Review of the report indicates that measurable free product did not exist in MW-1 and RW- 1 during the most recent gauging event. Therefore, please conduct a groundwater sampling event of all incident monitoring/recovery wells and report the findings in a monitoring report to the UST Section, Mooresville Regional Office within 60 days from the date of this notice. All sampling and reporting must be conducted in accordance with the most recent version of the Guidelines for Assessment and Corrective Action for UST Releases. Effective October 1, 2004, the Department requires that all work following the submittal of the Limited Site Assessment Report (Title 15A NCAC 2L .0405) be preapproved if State Trust Fund reimbursement is anticipated. To comply with this requirement, a completed PreapproVOClaim Authorization Form, encompassmk the required remedial activities, must be received in this office within 14 days of the date of this letter. Upon completion of the preapproved activities, you should submit your claim promptly. Reimbursement funds are budgeted based on completed preapprovals, but lengthy delays in reimbursement can occur if claims are not submitted immediately following work completion. The Free Product Recovery Report/Receptor Survey Update will be maintained in the Mooresville Regional Office. The subject incident has been determined by the Department, in response to North Carolina General Statute (NCGS) 143-215.94E(e4)(1), to be of sufficiently high priority to allow funding by the State Trust Fund Program. Therefore, you are directed to proceed with assessment or remediation activities. Specifically, you must continue free product recovery for the petroleum release that occurred from the underground storage tank, identified as UST-1 (6,000 gallon fuel oil underground storage tank), and submit a Free Product Recovery Report to the Mooresville Regional Office- UST Section within 45 days of the date of this Notice. At a minimum, you must conduct passive free product removal and update the current product thicknesses for MW-1 and RW-1 (see attached). Also, a receptor survey update must be included in the Free Product Recovery Report to update any previous survey results and any changes to the risk classification. Please note that this work must be performed by a North Carolina Licensed Geologist or Professional Engineer and must be conducted in accordance with the rule and the most recent version of the Guidelines for Assessment and Corrective Action for UST Releases. You may be eligible for reimbursement from the Leaking Underground Storage Tank Commercial Trust Fund for some or all of the costs for this and subsequent work (though deductibles and . reasonable rate limits do apply). Reimbursement also requires prior written approval of the specific tasks and costs for the necessary work. Attached is a hard copy of the Preapproval / Claim Authorization Form. Upon completion of the preapproved activities, you should submit your claim promptly. Many environmental consulting firms that work in North Carolina can help you apply for funding, and can prepare the necessary pre -approval and claim forms on your behalf for a small fee. Preapproval must be obtained even if Fund eligibility has not been determined where later reimbursement will be sought. Except where otherwise noted, work performed during initial abatement and assessment phases and during, as determined by the Denartment. emeraencv resnonse actions. do not reouire nreanoroval. Tasks or phases of work requiring preapproval include: • Any Initial Abatement Action or Limited Site Assessment activity that varies from or exceeds the scopes of work defined in the STIRA (tank closure) or ACA (assessment) guidelines or the Reasonable Rate Document, (with the exception of those variations specifically allowed in the aforementioned documents). • All work performed after a Risk, Rank and Abatement determination is made, typically following completion of a Limited Site Assessment.. • All aggressive fluid -vapor recovery events after completion of the first emergency response event. • Any task in the Reasonable Rate Document that is defined as requiring preapproval. Preapproval Procedures 1 A completed signed Preapproval/Claim Authorization Form (Task Authorization, or TA) and a proposal detailing the work to be performed at a specific site must be submitted to the appropriate Regional Office for preapproval. The proposal must describe the scone -of -work and the rationale for conducting the or000sed activities. 2 The Preapproval form must be completed in full, with the exception of those portions explicitly reserved for UST Section personnel (designated as 'Incident Manager','RO', 'CO', and 'LIST Section'). This includes the completion of the required text in the form header. as well as lhe'Task/Lab'.'Unitffvoe', and'Rate/Price' columns. 3 Once approval is granted, the Regional.Office will send a copy of the signed Preapproval form directly to the Main Consultant/Contractor. If verbal preapproval or a change is authorized over the telephone or by email, it is the responsibility of the consultant to prepare a written Preapproval form as outlined above and ensure that this document is submitted to the Regional Office within one week of the verbal authorization. Failure to acquire this document will result in non-payment of the costs. 