. Copies of documents corresponding to the historical sources are attached as Appendix 15.4. 5.5.1 Aerial Photographs The historical aerial photographs from 1938 and 1959 show the subject site bounded to the north, east, south and west by small buildings resembling residential structures. At the intersection of West North Street and North West Street, a larger building is present suggesting commercial use. In the 1965 aerial photograph adjacent properties to the north, east and south are shown as graded and ready for construction. A new road, similar in appearance to North Harrington Street, is also shown. West of the subject site, across North West Street, is a long commercial building with a parking lot on the north side. The 1971 aerial photograph depicts an apparent car dealership on the eastern adjacent property, a parking lot on the southern adjacent property, parking lots and an office building on the north adjacent property, and the long commercial structure on the west adjacent property as noted first in the 1965 photograph. The 1971 photograph shows a truck or rectangular feature on the north side of the long building. Aerial photographs from 1981, 1983 and 1988 show similar land use on adjacent properties to the 1971 photograph. In 1988, the eastern adjacent property is shown with few cars in the parking lots and portions of the lot appear under construction. Land use on the north, south and west adjacent properties is similar to earlier photographs. The 1993, 1999, 2002, 2004 and 2005 aerial photographs show land use on adjacent properties similar to that of today, with the noted exception of the West residential condominium tower on the southern adjacent property. The 2006 aerial photograph shows grading work and large earth piles on the south adjacent property. Construction of the tower is shown in the 2008 photograph. By 2009, construction of the tower's exterior appears as complete based on the absence of construction equipment and vehicles around the tower. The 2009, 2010, 2011 and 2013 aerial photographs show the adjacent properties as they appear today. Environmentally significant features were not identified on adjoining properties during Mid-Atlantics review of aerial photographs. 5.5.2 Toaoaraahic Maas Historical topographic maps of Raleigh from 1943, 1951 and 1980 and of Raleigh West from 1968, 1973, 1981, 1987, 1988, 1993 and 2002 show the subject site bounded to the north, south, west and east by urban land with no discernable features. Environmentally suspect features were not identified on adjoining properties during Mid -Atlantic's review of historical topographic maps. 5.5.3 Sanborn® Maps Mid -Atlantic's review of historical Sanborn° fire insurance maps revealed the following information concerning the adjoining properties: Properties adjacent to the north • 1914, 1950, 1972 — Multiple dwellings along Tucker Street Properties adjacent to the east, across North Harrington Street (current Wake County GSA Complex). North Harrington Street was formerly known as Fleming Street Mid -Atlantic Associates, Inc. 20 PESA Report — 413 North Harrington Street Project Number: OOOR2644.00 Raleigh, North Carolina 800.486.7568 — www.MAAonline.com • 1914, 1950, 1972 - Multiple dwellings Properties adjacent to the south (current West tower) • 1914 — Multiple dwellings along North Harrington Street and West North Street • 1950, 1972 — Multiple dwellings with two stores that have canopies, but no indication that they have gasoline tanks. Stores are located at No. 406 and No. 412 West North Street. In the center of the south adjacent property (behind a store and dwelling at 404-406 West North Street) are a wood yard and wood shed. Not adjacent, but further south across West North Street is a land parcel used by Standard Oil Company of New Jersey to store gasoline and oil products in tanks, as shown in the 1914, 1950 and 1972 Sanborn Maps. This property is topographically upgradient. Properties adjacent to the west, across North West Street • 1914, 1950, 1972 - Multiple dwellings along North West Street. Environmentally suspect features were identified on the southern adjacent property during Mid - Atlantic's review of historical Sanborn° fire insurance maps. These environmentally suspect features include two stores that might have sold gasoline from pumps under attached canopies, and a "wood yard" in the event that wood preserving activities had taken place. Also, the oil storage shown on the Standard Oil Company property is of environmental concern. The environmentally suspect features on the southern adjacent property and Standard Oil property are considered historical RECs. Phase II soil and groundwater sampling activities were completed by SITECH to address these concerns, which they also previously identified in their 2004 PESA. Some petroleum -related soil contamination was identified, but at concentrations below State action levels (Section 5.2). 