Partial Facility Compliance Inspection

The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

ADDITIONAL COMMENTS:
01 – This Partial Facility Compliance Inspection was conducted to evaluate the progress made on the removal of old Yard Waste that had been stockpiled from past years.
02 – Approval was granted to conduct a burn of the large material that had been there for years. 03 – The Division of Air Quality and The NC Forestry Service were contacted for Approval.
04 – Non-conforming solid waste has been removed from the old waste and better screening of the waste is currently
being implemented by the Town of Edenton Staff. 05 – Ash from the burn will be land applied on a Division of Water Resources Permitted wastewater land application site.
06 – Approval was granted from David May, Division of Water Resources Supervisor in the Washington Regional Office.
07 – No Waste Management Plan for the land application of the ash was required by Adam Ulishney of the Division of
Waste Management, Solid Waste Section, Environmental Compliance Branch in the Raleigh Central Office. 08 – Rock and Asphalt millings are being hauled in to construct an all-weather road and pads on the facility.
09 – Katy Shook, NC Cooperative Extension Agent in Chowan County was brought in to assist if a Waste Management
Plan was needed. Katy did however provide a land application rate on paper. A copy was sent to John College for files if needed,
10 – Facility staff will proceed to apply the ash as weather allows.
11 – This Facility is starting to look good.