4 After receiving the signed Preapproval form, the approved activities may be initiated. Any costs incurred prior to the final UST Section authorization date on the Preapproval may not be claimed as a "preapproved" cost under that form. 5 If the Main Consultant/Contractor discovers that unexpected tasks must be performed and/or costs will be incurred that will exceed the preapproved amount, the Main Consultant/Contractor must submit a'supplementary' Preapproval form, designated as such in the form header. List all previous Task Authorization numbers associated with this revised request and include photocopies of the earlier approved Task Authorization form(s) along w th a written justification to the Regional Office. This form (which replaces the earlier Amended Preapproval/Claim Authorization Form) must be signed and dated by all applicable UST Section staff prior to conducting the additional work. Please note that multiple Task Authorizations may be submitted with a single reimbursement claim. Once claimed, however, each Task Authorization is closed and no other costs may be claimed under that oreaonroval. Additionally. only one claim may be submitted for a aiven site durina a sinale auarter or 3-month Deriod. 2 Complete the "Final Reimbursement" section of all Preapproval forms included with a reimbursement claim. Designate the applicable date(s) of work for each task and the amount claimed for these dates under each Preapproval. This portion of the Preapproval form must be completed for the reimbursement request to be properly reviewed. Any failure to properly document the required information will result in the return of any filed claim, unprocessed. 3 Ensure that the aforementioned dates and subtotals correspond correctly to any information on the invoices, Primary Forms, and Secondary Forms submitted with the reimbursement claim. Inconsistencies within the provided documentation will result in reimbursement reductions or denials. Records indicate that you are the owner of this UST system. This letter is a standard notice explaining the actions you must take as a result of the release or discharge in accordance with North Carolina statutes and rules. The UST Section of the Division of Waste Management _ administers the state's rules for LISTS and the required response for petroleum releases. Those rules are located in Title 15A, Subchapter 2L and Title 15A, Subchapter 2N of the North _ Carolina Administrative Code (NCAC). As a responsible party, you are required to comply with the release response and corrective action requirements of 15A NCAC 2L .0115(c), which include the requirements established in 15A NCAC 2N. Listed is a general description of actions you must take to comply with State rules. For a detailed description of your requirements please refer to the enclosed rules and the most recent version of the UST Section guidelines for assessment and corrective action. The LSA Report is due in this office within 120 days of the date of this letter. Based on a review of the information submitted in the LSA, the Department will classify the risk of the discharge or release as high, intermediate or low. At that time, the Department will also classify the land use of the site as either residential or industrial/commercial. You will be notified of the risk and land use classifications once review of your LSA Report is completed. 2) Please note that before you sell or request a "No Further Action" determination for a property that has not been remediated to below "unrestricted use" standards, you must file a Notice of Residual Petroleum ("Notice") with the Register of Deeds in the county where the property is located (NCGS 143B-279.9 and 143B-279.11). Unrestricted use standards for groundwater and soil are the groundwater quality standards and interim standards contained in 15A NCAC 2L .0202 and the residential maximum soil contaminant concentrations established in 15A NCAC 2L .0115, respectively. The Notice must first be approved and notarized by the UST Section prior to conveyance of a property or prior to receiving a "No Further Action" determination, whichever occurs first. The Notice must contain a legal description of the property containing the source of contamination and legal descriptions of any other properties that you own (or control) that are contaminated by the release. The Notice must include appropriate land use restrictions for these properties. In addition, the Notice must identify all other properties (adjacent, adjoining, downgradient, etc.) on which contamination is known to exist at the time the Notice is prepared. If contamination is located on more than one parcel or tract, the UST Section may require that a composite map or plat be prepared. After the Notice is filed with the Register of Deeds, a certified copy of the filed Notice must be submitted to the UST Section. Additional guidance including the language and format.of the Notice is available by calling this regional office or visiting the UST Section web site at http://ust.enr.state.ne.us. If you believe that any of the information requested above has already been submitted, please notify me of the date, title, and content of the documents that contain the information. Your prompt attention to the items described herein is required. Failure to comply with the State's rules in the manner and time specified, may result in the assessment of civil penalties and /or the use of other enforcement mechanisms available to the State. Each day that a violation continues may be considered a separate violation. If you believe you are not the responsible party notify the UST Section within 15 days of the date of this letter.