5.5.4 City Directories City directories were reviewed by EDR. Our review of the EDR data revealed the following information concerning the adjoining properties: 437 North Harrington Street — Adjacent to the north (current office building) • No Listings for No. 437 in city directories researched 401 Capital Boulevard — Adjacent to the northeast, east and southeast across North Harrington Street (current Wake County General Services Administration complex) • 1992, 1997, 2003, 2007, 2012 — Wake County General Services Center Note: no listings for No. 401 Capital Blvd. prior to 1992. 401 North Harrington Street — Adjacent to the south (current West residential condominium tower). Wake Co. lists address as 401 North Harrington while the West tower has a documented address of 400 West North Street. Historically, this adjacent property contained several parcels with addresses of 401 to 411 North Harrington Street and 400 to 416 West North Street. Previous addresses of 401, 405, 409 North West Street. • 1922, 1926, 1931, 1936 — Residential • 1952 — Correll Coal Company Storage (No. 401) • 1977, 1982 — Roberson Pre -Cast Limited tile contractor (No. 401) • 1988 — Pine State Creamery • 2003, 2007, 2012 — Multiple tenant commercial building including a chiropractor, architect, two photographers Environmentally suspect features were not identified on adjacent properties during Mid -Atlantic's review of historical city directories. 6.0 Site Reconnaissance 6.1 Methodology and Limiting Conditions On December 29, 2014, Mid -Atlantic personnel conducted a physical/visual reconnaissance of the subject site and the surrounding area. Our reconnaissance included a visual inspection of the entire site, including the interior and exterior of the on -site structure. We did not encounter limiting conditions during our site reconnaissance that hindered our ability to identify RECs. Photographs taken during Mid -Atlantic's site reconnaissance are included in Appendix 15.3. Specific features noted in the following sections are shown on Drawing 15.2. 6.2 General Site Setting, Structures and Utilities The subject site is developed with the approximately 7,715 square -foot current building. According to historical documentation, the subject site building was constructed in 1990 and remodeled in 1995 and 2007. Additional site improvements include parking lots, sidewalks and landscaped areas. Parking lots are located adjacent to the north, east and west sides of the building. Vehicular access is provided to the subject site from the east by North Harrington Street. The subject site and its surrounding properties are provided with water and sewer services by the City of Raleigh Utilities Department, electricity by Duke Energy Progress and natural gas by PSNC Energy. 6.3 Exterior Observations 6.3.1 Pits, Ponds or Lagoons Mid -Atlantic personnel observed no evidence of pits, ponds or lagoons on the subject site. Mid -Atlantic Associates, Inc. 22 PESA Report — 413 North Harrington Street Project Number: OOOR2644.00 Raleigh, North Carolina 800.486.7568 — www.MAAonline.com 6.3.2 Stained Soil or Pavement/Stressed Vegetation Mid -Atlantic personnel did not observe obvious evidence of stained soil or pavement or stressed vegetation on the exterior portions of the subject site. 6.3.3 Solid Waste Mid -Atlantic personnel observed no evidence that may indicate that trash, debris or other types of solid waste have been buried or disposed at the subject site. The building is currently not occupied and is used for storage. 6.3.4 Wastewater The facility does not discharge any wastewater with the exception of sanitary waste to the municipal sewer system. 6.3.5 Wells The subject site and surrounding properties are provided with water from the City of Raleigh Utilities Department. Mid -Atlantic personnel did not observe evidence of wells on the subject site. 6.3.6 Septic Systems The subject site and its surrounding properties are provided with sewer services from the City of Raleigh Utilities Department. Mid -Atlantic did not observe evidence of septic systems on the subject site. 6.3.7 Storage Tanks/Vessels Mid -Atlantic personnel observed a square metal pipe sheared off at ground level in the west part of the subject site (Drawing 15.2). The use of the pipe is not clear; however, it does not resemble a typical fill port or vent pipe associated with a UST. Mid -Atlantic did not observe evidence of USTs, aboveground storage tanks or vessels in the exterior areas of the property. 