Mr. Duerr:
I spoke with Trudy Beverly of NCDEQ this morning to confirm that she had received the Phase I Limited Site Assessment
Report (Phase I LSA Report).
Ms. Beverly indicated that she had received it and had given it a cursory review. From our conversation, I understand
that based upon her cursory review, the NCDEQ finds the information provided satisfactory to issue a No Further Action
Notice (NFA Notice) with a Notice of Residual Petroleum (NORP).
Ms. Beverly indicated that this is a bit of an unusual situation because ECS will be filing the NORP for a party which is not
its client. She asked that we provide documentation that ECS is authorized to file the NORP on behalf of the property
owner (i.e., the State of North Carolina). She indicated that this documentation could be in the form of an email.
Ms. Beverly indicated that she may not be able to review the Phase I LSA Report in detail until next week due to previous
commitments.
I have copied Ms. Beverly and Joy Wayman of NC Department of Administration. (Trudy — if I have missed something,
please let us know. Joy — this is to let you know what is likely needed to finalize the NFA Notice).
Adam, can you, or someone from your firm, reach out to your contacts with the State of North Carolina to request that
they provide ECS with documentation that it is authorized to file the NORP on behalf of the State of North Carolina?