6.3.8 PCBs Older transformers and other electrical equipment could contain polychlorinated biphenyls (PCBs) at a level that subjects them to regulation by the U.S. EPA. PCBs in electrical equipment are controlled by United States Environmental Protection Agency regulations 40 CFR, Part 761. Mid - Atlantic did not observe equipment likely to contain PCBs at the subject site. Pole -mounted electrical transformers that provide service to the site are located on poles in the right of way of North West Street and North Harrington Street at topographically downgradient locations with respect to the subject site. 6.3.9 Surrounding Land Use The subject site is bounded to the north by parking lots and office buildings; to the east, across North Harrington Street, by the Wake County Government Services complex; to the south by the West condominium tower; and to the west by a commercial building containing several offices. Mid -Atlantic Associates, Inc. 23 PESA Report — 413 North Harrington Street Project Number: OOOR2644.00 Raleigh, North Carolina 800.486.7568 — www.MAAonline.com 6.3.10 Other Evidence of Environmental Impacts Mid -Atlantic did not observe other evidence of past, current or future activities on the exterior portions of the site that could potentially have an adverse environmental impact on the subject site. 6.4 Interior Observations 6.4.1 Heating and Cooling Systems The building on the subject site is heated by electric heat pumps according to Mr. Sandreuter. Mid -Atlantic also observed a natural gas meter on the south side of the building. We did not observe vent pipes or fill ports suggesting that tanks are located on the property. 6.4.2 Staining and Chemical Storage/Use Mid -Atlantic personnel observed several small containers of paint and wall filler in one office now used for storage. We did not observe other chemical containers stored in the building. 6.4.3 Drains and Sumps Mid -Atlantic observed floor drains in the building bathrooms. No other floor drains were observed in the building. 6.4.4 Other Evidence of Environmental Impacts Mid -Atlantic personnel did not observe other evidence of past, current or future activities that could potentially have an adverse environmental impact on the subject site. 7.0 Interviews 7.1 Interview with Owner The subject site has the current owner listed as "Harrington Street Ptnr [sic], LLC" by the Wake County Tax Office. Mid -Atlantic conducted an interview with Mr. Gregg Sandreuter, Manager of Harrington Street Partners, LLC. Mr. Sandreuter has been with Harrington Street Partners, LLC for 8 years. Mr. Sandreuter replied "none" to questions pertaining to his knowledge of above -ground storage tanks, LISTS or oil -water separators on the property; chemical spills or environmental concerns associated with the site; water wells or monitoring wells present on the site; past chemical use on the subject site; and chemical spills or environmental concerns associated with adjacent sites. Mr. Sandreuter noted a PESA was previously performed at the subject site by others. Mr. Sandreuter did not have knowledge of waste disposal in, on or under the site or complaints from employees or neighbors about environmental issues. Mr. Sandreuter indicated that to his knowledge a single story office building has been present at the site from approximately 1980 to the present and has been used for office purposes. From 2006 to 2011 the subject site was used as the Sales Office for the West at North ("West") residential condominium development. The general contractor used for construction of the West tower, Choate Construction Company, used offices in the south side of the building between 2006 and 2008. The Glenwood Agency, a real estate firm associated with Mid -Atlantic Associates, Inc. 24 PESA Report — 413 North Harrington Street Project Number: OOOR2644.00 Raleigh, North Carolina 800.486.7568 — www.MAAonline.com the sale of West condominiums, currently uses the building for staging of furniture and interior decorations. Follow-up questions were asked to Mr. Sandreuter after we reviewed the previous PESA, Phase II report and other documentation that he provided. Responses to those questions are summarized in the findings of Section 5.2. 7.2 Interview with Site Manager Mr. Sandreuter also serves as the Site Manager. Refer to Section 7.1 for information. 7.3 Interview with Occupants The property is not occupied, therefore an interview could not be completed, Refer to Section 7.2 for further information. 7.4 Interview with Others Additional interviews were not conducted by Mid -Atlantic as part of this investigation, refer to Section 7.1 for further information. 7.5 Interviews with Local Government Officials Mid -Atlantic personnel consulted the City of Raleigh Fire Department Report System on January 11, 2015 and found no records of environmental incidents at the subject site or the upgradient southern adjacent property. 8.0 Findings The following known/potential RECs, historical RECs and/or de minimis conditions were identified with respect to current and historical land use at the subject site. City directory information indicates that the subject site was used in the past for an equipment rental company (1972) and print shop for an insurance company (1982). It is possible that petroleum, printing inks and potentially solvents were used when the site was occupied by the rental company and print shop. For most of the site's history, the property was used for residences (at least 1922 to 1957) and for offices (1988 to the present). Use of the site for the equipment rental company and print shop is considered a potential REC. The following known/potential RECs, historical RECs and/or de minimis conditions were identified on the surrounding, off -site properties during the performance of this PESA: A leaking UST (LUST) at the Wake County General Services Complex, on the eastern adjacent property, is currently "open" and the release incident location is indirectly upgradient of the subject site. Groundwater contamination by gasoline constituents has been confirmed; however, the extent of the contaminant plume and groundwater flow direction from the release area has not been confirmed. Therefore the LUST incident is Mid -Atlantic Associates, Inc. 25 PESA Report — 413 North Harrington Street Project Number: OOOR2644.00 Raleigh, North Carolina 800.486.7568 — www.MAAonline.com considered a REC and a potential Vapor Encroachment Condition (VEC), because the width of the contaminant plume and the groundwater flow direction below the adjacent property has not been identified (only one monitoring well has been installed). Currently, the one monitoring well with contaminated groundwater is located 130 feet southeast of the subject site. Petroleum -impacted soils were discovered on the southern adjacent, topographically upgradient property approximately 15 feet south of the subject site during drilling of geotechnical borings, and approximately 90 feet south of the subject site during installation of a footer for the West condominium tower. Additional environmental test borings drilled by others during Phase II soil borings in the center and south portion of the southern adjacent property noted soils with petroleum odor within a few feet of the groundwater table. Laboratory test results from analysis of soil samples collected from the Phase II borings indicated petroleum constituents in soils; however, the concentrations were below State cleanup levels in effect at the time. A soil sample from the stockpile of excavated soils removed during installation of the footer was tested and found to contain diesel fuel constituents at 30 mg/Kg, above the current State action level of 10 mg/Kg. The excavated soil stockpile was then removed from the site. The former petroleum impacted soils on the southern adjacent property are considered an REC because petroleum contaminated groundwater could have migrated under the subject site. 9.0 Opinion 9.1 Environmental Concerns and Opinions. Our review of city directory data for the subject site indicates that the subject site was used as an equipment rental company (1972) and a print shop for an insurance company (1982). We have no evidence to suggest that this was a commercial print shop or that the equipment rental shop performed maintenance or stored quantities of petroleum, etc. Based on this and the site's brief land use history as an equipment rental shop and print shop, it is unlikely that these concerns made an environmental impact on the site and the former land use is not considered an REC. Physical observation and laboratory data have documented groundwater contamination on two adjacent sites along with generally low levels of soil contamination. Local topography suggests that the groundwater contamination may have the potential to migrate (or to have migrated) below the subject site. Therefore, the adjacent documented releases discussed in Section 8.0 are considered RECs. 9.2 Data Gaps A data gap is a lack of or inability to obtain information despite good faith efforts. A PESA report should identify and comment on significant data gaps when they affect the Environmental Professional's ability to identify RECs. The Environmental Professional must also identify the sources of information that were consulted to address these significant data gaps. Any exceptions to, or deletions from, these practices are described in Section 2.4 and Section 11.0 of this report. This assessment has revealed no evidence of RECs in connection with the subject site except for the following: Documented groundwater contamination on two adjacent properties. A "mild" diesel fuel odor was noted on the southern adjacent, upgradient property during geotechnical drilling and installation of a Tooter within approximately 90 feet of the subject site. The borings and trench encountered the odor at depths near the presumed location of the water table. Laboratory results have confirmed groundwater contamination at a monitoring well on the eastern adjacent property which is located indirectly upgradient of the subject site. The monitoring well is located approximately 130 feet southeast of the site. 10.2 Recommendations 40 CFR Part 112 requires environmental professionals to consider the information collected during performance of this PESA and render an opinion as to whether additional investigation is warranted to detect contamination. Based on information currently available for the subject site, it is our opinion that additional investigation is not warranted. Due to the close proximity of the impacts noted on the adjacent properties, it is likely that groundwater beneath the subject site is adversely impacted.
